General Allocation of Grant in Budget Categories. As more fully shown in the Budget/Timeline attached hereto as Exhibit “A” and incorporated herein (the “Budget”), the Grant shall be allocated as follows: (a) $800,000.00 of the Grant funds shall be allocated for Equipment, to be funded in the amounts and at the times as set forth below and in the Budget; and (b) $1,459,063.00 of the Grant funds shall be allocated for Prep/Fees, to be funded in the amounts and at the times as set forth below and in the Budget.
General Allocation of Grant in Budget Categories. (a) $35,000 of the Grant shall be allocated for the Salaries and shall be disbursed upon WCSO furnishing to Triumph satisfactory evidence that it has committed or otherwise allocated $110,000 of its own Matching Funds (as described below) for the Salaries. WCSO shall submit to Triumph Request for Funding on the form attached hereto as Exhibit “A” and incorporated herein (a “Request for Funding”). (b) $1,043,465 of the Grant shall be allocated for the Construction of the WCSO Facility, and shall be disbursed from time to time as contractor invoices for completed work are submitted to Triumph. WCSO shall submit to Triumph one or more Requests for Funding, each for an amount not to exceed 60% of the amount of the invoice(s) owing by WCSO to the contractors, materialmen, or vendors under the Contracts (such 60% being determined as shown on the Budget). (c) $1,000,000 of the Grant shall be allocated for the Construction of the ECTC Facility, and shall be disbursed from time to time as contractor invoices for completed work are submitted to Triumph. WCSO shall submit to Triumph one or more Requests for Funding, each for an amount not to exceed 50.0% of the amount of the invoice(s) owing by WCSO to the contractors, materialmen, or vendors under the Contracts (such 50.0% being determined as shown on the Budget). (d) $109,500 of the Grant shall be allocated for the purchase of the Equipment. Such $109,500 portion of the Grant shall be disbursed from time to time as copies of contracts, purchase orders, invoices, or other documentation are submitted to Triumph. WCSO shall submit to Triumph one or more Requests for Funding, each for an amount not to exceed 47% of the amount of the invoice, contract, or purchase order from a vendor (such 47% being determined as shown on the Budget). Notwithstanding the foregoing, the final $30,000.00 of the Grant Funds for the Equipment shall not be funded unless and until Grantee provides evidence to Triumph that all Matching Funds have been paid as and when provided in the Budget. (e) $30,000 of the Grant shall be allocated for the purchase of the Computers, and shall be disbursed from time to time as copies of contracts, purchase orders, invoices, or other documentation are submitted to Triumph. General Allocation of Grant in Budget Categories. The Grant shall be allocated as more fully shown in the Budget/Timeline attached hereto as Exhibit “A” and incorporated herein (the “Budget”). It is expressly understood and agreed that, with respect to the Budget category of Personnel paid for with Triumph funding and/or Matching Funds (as defined in Section 5.2 below), all of Grantee’s individual employees and other staff members working on the Project shall reside in one of the eight disproportionately affected counties under Section 288.8012(3), Florida Statutes (Bay, Escambia, Franklin, Gulf, Okaloosa, Santa Rosa, Walton, and Wakulla) (the “Affected Counties”); provided, however, that Triumph shall have the right, upon request from Grantee, to grant exceptions to the residency requirements in individual cases in Triumph’s sole and absolute discretion. The parties further agree that it is the intent of Grantee to hire personnel to support this Project as well as maximize external funding into the region and that personnel FTE percentages and costs may be split between Triumph, Grantee, and externally funded grants and research awards to maximize Project success.

  • Termination for Changes in Budget or Law The JBE’s payment obligations under this Agreement are subject to annual appropriation and the availability of funds. Expected or actual funding may be withdrawn, reduced, or limited prior to the expiration or other termination of this Agreement. Funding beyond the current appropriation year is conditioned upon appropriation of sufficient funds to support the activities described in this Agreement. The JBE may terminate this Agreement or limit Contractor’s Services (and reduce proportionately Contractor’s fees) upon Notice to Contractor without prejudice to any right or remedy of the JBE if: (i) expected or actual funding to compensate Contractor is withdrawn, reduced or limited; or (ii) the JBE determines that Contractor’s performance under this Agreement has become infeasible due to changes in applicable laws.
