Common use of Extension of Leave of Absence Clause in Contracts

Extension of Leave of Absence. An extended leave of absence beyond the period of actual physical disability may be allowed at the discretion of the Employer. Employees who request and receive from the Employer an extension of a leave of absence shall upon return to work be reinstated to the employee’s former position, if vacant, or to the first available opening for which the employee is qualified. The employee’s right to reinstatement to the first available opening shall be limited to ninety (90) days following the employee’s notification to the Employer of the employee’s availability for work, providing the employee’s notification to the Employer occurs on or before the return date agreed upon by the employee and the Employer.
