Duty to Meet & Confer Sample Clauses

Duty to Meet & ConferExcept in cases of emergency requiring immediate action, in which case the Union will be informed as soon as possible, the City and the affected departments agree to furnish the Union with a written description of any proposed change in personnel practices or working conditions within the scope of representation affecting the employees covered by this CBA at least twenty (20) working days before the changes are scheduled to go into effect. Within ten (10) working days of receipt of written notice, the Union will inform the City of any objections or proposals it may have for alternative changes. If the Union does not respond within ten (10) working days from the date of the return receipt of such written information, the affected departments shall assume the Union does not wish to meet & confer on the proposed policy change. If either the City or the Union does not accept the other party's proposal, the parties shall meet & confer on the issue as required by law. The proposed changes will not go into effect until the completion of the meet & confer process provided that the impasse procedure in the Employee Relations Ordinance in the Administrative Code shall not apply to the application of this Article. This Article is intended to meet the requirements of the Xxxxxx-Xxxxxx-Xxxxx Act.
Duty to Meet & Confer. Pursuant to the provisions of the Xxxxxx-Xxxxxx-Xxxxx Act, as amended, the CITY agrees to meet & confer, as required by law with LOCAL 200 in advance regarding any proposed changes in working conditions within the scope of representation including but not limited to the bargainable impacts on EMPLOYEES of: changes in management structure, the process for the fair and equitable selection of training candidates, the scheduling of operations, reorganization plans, staffing, the prioritization of work assignments in the face of cutbacks in staffing, changes in overtime recording procedures. The CITY shall attempt to provide any proposed changes to LOCAL 200 in writing within fifteen (15) days before said changes are to go into effect (emergencies excepted). Within five (5) days of the receipt of the notice of proposed changes, LOCAL 200 may request, in writing, a meeting and/or present the Department with any comments and suggestions it may have in writing concerning the proposed changes. The Department shall reply, in writing, within ten (10) days by scheduling a meeting, if so requested by LOCAL 200, and by responding to LOCAL 200’s written comments.

Within five (5) days of the receipt of the notice of proposed changes, LOCAL 200 may request, in writing, a meeting and/or present the Department with any comments and suggestions it may have in writing concerning the proposed changes. The Department shall reply, in writing, within ten (10) days by scheduling a meeting, if so requested by LOCAL 200, and by responding to LOCAL 200’s written comments.

  • Duty to Perform and Duty to Mitigate 11.6.1 To the extent not prevented by a Force Majeure Event pursuant to Article 11.3, the Affected Party shall continue to perform its obligations pursuant to this Agreement. The Affected Party shall use its reasonable efforts to mitigate the effect of any Force Majeure Event as soon as practicable.

  • Duty to Mitigate Each Party agrees that it has a duty to mitigate damages and covenants that it will use commercially reasonable efforts to minimize any damages it may incur as a result of the other Party’s failure to perform pursuant to this Agreement.
