Credit Assessments Sample Clauses

Credit Assessments. (1) The Vendor will perform its Services as specified in the CTSA. This expectation is reasonable, within normally acceptable business practices, and in the best interests of the State and the Customers. (2) DIR has chosen to address a majority of the risks related to Vendor perfor- xxxxx through the assessment of Credits against Rates To DIR and Prices for Services. The Credits provisions described below are negotiated based on Vendor’s Response to the RFO. The following provisions form the basis for as- sessing Credits: (A) If the Vendor does not fulfill its Services as specified under the CTSA, DIR and the Customers will be damaged; (B) Establishing the precise amount or value of such damage would be diffi- cult to quantify; (C) Except as otherwise provided in the CTSA, Credits will start to accumu- late immediately following the end of the Service billing period in which an applicable SLA was not met; notice of a Deficiency may be communi- cated in one of three ways: Vendor reports the Deficiency in its monthly SLA Non-compliance Report, Exhibit E, Attachment E-5 hereto; DIR noti- fies the Vendor of such Deficiency based on its independent information; or, the affected Customer notifies DIR and the Vendor of such Deficiency based on its experience with the Service. (3) In all instances in which the delay or failure to perform is caused by a Force Majeure Event or other event which excused performance under the terms of the CTSA, Credits will not be assessed, and the calculation of performance will be adjusted for the periods of delay caused by such Force Majeure Event or excused under the terms of the CTSA.
Credit Assessments. (a) We may determine your creditworthiness by doing a credit assessment of you and using any information we are permitted by law to use to do so. (b) We may disclose your Personal Information to a credit reporting body before, during or after we sell electricity to you: (i) to obtain a consumer credit report about you if you have applied for consumer or commercial credit; and/or (ii) to allow the credit reporting body to create or maintain a credit information file about you. (c) In assessing your creditworthiness under this clause 6, we may only disclose the following types of information: (i) your identity particulars (for example, name and address); (ii) the existence of your Market Agreement with us; (iii) the fact that we are a current credit provider to you; (iv) any payments overdue for more than 60 days that we have tried to recover from you; (v) any payments that are no longer overdue; (vi) that, in our opinion, you have committed a serious credit infringement; (vii) default payments from you for more than $150 has been dishonoured more than twice; and (viii) any other information we are permitted to disclose under consumer credit laws. (d) You agree we may obtain a consumer credit report from a credit reporting body containing information about you for the purpose of assessing your creditworthiness. (e) We may also exchange permitted credit information about you with other credit providers both to assess your creditworthiness and in the case of a payment default by you (either with us or with the other credit provider).
Credit Assessments. DIR has chosen to address a majority of the risks related to Successful Respondent performance through the assessment of Credits against Rates to DIR and Prices for Services. The following provisions form the basis for assessing Credits as described in the CTSA: a) If the Successful Respondent does not fulfill its Services as specified under the CTSA, DIR and the Customers will be damaged;
Credit AssessmentsYou agree that our provision of, and your ability to use, the Services is subject to: (a) successful completion of the initial, and any subsequent, credit evaluations; and (b) there being no material changes to your credit status during the term of these terms.
Credit Assessments. 17.1) The Service Provider reserves the right to utilise information obtained from credit reference agencies to help make credit decisions and for the prevention of fraud 17.2) The Service Provider cannot accept responsibility for the accuracy of the information supplied by credit reference agencies or accept any liability for the consequences of the Service Provider declining to register any person as a result of such information.
Credit Assessments. 18.1 You consent to us conducting a credit assessment of you as part of determining whether or not we will supply and make available the System to you.
Credit Assessments.  AMS Personnel Group (Pty) Limited shall conduct a credit assessment before we lend any amount of money to you and will not lend and advance any amounts to you unless AMS Personnel Group (Pty) Limited is satisfied with the result of that credit assessment and that the circumstances which determine your credit risk to us have not changed.
Credit Assessments. Armor Financial Services(Pty) LTD shall conduct a credit assessment before Mzansi Risk Management (Pty) LTD lends any amount of money to you and will not lend and advance any amounts to you unless Mzansi Risk Management (Pty) LTD is satisfied with the result of that credit assessment and that the circumstances which determine your credit risk to us have not changed.
Credit AssessmentsThe Company will carry out a credit assessment of each Authority: 4.1.1 at the time of accession; 4.1.2 at the time of entry into an Authority Loan; 4.1.3 in any event, not less than once per year whilst Authority Loans to that Authority are outstanding, and will perform ongoing monitoring. The Company will undertake an external review of its credit assessment process by an appropriately qualified adviser not less than once every five years.
Credit Assessments. Excalibur shall credit assess the Customer from time to time to assess the Customer’s risk profile. Any negative credit assessment shall enable Excalibur to stop Activating SIM Cards until such credit assessment improves.
