EMPLOYER AUTHORITY - EMPLOYEE RIGHTS. 5.1 It is recognized by both parties that, except as expressly stated herein, the Chief Executive Officer shall retain rights and authority necessary to operate and direct all the affairs of the department including, but not limited to, directing the working force; controlling all operations and services; determining the methods, means, organization and number of personnel by which operations and services are to be conducted; changing or eliminating equipment or facilities; and taking whatever actions may be necessary to carry out the missions of the Employer in emergencies. (a) Employees shall have the right, freely and without fear of penalty or reprisal by the Employer, to join and participate in the Union. (b) Employees choosing to participate in the internal affairs of the Union as an officer, xxxxxxx or other capacity, may do so without fear of reprisal by the Employer for such participation consistent with the employee's job duties and responsibilities and the provisions of this contract.
