Customer Properties. | For the Term of this Agreement, Customer grants to Cutover a royalty-free, limited, non-exclusive, non- sublicensable licence to use Customer’s company name, logo and/or relevant trademarks (“Customer Properties”) to market and promote the Cutover Services purchased by Customer, including the right to refer to Customer as a user of Cutover Services, to add the Customer Properties to Cutover’s customer list and website at xxx.xxxxxxx.xxx, and to use them in connection with the promotion of any published Case Study (if applicable pursuant to Clause 7.10). Cutover will comply with Customer’s reasonable marketing and brand guidelines, and will use Customer’s preferred form of logo providing the same are sent by email to Cutover’s Legal Notice Email. Customer can communicate updates to its logos and marketing and brand guidelines in the same manner during the Term.

  • Customer Property Customer Property is and shall remain your sole and exclusive property. “Customer Property” means all graphic user interface, text, content, images, video, music, designs, products, computer programs, drawings, documentation and other materials of any kind posted, submitted, provided or otherwise made available to us by you or an Authorized User in connection with the Products and Services. Customer Property may also contain Personal Information which is defined in Section 5.

  • Materials and Equipment ‌ Material means property that may be consumed or expended during performance, component parts of a higher assembly, or items that lose their individual identity through incorporation into an end item. Equipment means a tangible item that is functionally complete for its intended purpose, durable, nonexpendable, and needed for performance. Materials and Equipment shall be priced in accordance with the terms of the task order award, contract type, and applicable FAR and agency-specific regulatory supplements. Unless otherwise directed by task order terms and conditions, the Contractor may apply indirect costs to materials and equipment consistent with the Contractor’s usual accounting practices.

  • Customer Equipment Customer represents and warrants that it owns or has the legal right and authority, and will continue to own or maintain the legal right and authority during the term of this Agreement, to place and use the Customer Equipment as contemplated by this Agreement. Customer further represents and warrants that its placement, arrangement, and use of the Customer Equipment in the Internet Data Centers complies with the Customer Equipment Manufacturer's environmental and other specifications.
