Fleet Size. Operator’s measured fleet size exceeds its permitted fleet size on more than five (5) days of the month or Operator’s measured fleet size is below its minimum fleet size on more than five (5) days of the month.
Fleet Size. The Operator must consult with the Councils prior to expansions of the fleet which are in line with the deployment plan. The Operator must seek written approval from the Councils for expansion of the fleet size beyond the deployment plan.
Fleet Size. The Contractor shall have the absolute discretion to vary its fleet size in any manner and for any reason subject to the terms of this agreement.
Fleet Size a) Participating Company shall provide a minimum of 200 Dockless Vehicles at all times, with a distribution of vehicles across both East and West County Service Areas in response to market demand. Participating Company may provide up to a maximum of 500 Dockless Vehicles initially. The number of e-bikes will not count against the maximum number of permitted vehicles. A minimum of 50 e-bikes must be provided within the Demonstration Project area by Participating Company. Fleet size is calculated for daylight hours and weather permitting.
b) Participating Company may be authorized to increase the number of Dockless Vehicles when they are determined by the County to be in compliance with all provisions of this MOU and certain usage criteria are met. County has flexibility to base fleet size adjustments on additional factors. Participating Company may request permission to increase the number of Dockless Vehicles when:
i) Dockless e-bikes – usage is greater than 1 trip per day per vehicle as reported weekly
ii) Dockless e-scooters – usage is greater than 3 trips per day per vehicle as reported weekly
c) Xxxxxxxxxx County may, in its sole discretion, request or approve changes to the minimum and maximum fleet sizes within defined subareas of the County upon notification to Participating Company.
Fleet Size. Company shall begin operations in Columbia, Missouri corporate limits with a Fleet of five hundred (500) Small Vehicles. During the term of this Agreement, Company may not reduce the size of its Fleet below three hundred (300) Small Vehicles without written notification to City, provided at least seven (7) days before the reduction is to occur. Company shall not increase the size of its Fleet beyond five hundred (500) Small Vehicles without City’s approval pursuant to Section 5 of this Agreement. However, City may deny a request to increase the Fleet size as described herein if in its sole discretion it determines that an increase would not be in the best interest of the public health, safety, or welfare.
Fleet Size. Company shall begin operations in Joplin, Missouri corporate limits with a Fleet of ten (125) Small Vehicles. During the term of this Agreement, Company may not reduce the size of its Fleet below ten (10) Small Vehicles without written notification to City, provided at least seven (7) days before the reduction is to occur. Company shall not increase the size of its Fleet beyond fifty (125) Small Vehicles without City’s approval pursuant to Section 5 of this Agreement. However, City may deny a request to increase the Fleet size as described herein if in its sole discretion it determines that an increase would not be in the best interest of the public health, safety, or welfare.
Fleet Size. Franchisee shall maintain a minimum number of operable Ambulances that equals or exceeds one hundred twenty-five percent (125%) of the proposed peak deployment of Ambulances provided in the Deployment Plan.
Fleet Size. 8.1 The prevailing Fleet Size shall be recalculated by SEV and agreed by DCL on the last day of each calendar month for the purpose of calculating Maintenance Charges.
8.2 Spare Vehicles in the ratio of one Spare Vehicle to every ten Operational Vehicles (calculated by Vehicle category, and allowing for reasonable substitutes, across the whole fleet) shall be held at each Site and are included in this Agreement in respect of Fleet Size calculations.
8.3 The Fleet Size shall be allowed to fluctuate within a range defined as the Opening Fleet Size less ten percent to the Opening Fleet Size plus ten percent without penalty or notice. The Fleet Size, in respect of Maintenance Charges calculations shall only be allowed to exceed this range following either a revision of Schedule One agreed by SEV and DCL or on the first day of a DCL Financial Year.
8.4 DCL shall first offer all Surplus Vehicles that DCL wishes to sell for sale to SEV. Any Surplus Vehicle purchased by SEV shall be removed from DCL site within ten working days. Unless purchased by SEV, disposal of Surplus Vehicles shall be the responsibility of DCL.
8.5 Notwithstanding any other term of this Agreement, DCL shall within a period of five months of the Commencement Date reduce the number of MGV and LGV Vehicles in respect of which SEV is to provide Maintenance Services to a maximum of 52 Vehicles; ***Confidential treatment requested pursuant to a request for confidential treatment filed with the Securities and Exchange Commission. Omitted portions have been filed separately with the Commission. so as to enable SEV to undertake appropriate redundancy consultation and selection processes with those Transferring Employees involved in the maintenance of such MGV and LGV Vehicles and where appropriate to effect the dismissal of those Transferring Employees on the ground of redundancy.
Fleet Size. Company shall begin operations within MU’s jurisdictional boundaries with a Fleet of three hundred (300) Small Vehicles. During the term of this Agreement, Company may not reduce the size of its Fleet below one hundred fifty (150) Small Vehicles without written notification to MU, provided at least seven (7) days before the reduction is to occur. Company shall not increase the size of its Fleet beyond five hundred (500) Small Vehicles without MU’s approval pursuant to Section 5 of this Agreement. However, MU may deny a request to increase the Fleet size as described herein if in its sole discretion it determines that an increase would not be in the best interest of the public health, safety, or welfare of MU’s students, faculty, staff or visitors.
Fleet Size. Company shall be allowed to operate within the Overland Park, Kansas corporate limits with a Fleet of no more than four hundred (400) Shared Small Vehicles. Any increase in Company’s Fleet size beyond four hundred (400) Shared Small Vehicles must be approved in writing by the City. Company shall provide a minimum of 75 Shared Electric-assisted Scooters on or before April 15, 2022 and a minimum of 25 Shared Electric-assisted Bicycles on or before July 1, 2022.
