Monthly Updates. The Contractor must provide the Design Professional and the Owner with monthly updates of the Overall Project Schedule indicating completed activities and any changes in sequencing or activity durations. (See also Articles 2.1.2 and 2.1.5).

(a) Contractor's estimated percentage complete and remaining duration for each activity not yet complete.
(b) Actual start/finish dates for activities as appropriate.
(c) Identification of processing errors, if any on the previous update reports.
(d) Revisions, if any, to the assumed activity durations including revisions for weather impact for any activities due to the effect of the previous update on the schedule.
(e) Identification of activities that are affected by requested or proposed changes to the Work.
(f) Resolution of conflict between actual Work progress and schedule logic. When out of sequence activities develop in the Contract Schedule because of actual construction progress, Contractor shall submit revision to schedule logic to conform to current status and direction. The District Representative will review the updated information and meet with Contractor each month at the Site to determine the status of the Work. If agreement cannot be reached on any issue, Contractor will use the District Representative's determination in the processing of the update. Tenant Improvement Payments pursuant to this Facilities Lease will be based on the update of the Contract Schedule. No Tenant Improvement Payments will be made without the required monthly update of the Contract Schedule.

Ambit shall provide the JCDC with monthly updates on: (i) the AC220 development program timeline; (ii) the status of the AC220-002 and AC220-003 Clinical Trials and any changes relevant to sample logistics from such trials; and (iii) feedback on interactions with CDER concerning requirements for the Companion Diagnostic. Genoptix shall provide the JCDC with monthly updates on: (1) development and validation of the Companion Diagnostic; (2) status of preparation of the PMA for the Companion Diagnostic; (3) feedback on interactions with the CDRH concerning requirements for the Companion Diagnostic; and (4) any actual variances or expected variances to the approved budget for Companion Diagnostic Activities.

5.1.3.2 PM/CM will review the updated information and meet with CONTRACTOR each week at the SITE to determine the status of the WORK. If agreement cannot be reached on any issue, CONTRACTOR will use PM/CM’s determination in the processing of the update.
5.1.3.3 CONTRACTOR will incorporate PM/CM’S review comments and submit two (2) copies of the report.
5.1.3.4 Progress payments pursuant to the CONTRACT will be based on the update of the CONTRACT SCHEDULE.

On a monthly basis, if not more, during the construction of the Apartments, and at all times upon RCEB’s request, Owner shall provide RCEB with an update as to the progress of its work. Updates may include lender construction inspection reports. RCEB shall report such project updates to DDS on a monthly basis and/or as requested by DDS.

Monthly Updates. A representative of Buyer will be available to meet on a monthly basis with a representative of Seller in order to review with such representative the status of Buyer's business development, including developments regarding the Assets purchased hereunder. The Seller understands and acknowledges that such information, to the extent that it has not been disclosed to the public, may be deemed material non-public information and the Seller and its representatives will be prohibited from trading in securities of the Buyer on the basis of such information.
