DEPTH LIMITATION. The Seller Reserved Overriding Royalty Interest shall apply only to those depths from the surface down to the top of the Lodgepole formation, as seen at a measured depth of 6,316 feet on the Log for the Monsanto Company Xxxxx #1 Well, located in Xxxxxxx 0, Xxxxxxxx 000X, Xxxxx 00X0X, Xxxxx Xxxxxx, North Dakota. The Seller Reserved Overriding Royalty Interest shall not apply to any depths below the top of the Lodgepole formation. As provided in Section 3.27, Seller represents that, to the best of its knowledge and belief, such formation exists under all the Units, Xxxxx and Leases in which Seller shall except and reserve the Seller Reserved Overriding Royalty Interest, and notwithstanding the Seller Reserved ORRI Determination Criteria, the Parties hereto agree that should the Lodgepole formation not exist under any of the Units, Xxxxx or Leases, as applicable, the Seller Reserved Overriding Royalty Interest shall be limited from the surface down to the base of the Mission Canyon formation.
DEPTH LIMITATION. Notwithstanding anything to the contrary contained herein, unless the Initial Well is drilled to the Contract Depth, any assignment of Operating Rights made hereunder as a result of having drilled and completed the Initial Well, to include its substitute, as a producer of oil and/or gas in paying quantities, shall be limited to 50,000' below the surface of the earth.
DEPTH LIMITATION. Notwithstanding anything to the contrary herein, this Lease is limited to those depths lying below the top of the Queenston Formation, and Lessor expressly excepts from this Lease, reserves and retains all rights and depths from the surface of the earth to the top of the Queenston Formation, provided however, that Lessee shall have a subsurface easement to drill through those depths lying above the top of the Queenston Formation, if such subsurface easement is necessary for Lessee to access the depths lying below the top of the Queenston Formation. Specifically reserved by Lessor are all oil, gas and other mineral rights from the surface of the earth to the top of the Queenston Formation.
DEPTH LIMITATION. Divers’ time at all depths exceeding forty (40) feet shall be governed by the United States Navy Standard Decompression Table (using compressed air) using the optimum exposure time as found in Manual Navy ships No. 250-538. All safety precautions shall be observed in connection with this Manual.
