Common use of COURT SUBPOENAS Clause in Contracts

COURT SUBPOENAS. Department personnel must report as directed when summoned by subpoena or a written notice to appear. Personnel are to be on time, have a copy of their police report, be familiar with the facts of the case and prepared to testify, dressed in appropriate court attire. Personnel are to contact the Court Liaison, District Attorney’s Office, or person responsible for sending the subpoena 24 hours prior to their scheduled appearance, or the Friday before a Monday appearance. Notification procedures are subject to change, and will be detailed by written Special Order. If the appearance is cancelled within the 24-hour period prior to the proceeding, compensation will be processed as a recall for off-duty employees. Otherwise, the officer must appear at the District Attorney’s Office, or other specified venue, must sign in on a roster (unless extraordinary events prevent the Officer from signing the roster), and make contact with the person responsible for handling the case. If an Officer’s subpoena is cancelled while in route to Court, compensation in these instances will be processed as a recall for off-duty employees and not compensated at the overtime rate.
