Delivery Rate. Seller shall endeavor to deliver and Buyer shall endeavor to take Styrene ratably throughout each Month, subject to the occurrence of any Excusing Conditions and subject to any scheduled shutdowns which have been communicated between the Parties.
Delivery Rate. In connection with deliveries of Seller’s Gas hereunder, both parties shall be obligated to use reasonable efforts to avoid causing pipeline imbalances and to determine the cause of any pipeline imbalances for which a charge or penalty may be imposed. The party responsible for such imbalance charge or penalty shall be obligated to pay such imbalance charge or penalty regardless of whether it is the shipper on the subject pipeline.
Delivery Rate. The amount of Energy delivered in a Contract Year to the Delivery Point shall match the total expected volume of Green Attributes produced in that same Contract Year as generated by the Project. Seller shall deliver in each quarter the amount of Product in MWs (“A” or “Quarterly Quantity”) as set forth in the below chart (“Delivery Rate”) during each day of a Contract Year during the Delivery Term and shall ensure that the amount of Energy (as measured in MWh) delivered to the Delivery Point during a Contract Year matches the amount of Green Attributes generated by the Project during such Contract Year. Delivery Rate. The Contractor shall be able to deliver the Contracted Object in line with the provided forecast APPENDIX F. The Contractor shall be able to reach the maximum delivery rate 26 weeks after delivery of the first series production Contracted Object. Deliveries should approximately be able to follow a linear rate of increase up to the maximum delivery rate. Rolling non-binding forecast covering 18 month will be provided every six month. The rolling forecast includes a firm 6 month period, a semi flexible 7-12 month period and a flexible 13-18 month period. Any change in delivery rate in accordance with APPENDIX E shall be accepted by Contractor at no change in price, so long as the rate is between 48-432 units for the HRM and between 5 and 30 units for the HFU. The maximum delivery rate of the contractor is 432pcs/month for the HRM and 30 pcs/month for the HFU.

Buyer shall have no liability for, and Seller shall indemnify and hold Buyer harmless from, any and all costs, and/or penalties of any kind arising by reason of any imbalances occurring for Gas delivered pursuant to Seller's request.
Delivery Rate. Determine proper delivery rate of concrete and monitor batch times.
Delivery Rate. Gascor is not obliged to deliver Gas to the Buyers in any hour of a Day at a rate which is different to the rate at which the Sellers deliver Gas to Gascor under the Principal Contract. The Parties acknowledge that, under Clause 5.6(a) of the Principal Contract, a Seller is not obliged to deliver Gas in any hour of a Day at a rate greater than the rate which would deliver 1/24th of its Proportionate Share (as defined in the Principal Contract) of Gascor's applicable MDQ during that Day.
