Eligible Items for Deposit. You agree to scan and deposit only “checks” as that term is defined in Regulation CC and only those checks that are permissible under this Agreement or such other items as we, in our sole discretion, elect to include in Mobile Deposit Services. You agree that the image of the check transmitted to us shall be deemed an “item” within the meaning of Article 4 of the Uniform Commercial Code as adopted in New York, except to the extent that the application of this Agreement provides for separate treatment, subject to applicable law. For purposes of this Agreement, “check” (as defined in Regulation CC) means a negotiable demand draft that is drawn on: or payable through or at an office of a bank; a Federal Reserve Bank or a Federal Home Loan Bank; the Treasury of the United States; or a state or local government that is not payable through or at a bank. For purposes of the Agreement “item” means an instrument or a promise or order to pay money handled by a bank for collection or payment. The term does not include a payment for ACH or wire transfers.

These include: -Checks payable to any person or entity other than you even if endorsed over to you. -Checks endorsed by you and a non-joint account owner. -Checks payable to a business. -Checks stamped with a “non-negotiable” watermark. -Checks that are issued to multiple parties other than joint account holders. -Checks containing any alteration of which you know or suspect to be fraudulent or not authorized by the owner of the account on which the check is drawn. -Any Checks that are not in original form with a signature, such as substitute checks or remotely created checks. -Checks that are stale dated, dated more than six (6) months prior to the date of deposit. -Checks that are postdated (display a future date). -Checks written off an account at a financial institution located outside the United States. -Checks not payable in United States currency. -Checks that are otherwise not acceptable under the terms of your Bank account. -United States Savings Bonds.
