Common use of Employee Leaving During Notice Clause in Contracts

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause may terminate employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee remained with the employer until the expiry of such notice. An employee Employee whose employment is to be terminated for reasons set out in this clause 1.10.1 (a) may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the employee such Employee remained with the employer Employer until the expiry of such notice. This is with the provision : Provided that in such circumstances the employee Employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in paragraph 14.1 of this clause may terminate employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee remained with the employer Modern Industries (WA) Pty Ltd until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 5.7.1(a), may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the such employee remained with the employer Western Downs Regional Council until the expiry of such notice. This is with the provision : Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee Employee whose employment is to be terminated for reasons set out in this clause 14.1 above may terminate their employment during the period of notice andin order to commence employment with another employer, if so, shall provided that the Employee provides proof of the alternative employment to Kmart which may include a statutory declaration. The Employee will be entitled to the same benefits and payments under this clause had the employee they remained with the employer Kmart until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall Employee will not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 3.6.1. (a) may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer Employer until the expiry of such notice. This is with the provision that in In such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee Employee whose employment is to be terminated for reasons set out in accordance with this clause may terminate their employment during the period of notice andand if this occurs, if so, shall will be entitled to the same benefits and payments under provisions of this clause had as if the employee remained Employee remains with the employer Employer until the expiry of such notice. This is with the provision Provided that in such circumstances circumstances, the employee shall Employee will not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 2.3.1 may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause 2.3.5 had the such employee remained with the employer Employer until the expiry of such notice. This is with the provision : Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 5.3(a)(i), may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the such employee remained with the employer until the expiry of such notice. This is with the provision : Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 37.1 hereof may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer Employer until the expiry of such notice. This is with the provision Provided that in such circumstances circumstances, the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. a An employee employee, whose employment is to be terminated for reasons set out in this clause in 2.13.1 above may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer Company until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause paragraph 12.1.i may terminate their employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee remained with the employer Employer until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause paragraph 2.6. 1.1 may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee employee, whose employment is to be terminated for reasons set out in this clause 4.9.1 may terminate such employment during the period of notice specified in clause 4.7.2, and, if so, shall be entitled to the same benefits and payments under this clause 4.9 had the such employee remained with the employer until the expiry of such notice. This is with the provision notice provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause paragraph B (a)(i) hereof may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer company until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in clause 1.1 of this clause schedule, may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the such employee remained with the employer until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause paragraph 13.1.1 may terminate their employment during the period of notice and, if so, shall be entitled to the same benefits benefit as and payments under this clause had the employee remained with the employer Employer until the expiry of such notice. This is with the provision , provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this sub-clause 39. 3.1 hereof may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 4.7.1(a), may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the such employee remained with the employer Employer until the expiry of such notice. This is with the provision : Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. 12.3.1 An employee whose employment is to be terminated for reasons set out in this clause at Clause 12.1 may terminate his or her employment during the period of notice and, if so, and shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee Employee whose employment is to be terminated for reasons set out in this clause 31.1 may terminate his/her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he/she remained with the employer RFDS until the expiry of such notice. This is with the provision that However, in such circumstances the employee Employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. 33.3.1 An employee whose employment is to be terminated for reasons set out in this sub- clause (a) hereof may terminate their employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee they remained with the employer until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of the remainder of the period of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause subclause 2.3(a) of the "Consultation Before Terminations" clause, may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the such employee remained with the employer until the expiry of such notice. This is with the provision : Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in 1.3 of this clause Appendix may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer Myer until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 35, Redundancy, may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the such employee remained with the employer until the expiry of such notice. This is with the provision : Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause Part F, 7.3.1 hereof may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee Employee whose employment is to be terminated for reasons set out in this clause Clause 52.1 hereof may terminate their employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee they remained with the employer Company until the expiry of such notice. This is with the provision Provided that in such circumstances the employee Employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 2.7.1 may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he/she remained with the employer until the expiry of such notice. This is with the provision that in In such circumstances the employee shall not be entitled to payment instead in lieu of notice. Similarly, the employer retains the prerogative to pay the notice period and elect not to require the notice period to be worked by the employee at the employer's discretion.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in 1.3 of this clause appendix may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer Myer until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 4.5.1 may terminate his or her employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer Company until the expiry of such notice. This is with the provision Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause 25.1(a) may terminate his or her employment during the period of notice and, if so, shall be entitled to the same benefits and payments under this clause had the employee he or she remained with the employer Employer until the expiry of such notice. This is with the provision that in In such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. This is with the provision : provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this (a) of clause 2.7.1, may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the such employee remained with the employer until the expiry of such notice. This is with the provision : Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee employee, whose employment is to be terminated for reasons set out in this clause 3.5.1 may terminate such employment during the period of notice specified in clause 3.4.2, and, if so, shall be entitled to the same benefits and payments under this clause 3.5 had the such employee remained with the employer until the expiry of such notice. This is with the provision : Provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.

Employee Leaving During Notice. An employee whose employment is to be terminated for reasons set out in this clause Clause 2.3.1 , may terminate such employment during the period of notice notice, and, if so, shall be entitled to the same benefits and payments under this clause had the such employee remained with the employer until the expiry of such notice. This is with the provision , provided that in such circumstances the employee shall not be entitled to payment instead in lieu of notice.
