Copyright and Licensing. Broker represents and warrants to Licensee that Broker has and shall have throughout the term of this Agreement the full authority to broadcast the Programming on the Stations and that Broker shall not broadcast on the Stations any material in violation of the Copyright Act. All music supplied by Broker shall be: (i) licensed by ASCAP, SESAC or BMI; (ii) in the public domain; or (iii) cleared at the source by Broker.

The client is not authorized to use the images deriving from this assignment for commercial purposes. Digital or analog editing of deliverables is prohibited without explicit written consent by the photographer in advance. Other suppliers delivering products and/or services during a wedding/photo shoot are to contact the photographer directly to receive photographs and in order to be granted permission for usage. Additional terms and conditions apply for commercial use. Images are not to be shared or otherwise made public without clear and unequivocal mention of the photographer’s name. The client is, unless otherwise agreed upon, not authorized to sublicense any images to a third party, nor transfer their own license. If the client desires to send in an image to participate in a contest, or have an image published by a third party, the client is to ask for written permission at all times. Every unauthorized use of images, that has not been previously agreed to, will be considered copyright infringement. In this case the photographer will charge the valid SOFAM-rates. This compensation of damages does not reserve the client the right to any images created by the photographer.

CSC, prior to the Service Commencement Date, must furnish CCSL a copy of a licensing agreement for any of said materials which contains a copyright for unlimited future use at the Facility by CCSL or its subcontractors without payment of any royalty or fees.
