Extreme Hardship. Reasons beyond the control of the Licensee as determined by the Director of Housing and Residential Life as outlined in the Housing Policies and Guidelines. Hardship that the Licensee was aware of prior to the license agreement will not be considered.
Extreme Hardship. The Responsible Party may submit a written request to the City Engineer requesting an exception to the installation of the required Public Improvements within the specified time frame if installation of said improvements will create an extreme hardship for the Responsible Party. The City Engineer will have sole discretion in determining if an extreme hardship exists. If the City Engineer determines an extreme hardship exists, the City Engineer will determine the length of time the installation of the improvements will be allowed to be delayed up to a maximum of Five (5) years from the date of such determination. The City Engineer may require a Performance Security be provided for an amount of up to One Hundred percent (100%) of the cost of the improvements not completed plus projected inflationary costs for said Public Improvements.
Extreme Hardship. If the University approves the request then the Licensee is responsible for the Housing per day charge and the Dining Plan per day charge including flex dollars through the last day of occupancy, the last day of Dining Plan usage, the official withdrawal rate or termination effective date, whichever is later, and University may charge for the number of days the notice period is less than 14 days. For Licensees who remain enrolled at the University the Licensee may be charged for the full semester’s Housing and Dining Plan fees for that semester.
Extreme Hardship. The Subdivider may submit a written request to the Authorized Official requesting an exception to the installation of the required Public Improvements within the specified timeframe when installation of said improvements will create an extreme hardship for the Subdivider. The Authorized Official will have sole discretion in determining if an extreme hardship exists. If the Authorized Official determines an extreme hardship exists, the Authorized Official will determine the length of time the installation of the improvements will be allowed to be delayed up to a maximum of two years from the date of such determination. The Authorized Official may require a Performance Security be provided for an amount of up to one hundred percent of the cost of the improvements not completed plus projected inflationary costs for said Public Improvements.
Extreme Hardship. Accrued PTO may be paid out in the limited case of an extreme hardship. An extreme hardship is a financial hardship due to a serious, isolated and unexpected event that will have severe financial impact on the employee and cannot be met by any other source of income or savings (e.g., house fire, catastrophic illness, natural disaster), and does not include circumstances resulting from poor planning or foreseeable consequences of personal actions. Request for extreme hardship PTO payouts are subject to approval by the Director/Vice-President of Allina Labor Relations, or his/her designee.
Extreme Hardship. 23.1 The University must allow for individual exceptional circumstances of extreme hardship.
Extreme Hardship. On a case-by-case basis, the Director may discharge all or a portion of your CyberCorps® SFS scholarship service or repayment obligation whenever compliance with the obligation is impossible or would involve extreme hardship, or if enforcement of such obligation would be unconscionable. If your request for discharge is denied, you may seek reconsideration if there are new facts or law that you believe should be considered. Your reconsideration request must be in writing and received within thirty calendar days after the date on which you were notified that your discharge request was denied. The decision on your request for reconsideration is final, with no further right of reconsideration. (Requests to discharge or refund Scholarship amounts already repaid or already referred to the United States Department of the Treasury for collection will not be considered or granted.) SECTION B: IMPORTANT NOTICES PRIVACY ACT STATEMENT Authority: 15 U.S.C. 7442 (§ 302 of the Cybersecurity Enhancement Act, as amended); 42 U.S.C. 1870 (NSF Act, as amended). Purpose: As part of administering your CyberCorps® SFS Scholarship award, to ensure that you understand and agree to the terms and conditions of your Scholarship, including (1) the nature and scope your service obligation, (2) that if you fail to fulfill that obligation or other Scholarship terms and conditions, your scholarship will be subject to Scholarship Repayment.
Extreme Hardship. C. As to these conditions, University may require the following cancellation terms:
Extreme Hardship. A $50 cancellation fee shall be collected from the Licensee. The Licensee shall be charged a prorated daily rate from the date the Licensee requests the cancellation through the end of the required 30-day notice period. All other reasons to cancel this Agreement under this subsection shall be granted or denied at the sole discretion of the University.
Extreme Hardship. 6.2 For Licensees who withdraw from the University, the University's grant of the request to cancel this License Agreement will result in an assessment of a thirty (30) day charge starting from the date Licensee vacates the facility.
