Common use of Emergency Transfer Clause in Contracts

Emergency Transfer. In the event the dwelling unit is damaged to the extent that conditions are created that are hazardous to the life, health, or safety of the occupants, CMHA shall be responsible for repair of the unit within a reasonable period of time after receiving notice from Tenant. If the damage was caused by Tenant, household members, guests, or any other person under Tenant’s control, the cost of the repairs shall be charged to Tenant. 1) CMHA shall offer to Tenant a replacement dwelling unit, if available, if necessary repairs cannot be made within a reasonable time. 2) Tenant shall accept any replacement unit offered by CMHA. 3) If CMHA determines that the dwelling unit is uninhabitable because of imminent danger to the life, health, and safety of Tenant, and Tenant refuses alternative accommodations, then the Lease shall be terminated, and any rent paid will be refunded to Tenant, on a prorated basis.
