High Risk Systems. THE SYSTEM AND SERVICES ARE NOT DESIGNED, DEVELOPED, TESTED, OR INTENDED TO BE RELIABLE IN THE CONTEXT OF HIGH RISK SYSTEMS. WESCO HAS NO RESPONSIBILITY FOR, AND CUSTOMER WILL INDEMNIFY, DEFEND, AND HOLD HARMLESS WESCO, ITS AFFILIATES, AND REPRESENTATIVES FROM ALL CLAIMS, SUITS, DEMANDS, AND PROCEEDINGS ALLEGING, CLAIMING, SEEKING, OR ASSERTING, ANY LIABILITY, LOSS, OBLIGATION, RISK, COST, DAMAGE, AWARD, PENALTY, SETTLEMENT, JUDGMENT, FINE, OR EXPENSES (INCLUDING ATTORNEYS’ FEES) ARISING FROM OR IN CONNECTION WITH CUSTOMER’S USE OF THE SYSTEM AND SERVICES ON OR IN A HIGH RISK SYSTEM, INCLUDING THOSE THAT COULD HAVE BEEN PREVENTED BY DEPLOYMENT OF FAIL-SAFE OR FAULT-TOLERANT FEATURES TO THE HIGH RISK SYSTEM, OR ARE BASED ON A CLAIM, ALLEGATION, OR ASSERTION THAT THE FUNCTIONING OF THE HIGH RISK SYSTEM DEPENDS OR DEPENDED ON THE FUNCTIONING OF THE SYSTEM, AND SERVICES, OR THAT THE FAILURE OF ANY SYSTEM AND SERVICES CAUSED A HIGH RISK SYSTEM TO FAIL. THE SYSTEM AND SERVICES SHALL NOT BE USED FOR EMERGENCY RESPONSE SYSTEMS OR TO OPERATE LIFE SAFETY DEVICES.

HIGH RISK SYSTEMS INCLUDE, BUT ARE NOT LIMITED TO, CRITICAL INFRASTRUCTURE, INDUSTRIAL PLANTS, AIRCRAFT, TRAIN, BOAT, OR VEHICLE NAVIGATION OR COMMUNICATIONS SYSTEMS, WEAPONS SYSTEMS, AIR TRAFFIC CONTROL SYSTEMS, NUCLEAR FACILITIES, OR LIFE SUPPORT OR EMERGENCY MEDICAL OPERATIONS.

Related to High Risk Systems

  • High Risk Use Npcap is not designed, manufactured, or intended for use in hazardous environments requiring fail-safe performance where the failure of the software could lead directly to death, personal injury, or significant physical or environmental damage (“High Risk Activities”). Use of Npcap in High Risk Activities is not authorized.

  • High Risk Activities 1. The Software is not fault-tolerant and is not designed, manufactured or intended for use or resale as on-line control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the Software could lead directly to death, personal injury, or severe physical or environmental damage ("High Risk Activities"). Syncro and its suppliers specifically disclaim any express or implied warranty of fitness for High Risk Activities.

  • Drainage Systems (1) Clear culvert inlets, outlets, and sediment catching basins.

  • Infrastructure (a) The Borrower has and will maintain a sufficient infrastructure to conduct its business as presently conducted and as contemplated to be conducted following its execution of this Agreement.

Supplier will have a defined process to address any findings but will ensure that any high-risk vulnerabilities are addressed within 30 days.

  • Infrastructure Improvements The design, redevelopment and construction and completion of certain infrastructure improvements, including sewer, stormwater, electrical and water main improvements, along with other similar improvements.

  • Anesthesia Services This plan covers general and local anesthesia services received from an anesthesiologist when the surgical procedure is a covered healthcare service. This plan covers office visits or office consultations with an anesthesiologist when provided prior to a scheduled covered surgical procedure.

  • Irrigation Systems The Project Area either has no irrigation system or a low-volume drip irrigation system. If a watering system is used, it is a drip irrigation system equipped with a filter, pressure regulator and emitters rated at twenty (20) gallons per hour (gph) or less. The system is maintained free of leaks and malfunctions. No spray irrigation is applied to the Project Area, including spray from irrigation systems adjacent to the Project Area.
