Grievance Procedure Step 1. A. A member having an individual grievance will first attempt to resolve it informally with the member's immediate supervisor. This first attempt shall be made by the member-grievant within ten (10) calendar days following the events or circumstances giving rise to the grievance having occurred or is first known by the member-grievant. Grievances brought to the attention of the supervisor (except for automatic time extensions as hereinafter described in Section 8.7) beyond the ten (10) calendar day time limit shall not be considered. At this Step, there is no requirement that the grievance be submitted, or responded to, in writing. However, a Grievance Representative may accompany the grievant should the latter request such attendance. If a supervisor grants a grievance at verbal levels, written acknowledgement of granting such grievance shall be furnished. If the member is not satisfied with the oral response from the immediate supervisor, which shall be given within ten (10) days of the informal request at this Step, the member may pursue the formal steps which follow. Before a grievance and proposed solution is placed in writing by a member pursuant to Step 1, the Grievance Chairman or designee shall be advised of the grievance. A. Should the member-grievant not be satisfied with the answer in Step 1, within ten (10) calendar days thereafter the member may appeal the grievance to Step 2 by delivering a copy of the Grievance Form, and any other pertinent documents, to the office of the Chief of Police or the Chief's designee if the Chief is absent from duty. The Chief or designee shall date the Form, accurately showing the date the office received the Form. B. Within ten (10) calendar days of receipt of the Grievance Form, the Chief or designee shall investigate the grievance, and shall schedule and conduct a meeting to discuss the grievance with the Grievance Chairman. The Grievance Chairman will bring the member-grievant to the meeting. C. In the meeting called for at this Step, the Chief or designee shall hear a full explanation of the grievance and the material facts relating thereto. D. 4. Within seven (7) working days from the date the reply is received, the Grievance Committee shall notify in writing, the supervisor who rendered the decision and the Human Resources Department, whether or designee not the Union intends to process the grievance any further.

D. Within ten (10) calendar days of the meeting in this Step, the Chief shall submit written decision to the Grievance Chairman the written response to the grievanceCommittee.

(b) Nothing in the Agreement shall be construed as compelling the Union to submit a grievance Form, to arbitration or to represent an employee before the Safety/State Civil Service Director Commission. The Union's decision to request the movement of a grievance to arbitration or designee shall investigate the grievance, and shall schedule and conduct a meeting to discuss terminate the grievance with prior to submission to arbitration shall be final as to the Grievance Chairman. The Grievance Chairman may bring interests of the member-grievant and the appropriate Grievance Representative Union.
(c) Where the grievance involved an alleged violation of individual rights specified in State Civil Service Commission Law and Rules for which a specific appeal to the meeting.

The Union's decision to request the movement of a grievance to arbitration or to terminate the grievance prior to submission to arbitration shall be final as to the interests of the grievant and the Union.
(c) Where the grievance involved an alleged violation of individual rights specified in State Department of Personnel Law and Rules for which a specific appeal to the State Department of Personnel is available, the individual may present his/her complaint to the State Department of Personnel directly. The grievant may pursue the formal steps which followState Department of Personnel procedure or the Grievance Procedure as herein provided. Before Once the grievant makes the selection of procedure, such selection shall be deemed final and binding and constitute an absolute waiver of the procedure not selected. The election will be made in writing at the appropriate time.
3. Should the Union wish to move a grievance and proposed solution is placed in writing by a member pursuant to Step 1arbitration, the Grievance Chairman or designee Union shall notify the Public Employment Relations Commission of same and request a list of arbitrators to be advised furnished to the Employer and the Union. Selection of an arbitrator shall conform to the procedures of the grievance.
A. Should the member-grievant not be satisfied with the answer in Step 1Public Employment Relations Commission, within respectively. The parties shall meet at least ten (10) calendar working days thereafter prior to the member may appeal the grievance to Step 2 by delivering a copy date of the Grievance Formarbitration hearing to frame the issues to be submitted to the arbitrator and to stipulate the facts of the matter in an effort to expedite the hearing.
4. The arbitrator shall hear the matter on the evidence and within the meaning of this Agreement and make a decision, which decision shall neither modify, add to, or subtract from the terms of this Agreement and the referenced policies. The decision shall be rendered within thirty (30) days of the hearing.
5. The cost of the arbitrator and his/her expenses shall be borne equally by both parties. Any other expenses incurred in connection with the arbitration shall be paid by the party incurring same.
6. The cost of the transcript, if any, will be borne by the party requesting it. If both parties request a transcript, the cost will be shared equally.
7. The arbitrator may prescribe an appropriate back pay remedy when he/she finds a violation of this Agreement, provided such a remedy is permitted by law, and any other pertinent documentsis consistent with the terms of this Agreement, except that he/she may not make an award which exceeds the Employer's authority.
8. The decision or award of the arbitrator shall be final and binding to the office of the Chief of Police or the Chief's designee if the Chief is absent from duty. The Chief or designee shall date the Form, accurately showing the date the office received the Form.
B. Within ten (10) calendar days of receipt of the Grievance FormEmployer, the Chief or designee shall investigate the grievanceUnion, and shall schedule and conduct a meeting to discuss the grievance with the Grievance Chairman.
