Common use of – Due Process Meeting Clause in Contracts

– Due Process Meeting. When the University determines that an employee has potentially violated rules, regulations or is guilty of other misconduct that may result in a suspension or termination of employment, a due process meeting shall be held by the Chief Human Resources Officer or designee to the extent required by law. The University will provide written notice to the employee and the Union representative of the time, date and place where the meeting shall occur, and of the nature and grounds for the proposed discipline. The University shall provide seven (7) calendar days’ notice of the time and date of the meeting. The employee shall waive the opportunity to make a statement about the proposed discipline should the employee fail to attend the meeting. If the employee chooses not to make a statement or fails to attend the due process meeting, the University will base its decision regarding discipline on the facts and the inferences drawn from the facts known at the time of the decision.
