Easement Requirements. If, at any time during the Term, in Company’s sole discretion, a separate easement, right of way, license agreement or other similar agreement is required in order to grant Company sufficient rights to install and locate the Charging Equipment, Company will deliver such agreement to Customer and Customer shall execute and return the same within ten (10) days of such delivery. At Company’s sole discretion and cost, such agreement may be recorded in the Clerk’s Office of the Circuit Court of the county where the Site is located. If Customer fails to execute such agreement within the applicable timeframe, Company reserves the right to rescind Customer’s participation in the Residential Charging Program and immediately terminate this Agreement. Notwithstanding anything to the contrary contained in this Agreement, if any third-party consents are required for Company to access the Site or to install any of the Charging Equipment intended to serve Customer, Company may, at its option, delay installation of such Charging Equipment until appropriate rights of way, easements or other consents, satisfactory to Company, are obtained without cost to Company.
