General Disputes Resolution Procedure. A major objective of this agreement is to eliminate lost time and/or production arising out of disputes or grievances. Disputes over any work related or industrial matter should be dealt with as close to the source possible. Disputes over matters arising from this agreement shall be dealt with accordingly to the following procedure. An apprentice should submit the work related grievance and or industrial matter to their case manager for resolution within 48 hours. If the matter remains unresolved, then the matter is referred to an appropriate official of the ETU, who shall discuss the issue with the Manager Group Employer. If still not resolved discussions will be held between the ETU State Secretary and the CEO of the company to attempt to resolve the issue. Whilst the above procedures are being followed work should continue as normal. This procedure is to be followed in good faith and without unreasonable delay by either party. Should the matter remain unresolved it shall be dealt with in one of the following ways agreed between the parties: ❖ Disputes Board ❖ Referred to the Australian Industrial Relations Commission for conciliation and if required arbitration. The Commission’s decision will be accepted by all parties subject to legal rights of appeal.

General Disputes Resolution Procedure. The parties will aim to reduce the incidence of lost time through the elimination of restrictive practices, close consultation and co-operation with those directly affected and through the effective operation of dispute prevention and settlement procedures. The parties to this Agreement will observe the procedure under clause 10 Settlement of Disputes or Claims of the National Electrical, Electronic and Communications Contracting Industry Award 1998.

  • Governing Law and Dispute Resolution Procedure 34.1 This Agreement and any dispute or claim (including any non-contractual dispute or claim) arising out of or in connection with it or its subject matter, shall be governed by, and construed in accordance with, the laws of England and Wales.

  • Formal Dispute Resolution 10.6.1 If the Parties are unable to resolve the dispute through the informal procedure described in Section 10.5, then either Party may invoke the formal Dispute Resolution procedures described in this Section 10.6.   • Informal Dispute Resolution Process 1. In the event there is a dispute under this Centralized Contract, the Contractor, OGS and Authorized User agree to exercise their best efforts to resolve the dispute as soon as possible. The Contractor, OGS and Authorized User shall, without delay, continue to perform their respective obligations under this Centralized Contract which are not affected by the dispute. Primary responsibility for resolving any dispute arising under this Centralized Contract shall rest with the Authorized User’s Contractor Coordinators and the Contractor’s Account Executive and the State & Local Government Regional General Manager.

  • Governing Law; Dispute Resolution This Agreement shall be subject to the provisions of Sections 9(a), 9(c), and 9(h) of the Employment Agreement.
