Common use of Functions of the Committee Clause in Contracts

Functions of the Committee. 6.4.1 Subject to Clause 6.4.2, the functions of the Committee shall include: (a) the supervision and monitoring of the Joint Governance Arrangements; (b) the supervision of the Joint Office and the Chief Executive; (c) the preparation and development of the Resource Plan in accordance with Clause 8.1; (d) the preparation, revision and development of the Budget in accordance with Clause 8.2; (e) the review and approval of Expenditure; (f) where required under the AS Agreement, the appointment of and provision of authority and/or instructions to, a Network Operator's Representative under the AS Agreement; and (g) any other functions that the Parties agree from time to time. 6.4.2 Except as otherwise provided in this Agreement: (a) the Committee; and (b) any Representative (by virtue only of being a Representative), shall have no ability to determine any matter, no competence to discharge any function or to exercise any power, and no power or authority to bind any Party, other than by virtue of the effect of any decisions of the Committee in relation to matters within the scope of its functions.
