Covered Units. The Covered Units which are included within this Contract are:

Covered Units. At the Property, a building without an elevator, the eight ground-floor units—Units 101 to 108—are “covered units” within the meaning of the Act. The standards used to assess compliance with the Act under this Agreement are the Guidelines and the Design Manual.
Covered Units. At the Subject Properties, all ground-floor units in all non-elevator buildings and all units in buildings with elevators are “covered dwelling units” within the meaning of the Act. Each covered dwelling unit at the Subject Properties, and the public and common-use areas at the Subject Properties, are subject to the design and construction requirements of the Act. The standards used to assess compliance with the Act under this Agreement are the Act, the Guidelines, and the fair housing design standards in effect at the time a Subject Property was constructed. With respect only to alterations made pursuant to Section II(E)(5) of this Agreement, the standard used to assess compliance of such alterations shall be ANSI 2003 and the applicable codes for renovations in the jurisdiction in which each Subject Property is located (collectively, all such standards, the “Applicable Fair Housing Standards”). The standards used to assess compliance with the Americans with Disabilities Act, Title III, that apply in addition to the Act to areas that serve the general public, such as the rental office and public parking areas, are the Americans with Disabilities 1991 and 2010 ADA Standards for Accesssible Design.
Covered Units. The Contractholder or its Third Party Administrator shall be responsible for providing the Company with monthly updates as to the number of Covered Units throughout the Contract Period. The number of Covered Units reported to the Company by the Contractholder or its Third Party Administrator is subject to audit by the Company as appropriate. An individual or family shall be considered a Covered Unit in a Contract Month if he/she/they were considered covered by the Employee Benefit Plan at any time during the Contract Month.
Covered Units i. At a mutually agreeable time at least twelve (12) months but not more than twenty-four (24) months from the effective date of this Agreement, the Xxxxxx Defendants will request the Inspector conduct an inspection of alterations to covered units at the Subject Properties as set forth in Appendices 1-5 to this Agreement. The inspection shall be of a sample to be determined by the Inspector of the completed covered unit alterations at the Subject Properties to determine if the alterations have been performed according to the terms this Agreement. It is contemplated by the Parties to this Agreement that this inspection may take place contemporaneously with the scheduled inspection of the public and common use and exterior accessible routes at the Subject Properties, as described in Paragraph 8.a. above. It is further understood by the Parties that the sample inspection of covered unit alterations shall not require inspection of every individual dwelling unit so altered, and may in fact take place before all such alterations required by Appendices 1-5 are completed. ii. The Inspector shall note the results of each covered unit inspection, including deficits, if any, in a written report and shall send that report to counsel for the Xxxxxx Defendants. If the inspection indicates that any of the required alterations have not be made as specified, the Xxxxxx Defendants agree to correct any deficiency within sixty (60) days of receipt of the Inspector’s report. This process shall continue until the Inspector certifies that all of the noted deficits have been corrected. The Inspector shall provide such certification of full completion of the alterations from the sample inspection to counsel for all Parties. Within sixty (60) days of the expiration of the thirty-six (36) month limit for completion of alterations to the covered units, the Inspector shall certify to counsel for all Parties that the alterations required to all covered units at each Subject Property have been completed, based on the sample inspection and any additional inspection necessary.

  • Units Interests in the Partnership shall be represented by Units. The Units initially are comprised of one Class: Class A Units. The General Partner may establish, from time to time in accordance with such procedures as the General Partner shall determine from time to time, other Classes, one or more series of any such Classes, or other Partnership securities with such designations, preferences, rights, powers and duties (which may be senior to existing Classes and series of Units or other Partnership securities), as shall be determined by the General Partner, including (i) the right to share in Profits and Losses or items thereof; (ii) the right to share in Partnership distributions; (iii) the rights upon dissolution and liquidation of the Partnership; (iv) whether, and the terms and conditions upon which, the Partnership may or shall be required to redeem the Units or other Partnership securities (including sinking fund provisions); (v) whether such Unit or other Partnership security is issued with the privilege of conversion or exchange and, if so, the terms and conditions of such conversion or exchange; (vi) the terms and conditions upon which each Unit or other Partnership security will be issued, evidenced by certificates and assigned or transferred; (vii) the method for determining the Total Percentage Interest as to such Units or other Partnership securities; and (viii) the right, if any, of the holder of each such Unit or other Partnership security to vote on Partnership matters, including matters relating to the relative designations, preferences, rights, powers and duties of such Units or other Partnership securities. Except as expressly provided in this Agreement to the contrary, any reference to “Units” shall include the Class A Units and any other Classes that may be established in accordance with this Agreement. All Units of a particular Class shall have identical rights in all respects as all other Units of such Class, except in each case as otherwise specified in this Agreement.
