Events outside of Our control a) We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this Agreement that is caused by an Event Outside Our Control.
Events outside of Our control. 10.5.1 By submitting Your Application Form, Mobile Device Order Form or Mobile Device Subscription Order Form, You acknowledge that certain events may not be within Our control, and may affect Our ability to perform Our obligations under this Agreement (such obligations being Affected Obligations).
10.5.2 To the extent permitted under the Australian Consumer Law, We will not be liable for Affected Obligations,however We will use reasonable endeavours to notify You of such event (and We will endeavour to provideYou with prior notice, if reasonably practicable to do so).
Events outside of Our control. We shall not be liable in any way to you for any failure or delay in performance of any of our obligations to you, arising from any event or circumstance beyond our reasonable control.
Events outside of Our control. ▪ If we are unable to perform our obligations under this Agreement because of factors beyond our control, including a change of law, an event of Force Majeure, we will notify you as soon as is reasonably practicable and will use reasonable endeavors to secure the return of any money paid by you in respect of which we have been unable to discharge our obligations under this Agreement. We will not have any liability to you where we are unable to perform our obligations.
Events outside of Our control. 9.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this XXXX that is caused by any act or event beyond our reasonable control, including failure of public or private telecommunications networks (Event Outside Our Control).
9.2 If an Event Outside Our Control takes place that affects the performance of our obligations under this XXXX:
(a) our obligations under this XXXX will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control; and
(b) we will use our reasonable endeavours to find a solution by which our obligations under this XXXX may be performed despite the Event Outside Our Control.
Events outside of Our control. 8.1 We will not be liable or responsible for any failure to perform or delay in performance in relation to the provision of the Services or Our obligations under this Contract if the delay or failure results from events or circumstances outside of Our reasonable control, including without limitation, acts of God, strikes, lock outs or other industrial action by third parties, accidents, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not), fire, explosion, failure of public or private telecommunications network or on-site electricity supply.
Events outside of Our control. The School shall not be liable to you for events outside its control which it could not have foreseen or prevented, even if it had taken reasonable care, including but not limited to health and safety concerns. Should any such circumstances arise, the School reserves the right to change or cancel parts, or all, of the Program. The School will take reasonable and proportionate steps to mitigate any adverse impact on you.
Events outside of Our control. If the supply of the Software to you is temporarily suspended by, or subject to an outage due to, an event outside of the Licensor’s control, the Licensor will contact you as soon as possible to let you know and do what it can to reduce the suspension or outage. As long as the Licensor does this, Licensor will not be liable to compensate you for the suspension or outage.
Events outside of Our control. We shall not be liable to you for events outside our control which we could not have foreseen or prevented, even if we had taken reasonable care. Such events include, but are not limited to: strikes; other industrial action; staff illness; severe weather; fire; civil commotion; riot; invasion; terrorist attack or threat of a terrorist attack; cyber attack; war (whether declared or not); natural disaster; restrictions imposed by government or public authorities; significant changes to our funding or government higher education policy; epidemic or pandemic disease; or failure of public utilities or transport systems. Should any such circumstances arise, we reserve the right to make changes to the Course and University services and facilities in line with section 5 above. We will take reasonable and proportionate steps to mitigate any adverse impact on you.
Events outside of Our control. 12.1. We and you will not be liable for events outside of our control. Neither we nor you will be in breach of this Agreement or liable for delay in performing, or failure to perform, any obligations under this Agreement if such delay or failure results from events, circumstances or causes beyond your or our reasonable control, including strikes; lock-outs or other industrial disputes (except with respect to that party's own employees); acts of God; war; riot; civil commotion; compliance with any law or governmental order, rule, regulation or direction; accident; fire; flood; epidemic or pandemic; or storm. In such circumstances the affected party shall be entitled to a reasonable extension of the time for performing such obligations, provided that if the period of delay or non- performance continues for 2 months, the party not affected may terminate this Agreement (together with any other arrangement between the parties) by sending written confirmation by following the process outlined in clause 9.
