Criminal Charges: Conviction and Dismissal. In the event an employee is formally 27 charged by law enforcement officials with a criminal drug/alcohol statute offense 28 that violates the Act, the employee shall be suspended from service without pay 29 until either criminal charges are dismissed or a conviction entered in the appropriate 30 court. In the event the formal charges against the employee result in a conviction 31 under any criminal drug/alcohol statute, such conviction shall be grounds for 32 immediate personnel action up to and including termination, without compliance 33 with Article III, Section D. In the event charges are dismissed or an alleged violation 34 does not result in a conviction, the employee will be restored to full service with 35 back pay. 36
