Food Service Provider. It is acknowledged that Kodak has an exclusive agreement with a specific food service provider at each Kodak Rochester Site. Each Tenant shall have the right to use the food service provider selected by Kodak to provide such food services to the Tenant and its respective employees and invitees at each Kodak Rochester Site. Except for the permitted food service provided, tenants shall not have the right to allow other food service provider’s access to any Kodak Rochester Site, with these exceptions: • If the tenant offers Kodak’s Supplier the opportunity to provide food service for a specific event, and the Supplier declines the opportunity, the tenant shall not be restricted from arranging for food service to be provided by any other Supplier. • If the Kodak Supplier does not provide food service or vending service to any building located at Xxxxxxx Business Park, the tenant shall not be subject to any exclusivity obligations.
Food Service Provider. Involvement in the sessions of Consumer Engagement Labs in October-November 2021, including observation and identification of commercially feasible ideas for new food packaging; Delivering sample takeaway meal(s) to about 15 consumers participating in the Labs session, enabling them to better understand specific design challenges related to meal packaging and consequences of specific packaging options for the properties of the delivered dishes; Planning for commercial exploitation of results of the Labs session by screening for commercially feasible product concepts, with the support of project partners; Selection of at least one new product co-created by consumers participating in the Labs session (innovative packaging design) that will be commercialised jointly by food service provider/packaging company, with commitment to introduce the product to the market in the first half of 2022, following the branding/visual identity guidelines defined by EIT/EIT Food (confirmed by written description of the planned product and plans for commercialisation, delivered by 15 December 2021, and obligation to introduce the product in the first half of 2022); the development and marketing of the product (innovative packaging design) will not be funded by this project and is the responsibility of the consortium member; Communicating with local media to ensure at least 1 publication in the local language (press or thematic magazines) describing the project, complying with visual identity guidelines; Participation in the final debriefing session (online) with University of Warsaw to discuss the project experiences and lessons learned.
Food Service Provider. Contractor acknowledges that the University is under contract with the Food Service Provider, which acts as the University's exclusive agent for the operation of food and beverage concessions and a catering business at the Facilities and that pursuant to such agreement the Food Service Provider subcontracts with branded coffee and tea companies, currently Starbuck's Coffee and First Colony Coffee & Tea Company which sell their Competitive Beverages in leased spaces within the Xxxx University Center, Xxxxxx Arts and Letters and the Constant Convocation Center. Contractor acknowledges and agrees that the sale of such Competitive Beverages at the above locations are an exception to exclusivity and the sale of such Competitive Beverages at those locations will not be considered a breach of this Contract, provided that all such sales are limited to those vendors listed above. If, however, the vendors listed above cease to operate at Facilities for any reason, and at that time Contractor is able to provide such beverages then the University will give Contractor first right to enter into a contract for the exclusive sale of such beverages with the vendors at the locations listed above, however, if Contractor is unable to provide such beverages then the University have the right to work with similar vendors after obtaining Contractor’s approval, which approval will not be unreasonably withheld if the vendors do not compete with Sponsor. The merchandising for such Competitive Beverages, however, will only be permitted in the retail space within the Xxxx University Center, Xxxxxx Arts and Letters and the Constant Convocation Center. In addition, University agrees that if it operates or becomes a subtenant of any such retail space where Beverages are sold, University will sell only the Products in the retail space.
