Federal Drug and Alcohol Confidentiality Laws. 6 Provider shall comply with 42 CFR Part 2, as applicable. If Provider is a “Part 2 7 program” as defined under 42 CFR §2.11, Provider shall obtain a signed written 8 consent that complies with the requirements of 42 CFR Part 2 from each individual, 9 prior to disclosing the individual’s Patient Identifying Information to MCO or HCA. 10 For the purposes of this section, Patient Identifying Information shall have the same 11 meaning as under 42 CFR §2.11. Such consent shall explicitly name MCO and/or HCA 12 as an authorized recipient of the individual’s Patient Identifying Information. 13 Provider shall maintain copies of each individual’s consent form in accordance with 14 federal law.
