COVID Waiver. Landlord and Tenant hereby waive any and all claims, losses (including, without limitation, loss of revenue), damages, causes of action, costs, expenses (including, without limitation, attorneys’ fees), rights or remedies, whether known or unknown, liquidated or unliquidated, whether arising from contract, tort, statute or regulation, and whether arising now or in the future, stemming or arising directly or indirectly from or in connection with, or resulting directly or indirectly from, COVID-19 Matters (defined below) (the “COVID-19 Matters Waiver”); it being the intention of the parties to make this waiver as broad and as general as the law permits. The COVID-19 Matters Waiver includes (as to COVID-19 Matters), without limitation, all rights and remedies (such as, without limitation, remedies for rent abatement or suspension, or termination of this Lease) related to claims for force majeure, casualty, condemnation, deprivation of services, constructive eviction, breach of the covenant of quiet enjoyment, frustration of purpose, or impossibility of performance. For purposes hereof, “COVID-19 Matters” means all matters, effects, or circumstances caused in whole or in part by or directly or indirectly resulting or arising from or in connection with coronavirus or COVID-19 such as, without limitation, loss of revenues, customers, business, sales, or traffic due to governmental closure orders, or voluntary or governmentally required or recommended quarantines or sequestering, in each case if caused in whole or in part by or directly or indirectly resulting or arising from or in connection with coronavirus or COVID-19, in each case regardless of the year or time of occurrence.
COVID Waiver. In consideration of being allowed to participate in any way in the Cape Fear Flyers NC Inc. youth running program, related events and activities, the undersigned acknowledges, appreciates, and agrees that:
COVID Waiver. In consideration for receiving permission to be on premises at Xxxxxx’s Dance Studio (hereinafter the “Activity or Activities”), I, on behalf of myself and any minor child/children for whom I have the capacity to contract, hereby acknowledge and agree to the following: 1. I understand the hazards of the novel coronavirus (“COVID-19”) and agree to follow the Centers for Disease Control and Prevention (“CDC”) guidelines regarding COVID-19, as well as the safety protocol required for participation in the Activity. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the CDC guidelines are regularly modified and updated and I accept full responsibility for familiarizing myself with the most recent updates, as well as the updates regarding The Activity’s published COVID-19 protocol. 2. Notwithstanding the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to participate in Activities. 3. I acknowledge and fully assume the risk of illness or death related to COVID-19 arising from my being on the premises and participating in the Activities and hereby release, waive, discharge, and covenant not to sue (on behalf of myself and any minor children from whom I have the capacity contract) JSW Ventures dba Stacey’s Dance Studio, Inc., their respective administrators, directors, agents, employees and assigns (the “RELEASEES”) from any liability related to COVID-19 which might occur as a result of my being on the premises and participating in the Activities provided. I hereby release, discharge, and covenant not to sue JSW Ventures dba Xxxxxx’s Dance Studio, Inc., its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the “Releasees” herein) from all liability, claims, demands, losses or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the “releasees” or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of Releasees, I will indemnify, save and hold harmless each of the Releasees from any loss, liability, damage, or cost, which may incur as the result of such claim. COVID Waiver. All in-person campers and students are required to follow safety measures mandated by public health and requested by Xxxxxxxx for the duration of COVID 19. Refusal to do so will result in a request to leave the academy space, at which point parents will be notified. Repeated failure to comply with COVID safety regulations will result in removal from the program. While every effort is made by Centauri to maintain a safe environment during COVID 19 and to mitigate risk of infection, parents sending their child to in-person programs during the pandemic must recognise and accept the risk. By registering your child in our programs, you agree Centauri, the directors, staff, contracted workers and volunteers can accept no responsibility should your child be exposed to COVID 19.
COVID Waiver. By participating in programs, services, and activities of Karmê Chöling, you agree to the following: (Please initial on each line to indicate you have read the following) I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. If any of these symptoms manifest while at KCL, I will immediately quarantine and notify KCL Staff. I have not traveled internationally within the last 14 days. I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19. I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities. I am following all CDC recommended behavior guidelines as much as possible to limit my exposure to the Coronavirus /COVID-19. I have taken all the CDC prescribed precautions to protect myself including getting vaccinated for COVID and following my healthcare providers’ recommendations.
COVID Waiver. Please understand that despite all the precautions that you, other members, and/or Trainer may take, we cannot guarantee your health or safety, and you may still be exposed to COVID-19, including through interactions with other individuals who have COVID-19. By executing this release and gaining access to the facility, you, on behalf of yourself, your heirs, beneficiaries, representatives, successors and assigns: (1) voluntarily assume all risks associated with any exposure to COVID-19, including, but not limited to suffering any type of medical condition, illness and, potentially, death; and (2) knowingly and voluntarily waive, release, covenant not to sue, forever discharge, indemnify, and hold harmless Trainer, its parents and subsidiaries and their respective officers, directors, employees, contractors, agents, representatives, successors and assigns (“Released Parties”) from any and all liability, damages, losses, suits, demands, causes of action to the fullest extent permitted by the laws of this state, or any other claims of any nature whatsoever, arising out of or relating in any way to your use of the facility and your potential exposure to COVID-19.
