Ethics and Confidentiality. 10.1 Each of the parties agrees that all information obtained as a result of this Agreement relating to the business or affairs of the other party hereto, which at the time is of a confidential nature, whether or not specifically identified as confidential, other than information generally available to the public is strictly confidential and is to be held in strictest confidence, and shall cause its Representatives (as defined below), to hold all confidential information in strictest confidence. "Representatives" with respect to any party means its affiliates and their respective directors, officers, employees, agents and other representatives and advisors.

Ethics and Confidentiality. 4.2.1 All medical research using identifiable personal information, or using anonymised data from the NHS which is not in the public domain, must be approved by a Research Ethics Committee (REC). The TAVI Steering Group will expect to see a copy of the REC approval (or an equivalent university or industry specific document) before the data are released.
4.2.2 Ethical approval from the data user’s local ethical committee is the responsibility of the data user.
4.2.3 Once the project has been approved, datasets will be provided without restrictions within the European Economic Area (EEA, which consists of the twenty seven member states of the European Union together with Iceland, Liechtenstein, Norway and the States of Guernsey) and internationally recognised schemes as the US Safe Harbour Agreement.
4.2.4 TAVI data must not be transferred to a country or territory outside the European Economic Area and internationally recognised schemes such as the US Safe Harbour Agreement.
4.2.5 Researchers must ensure that personal information is handled by healthcare professionals or staff with an equivalent duty of confidentiality to that in a National Health Service (NHS) contract (eg an honorary NHS contract or university contract of employment).
4.2.6 It is virtually impossible to guarantee that an individual will never be identified, given the nature of the data. It is therefore the responsibility of data users to ensure that the participants’ identity is not disclosed under any circumstances.
4.2.7 Data users must consider the risk of identifying individuals in their analyses prior to publication. ‘Small numbers' are considered from 1 to 5. Low-level analyses are more likely to contain small numbers which might facilitate identification of individual patients. A higher level of aggregation should be considered when analyses produce less than 5 cases.

Individuals as set forth above shall conform to the Executive Branch Code of Ethics with regard to conflicts of interests as set forth in KRS Chapter 11A; applicable provisions of KRS 161.430 and KRS 161.460; and this policy. Ethics and Confidentiality. The evaluation has a high standard of confidentiality. All data collected from individuals is handled with absolute confidentiality and no track of identity can be made in documents, etc. shared by the evaluation team. Track of identity can only occur with the explicit consent of the individual in question. The data collection methods are free from any bias. Personal data, for example race, ethnicity, gender, sexuality, age, religion or disabilities will not be collected. Quotations will be anonymous and indirect. Direct quotations will only occur with the consent of the individual. Records are kept for five years after the end of the project. The evaluation is in line with the International Standards for Evaluation4 and is committed to the CERN statement of ethics (Xxxxxx and Niewenhuis, 2005, 73).
