EMPLOYEE AND ASSOCIATION RIGHTS. 4.1 Association business, discussions, and activities may be conducted by bargaining unit members or union officials on district property, whenever: 4.1.1 An authorized Association representative obtains advance permission from the Superintendent or designee regarding the specific time, place, and type of activity to be conducted. 4.1.2 The Superintendent or designee can verify that such requested activities and use of facilities will not interfere with the school programs and/or duties of bargaining unit members, and will not directly or indirectly interfere with the right of employees to refrain from listening or speaking with a union representative. 4.2 The Association may use the school mailboxes and staff workroom bulletin boards and other means of communication subject to the following conditions: (a) all postings for bulletin board or items for school mailboxes must contain the date of posting or distribution and the identification of the organization, together with a designated authorization by the Association president; (b) a copy of such postings or distributions must be delivered to the Superintendent or designee at the same time as posting or distribution; and, (c) if the Association continually posts or distributes information which is derogatory or defamatory of the District or its personnel, the District may remove the right to post or distribute for a period of one full semester. 4.3 Reasonable access will be provided the Association to duplicating equipment, as long as its use does not interfere with the production of materials for the educational program or administrative functions of the District. The Association will reimburse the District at the same rate as the public for the use of the equipment. 4.4 The Association may exclusively receive time off from duties for the processing of grievances past the Informal Level of the grievance procedure, Article 19 herein, for bargaining unit members who are designated as Association representatives, subject to the following conditions: 4.4.1 By no later than fifteen (15) days following the signing of this Agreement, the Association will designate in writing to the Assistant Superintendent for Human Resources, two bargaining unit members who are to receive the time off; 4.4.2 Within fifteen (15) days of the signing of this agreement and within two (2) days of any changes the Association will provide written notification to the Assistant Superintendent a list of all Association officers to include, but not be limited to president, vice-president, secretary, treasurer, directors, and grievance representatives. It is recognized that any MTA member, who for whatever reason becomes a non-MTA member, can no longer be an Association officer/representative or represent the Association in any way. 4.4.3 Twenty-four (24) hours prior to release from duties for grievance processing the designated representative informs his immediate supervisor in order that an adequate substitute may be obtained, if such is necessary; and, 4.4.4 That such time off shall be limited solely to representing a grievant in a conference with a management person, beyond the Informal Level, and in no way shall this limitation include use of such time for matters such as gathering information, interviewing witnesses, or preparing a presentation. 4.5 The District shall, at no charge, furnish the Association with one copy of any official budgetary documentation that is available in the district; however, the Association will reimburse the District for the cost of reproduction of subsequent copies. 4.6 The District shall furnish the Association with access to the placement of personnel on the respective salary schedules.

4.1.3. Right to use all existing payroll deductions.
4.1.4. Right to the following conditions: (a) all postings for bulletin board or items for school mailboxes use of a designated room of adequate size. Arrangements with Building Administrators must contain the date of posting or distribution and the identification be made in advance with no disruption of the organization, together with a designated authorization normal school day. Any extra-ordinary expense incurred by the Association president; (b) association through the use of school facilities will be its responsibility.
4.2. Authorized association representatives or delegates shall be granted leave to attend state or national association workshops, conferences, business meetings, or other sanctioned IEA/NEA activities:
4.2.1. The amount of leave taken shall not totally exceed five days per school year by all such authorized personnel. Also, no one individual may exceed three days of authorized leave per school year. The association’s president shall provide a copy of such postings or distributions must be delivered list to the Superintendent or designee of eligible association members who will attend these meetings.
4.2.2. A written request for leave is submitted to the Superintendent a minimum of five days in advance of the leave.
4.2.3. The association reimburses the District the cost of a substitute with no deduction from salaries.
4.3. The president of the association shall be given, at the same time as posting or distribution; andthe media is notified, (c) if the Association continually posts or distributes information which is derogatory or defamatory an electronic copy of all regular and special meetings of the District or its personnelBoard, together with a copy of the District may remove the right to post or distribute for a period of one full semesteragenda.
4.3 Reasonable access 4.4. One copy of all Open Session Board minutes shall be made available to the president of the association within seven days after the Board has approved the minutes of the previous meeting. An electronic copy of all media releases will be given to the president at the time of release.
4.5. Copies of the non-ratified contract will be provided to each member of the Board and teacher’s negotiating teams. The master copy of the ratified contract will be provided to the Board and association team members to have sufficient copies made for each group. All copies will be duplicated in the presence of a teacher and Board team member. A copy of the ratified agreement will be posted on the district’s website.
4.6. There will be no discrimination towards members of the association’s negotiating team, association members, or association officers.
4.7. The Board shall place the association on the agenda of any regular Board meeting under new business provided the association notifies the Board five working days in advance and state the purpose for addressing the Board. Also, one spokesperson is to be appointed by the association and the presentation is to be limited to a maximum of ten minutes.
4.8. By the opening of school, the Superintendent will supply a copy of the Board Policy Book to each building principal, one copy for the Association to duplicating equipment, as long as its use does not interfere with President and keep a copy available in the production of materials unit office for the educational program or administrative functions interested citizens. The copies will be updated for revisions by sending copies of the District. The Association will reimburse the District revisions to each policy holder at the same rate as time the public Board members receive their copies. The copies remain the property of the school district and are to be returned by employees at the end of the school year or at the termination of employment.
4.9. An employee shall be given written notice of any change in his/her assignment for the use of the equipment.

The Board agrees not to discriminate against any employee covered by this Agreement because of the employee’s participation in any lawful Association business, discussions, and activities may be conducted by bargaining unit members or union officials on district property, whenever:

4.3 Reasonable access Section 3.3. Upon request, the Board will provide the Association’s President with such available public information concerning the District as assists the Association in evaluating an item pending in negotiations or currently involves an item of negotiation, or is relevant to the processing of a grievance, as well as copies of the Board’s agenda and copies of its official minutes. Name, address, category and step placement of newly hired employees will be provided to the Association five (5) days after the Board takes official action in hiring any employee covered by the Agreement.
Section 3.4. Matters that the Association submits to duplicating equipmentthe Board in writing, as long as its use does not interfere with which are considered appropriate by the production of materials Superintendent for Board action, shall be considered by the educational program or administrative functions of the DistrictBoard.
Section 3.5. The Association will reimburse and the District Board recognize the importance of good communications in maintaining positive relationships, and their representatives therefore agree to meet from time-to-time to discuss problems of mutual concern relating to implementation of this Agreement and not the subject of a pending grievance or negotiation. Meetings shall be held at the same rate as the public for the use of the equipment.

Employees will receive a presentation.
4.5 The District shall, at no charge, furnish the Association with one copy of any official budgetary documentation evaluative materials placed in their personnel file within ten (10) calendar days of its placement. The parties recognize that an employee’s disciplinary record is available a relevant factor in determining the district; howeverappropriate level of discipline for misconduct and that passage of a significant period of time without discipline may diminish the weight given to prior discipline. Upon mutual agreement with the employee and the Superintendent, the Association will reimburse the District for the cost of reproduction of subsequent copiesa written reprimand can be expunged from an employee’s personnel file.
4.6 The District shall furnish the Association with access to the placement of personnel on the respective salary schedules.
