Deliverable Material. As the Design-Build Work progresses (or upon the termination of the Design- Builder’s right to perform the Design-Build Work), the Design-Builder shall deliver to the Owner all Deliverable Material. The provisions of Section 11.6 (Property Rights) shall apply to any Deliverable Material used by the Design-Builder in the Design-Build Work that is proprietary in nature or otherwise subject to the property rights of a third party. Deliverable Material provided to the Owner shall be the property of the Owner, and the Owner shall have the right to use, reuse, reproduce, publish, display, broadcast and distribute the Deliverable Material and to prepare derivative and additional documents or works based on the Deliverable Material without further compensation to the Design-Builder or any other party. The Owner shall have the right from and after the Contract Date to use (or permit use of) all such Deliverable Material, all oral information received by the Owner in connection with the Design-Build Work, and all ideas or methods represented by such Deliverable Material, without additional compensation. The Owner’s use of any such Deliverable Material for any purpose other than the Design-Build Improvements shall be at its own risk and the Design-Builder shall have no liability therefor. For Deliverable Material provided to the Owner in paper format, upon request by the Owner, the Design-Builder agrees to provide the Deliverable Material to the Owner in an appropriate, usable and editable electronic format (e.g., Word file, Excel spreadsheet, AutoCAD file).

Deliverable Material. The Design-Builder shall have delivered to the Owner all Deliverable Material required by Section 3.16 (Deliverable Material);
Deliverable Material. As the ICI Design/Build Work progresses (or upon the termination of the Lessee's right to perform the ICI Design/Build Work), the Lessee shall deliver to the Lessor all documents, reports, submittals and other materials ("Deliverable Material") required to be delivered under Appen dices 4 and 5. The provisions of Section 17. 2 shall apply to any Deliverable Material used by the Lessee in th e ICI Design/ Build Work. The Lessor shall have the right from and after the Contract Date to use (or permit use of) all such Deliverable Material, all oral information received by the Lessor in connection with the ICI Design/Build Work, and all ideas or methods represented by such Deliverable Material without additional compen sation for any other public purpose in connection with w astewater collection and treatm ent, and sludge incineration by the Lessor; provided that the Lessor acknowledges and agrees that (i) such Deliverable Material was prepared solely with respect to the ICI Design/ Build Work, (ii) the Lessee makes no representations or warranties regarding the suitability of such Deliverable Material for any other purpose; (iii) the use of such Deliverable Material for any other purpose shall be solely at the risk of the Lessor, and the Lessor waives all claims against the Lessee, its employees and subcontractors of any kind or n ature (including claims under contract, tort or any other law) with respect to use of such Deliverable Material for any other purpose.
Deliverable Material. The Developer shall deliver to the County all design documents, reports, submittals and other materials (“Deliverable Material”) required to be delivered under Appendix 6 (Design-Build Work Review Procedures), Appendix 7 (Commissioning), Appendix 10 (Insurance Requirements) and Appendix 14 (Reports and Records). With respect to those Deliverable Materials required to be delivered within a certain number of days after the Effective Date under Appendix 4 (Design and Construction Standards), Appendix 6 (Design-Build Work Review Procedures), Appendix 7 (Commissioning), Appendix 10 (Insurance Requirements) and Appendix 14 (Reports and Records), such obligation to provide such Deliverable Materials shall be counted from the Effective Date. The County shall have the right from and after the Effective Date to use (or permit use of) all such Deliverable Material, all oral information received by the County in connection with the Design-Build Work, and all ideas or methods represented by such Deliverable Material, without additional compensation. The County’s use of any such Deliverable Material for any purpose other than the Project shall be at its own risk and the Developer shall have no liability therefor.
Deliverable Material. The Developer shall have delivered to the County all Deliverable Material required by subsection 7.1(H) (Deliverable Material) needed to achieve Final Completion;
Deliverable Material. As the Design-Build Work progresses (or upon the termination of the DBOM Contractor’s right to perform the Design-Build Work), the DBOM Contractor shall deliver to the BWS all Deliverable Material. The provisions of Section 22.6 (Property Rights) shall apply to any Deliverable Material used by the DBOM Contractor in the Design-Build Work that is proprietary in nature or otherwise subject to the property rights of a third party. The BWS shall have the right from and after the Contract Date and notwithstanding any termination of this Service Agreement to use (or permit use of) all such Deliverable Material, all oral information received by the BWS in connection with the Design-Build Work, and all ideas or methods represented by such Deliverable Material, without additional compensation. The BWS’s use of any such Deliverable Material for any purpose other than in connection with the continued development, implementation, operation or expansion of the Project shall be at its own risk and the DBOM Contractor shall have no liability therefor. The provisions of this Section shall survive any termination of this Service Agreement.
Deliverable Material. The DBOM Contractor shall have delivered to the BWS all Deliverable Material required by Section 4.7 (Deliverable Material).
