Higher Duties Allowance. (a) An employee who is appointed to perform temporarily all of the duties of a higher classified position and who performs all such duties required to be performed during the appointment will be paid an allowance equal to the difference between their substantive salary and the minimum salary of the higher classified position for all the time during which the employee performs such duties. Where it is specified at the commencement of the higher duties allowance that the employee is to undertake part of the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paid. (b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one (1) week or in excess of two (2) consecutive working days for trades staff. (c) No allowance will be payable pursuant to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks. (d) An employee who has been in receipt of a higher duties allowance for more than one (1) month will be paid such allowance for all paid leave taken during that period. (f) Where an employee in receipt of a higher duties allowance works on a public holiday, the relevant shift loading or overtime rate will be applied to the higher duties allowance for time worked on that day.

Higher Duties Allowance. Acting in a Higher Position Other Than Principal
(a) An A higher duties allowance shall be paid to an employee who is appointed to perform temporarily all of the duties of acts up for more than eight consecutive working days in a position with a higher classified position and who performs all such duties required to be performed during the appointment will be paid an allowance equal to the difference between their substantive salary and the minimum salary of the higher classified position for all the time during which the employee performs such duties. (g) When as a consequence of an employee in receipt appointment to the Community of Learning leadership role the employer reallocates duties of a teacher(s) acting in a higher duties allowance works on position to a public holiday, the relevant shift loading teacher or overtime rate will be applied to teachers then:
(i) the higher duties allowance for time worked shall be paid from the date the duties are transferred
(ii) the higher duties allowance may be paid to both permanent and fixed term teachers
(iii) the employer shall identify either the hours assigned to each teacher (as per 3.13 (d) above) or the total hours transferred each term where the duties are not performed on that daya continuous basis
(iv) the rate of the higher duties allowance will be calculated in accordance with 3.13 (b) and 3.13 (f) above.

Higher Duties Allowance. (a) An employee 79.1 A staff member who is appointed to perform temporarily all of the duties of a higher classified position and who performs all such duties required to be performed during act in a position of higher classification than that which the appointment staff member occupies will be paid an allowance equal computed in accordance with this clause.

79.3 For the purposes of determining the minimum periods as outlined above, holidays shall count when the acting at the higher level takes place both before and after the holiday.
79.4 The higher duties allowance shall be the difference between their the professional staff member’s substantive salary and the minimum salary point of the higher classified position for all level position.
79.5 If the time during which professional staff member is not performing the employee performs such duties. Where it is specified at the commencement of the higher duties allowance that the employee is to undertake part full range of the duties of the higher position onlylevel position, he/she shall be paid a lesser amount, which will normally be a percentage pro rata amount of the full amount, will be paid.

79.6 A professional staff member shall be eligible to receive an increment at the higher level position if they have served for a continuous period in excess of one
(1) week 12 months at the higher level, or in excess a total period of two (2) consecutive working days for trades staff12 months over a 24-month period.
(c) No allowance will 79.7 If a professional staff member is promoted to the higher level position, they shall not suffer any reduction in remuneration and shall be payable pursuant promoted on the same incremental level at which they were acting.
79.8 Any periods of acting at the higher level shall be taken into account in determining future increments should a professional staff member be promoted to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and the higher level.
79.9 A professional staff member who is deputising while the senior employee is absent on duty or for periods of leave for up acting in a higher level position shall be entitled to four (4) weeks.

Higher Duties Allowance. (a) An employee who is appointed 4.8.1 Where the University requires a Staff Member to perform temporarily some or all of the duties of a position classified at a higher classified position and who performs all such duties required to be performed during level for a minimum period of five consecutive working days (or in the appointment case of a part-time Staff Member, for a minimum period of the Staff Member’s normal working week), the Staff Member will be paid their substantive salary as well as an allowance equal to the difference between their the Staff Member’s substantive salary and the minimum salary for the level of the higher classified position.
4.8.2 Where the Staff Member is not undertaking all the duties of the position then a proportion of the allowance will be paid for the proportion of work performed. The Staff Member will be advised of the extent of the duties to be performed and the rate of allowance to be paid. The duties and allowance may be increased or decreased during the relieving period following consultation with the Staff Member.
4.8.3 Payment of a Higher Duties Allowance will not normally exceed a period of 12 months. If the allowance is to continue to be paid beyond the 12 month period the Supervisor must advise the Director, Human Resources the reasons and seek approval for continuation of the allowance. The Director, Human Resources may approve the continuation of the allowance for a further period of up to 12 months and/or make a recommendation regarding the cessation of the allowance and associated duties.
4.8.4 A Higher Duties Allowance is not payable where the Staff Member is the designated relieving officer or is recognised in the relevant position description as the deputy of a more senior Staff Member.
4.8.5 Where a Staff Member is paid a Higher Duties Allowance for a period greater then 12 months they will be eligible for incremental progression to the next step of the higher classified position for all and the time during which the employee performs such duties. Where it is specified at the commencement of the higher duties allowance that the employee is to undertake part of the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paidbecome superannuable.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position 4.8.6 A Staff Member who receives a Higher Duties Allowance for a period in excess of one
(1) week or in excess of two (2) consecutive 20 working days for trades staff.
(c) No allowance will be payable pursuant to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while receive the senior employee is absent on duty or for periods of leave for up to four (4) weeks.

(d5) An employee Where an officer who has qualified for payment of higher duties allowance under this clause is required to act in another office or other offices classified higher than the officer’s own for periods less than five working days without any break in acting service, such officer shall be paid higher duties allowance for such periods: provided that payment shall be made at the highest rate the officer has been paid during the term of continuous acting or at the rate applicable to the office in which the officer is currently acting - whichever is the lesser.
(6) Where an officer who is in receipt of an allowance granted under this clause and has been so for a continuous period of 12 months or more, proceeds on -
(a) a period of normal annual leave; or
(b) a period of any other approved leave of absence of not more than four weeks, such officer shall continue to receive the allowance for the period of leave; provided that this subclause shall also apply to an office who has been in receipt of a higher duties an allowance for less than 12 months if during the officer’s absence no other officer acts in the office in which the officer was acting immediately prior to proceeding on leave and the officer resumes in the office immediately on return from leave.
(7) Where an officer who is in receipt of an allowance granted under this clause proceeds on -
(a) a period of annual leave in excess of the normal; or
(b) a period of any other approved leave of absence of more than one (1) month will four weeks, such officer shall not be paid entitled to receive payment of such allowance for all paid leave taken during that periodthe whole or any part of the period of such leave.

Higher Duties Allowance. (a) Where an employee has been directed to temporarily perform duties at a higher classification level, the following provisions apply:
i. An employee who is appointed directed to perform temporarily all or part of the duties of a higher classified position and who performs all such duties required to be performed during the appointment classification will be paid an allowance equal to the difference between their substantive the employee’s own salary and the minimum salary of the employee would receive if promoted to the higher classified position for all the time during which the employee performs such duties. v. An employee who performs the duties of a higher classification which has a maximum annual salary in excess of the maximum annual salary payable to Nurse 3, for a period in excess of one
(1) less than one week or in excess of two (2) consecutive working days for trades staffwill not be paid an allowance, and that period will not count as service at the higher classification level unless the commissioner determines otherwise.
(c) No allowance vi. An employee who performs the duties of a higher classification for twelve months continuously, or for twelve months in broken periods over a 24 month period, and has met the requirements of clause 24 of this Agreement will be payable pursuant to subclause 12.1(a) to paid an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for increment in accordance with that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeksclause.

(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.
(f) Where an employee in receipt of a higher duties allowance works on observes a public holiday, will continue to receive payment of higher duties allowance during the relevant shift loading or overtime rate will be applied absence to the extent of the continued operation of the direction. Higher Duties Allowance. 29.3 Where a relieving employee classified above Level 3 acts in an office or offices classified one class higher than the employee’s own office for a continuous period exceeding 4 weeks, the employee shall be paid a higher duties allowance as prescribed in subclause 29.1 of this Clause for all that the employee is to undertake part of the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paid.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a such period in excess of one4 weeks.

Provided that this subclause 12.1(a) shall also apply to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks.
(d) An employee who has been in receipt of a higher duties an allowance for less than 12 months if during the employee’s absence no other employee acts in the office in which the employee was acting immediately prior to proceeding on leave and the employee resumes in the office immediately after leave. For the purpose of this subclause the expression “normal annual leave” shall mean an annual period of recreation leave of 4 weeks (5 weeks in the case of regular shift workers), and shall include any of the holidays and leave in lieu accrued during the preceding 12 months taken in conjunction with such annual recreation leave.
29.8 Where an employee who is in receipt of an allowance granted under this Clause proceeds on:
29.8.1 A period of annual leave in excess of the normal; or
29.8.2 A period of any other approved leave of absence of more than one (1) month will 1 calendar month, the employee shall not be paid entitled to receive payment of such allowance for all paid leave taken during that periodthe whole or any part of the period of such leave.

(b) No allowance will be payable pursuant advise the hours assigned to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one

(e) An employee who has been relieving continuously This allowance shall be included in a position the employee’s salary in order to calculate appropriate holiday pay for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employmentthat employee.
(f) Where The ‘rate for the position’ is the salary the employee acting up would receive should they be permanently appointed to the position but not less than the rate for their current position.
(g) When as a consequence of an employee in receipt appointment to the Kāhui Ako leadership role the employer reallocates duties of a teacher(s) acting in a higher duties allowance works on position to a public holiday, the relevant shift loading teacher or overtime rate will be applied to teachers then:
(i) the higher duties allowance for time worked shall be paid from the date the duties are transferred
(ii) the higher duties allowance may be paid to both permanent and fixed term teachers
(iii) the employer shall identify either the hours assigned to each teacher (as per 3.13 (d) above) or the total hours transferred each term where the duties are not performed on that daya continuous basis
(iv) the rate of the higher duties allowance will be calculated in accordance with 3.13 (b) and 3.13 (f) above.

Higher Duties Allowance. (a) An employee 37.1 This Clause applies only to an Education Assistant who is appointed to perform temporarily all of the duties of act in a position that is classified at a higher level than their substantive position.
37.2 An Education Assistant who is directed by the Employer to act in a position that is classified higher than the Employee’s own substantive position and who performs all such duties required to be performed during the appointment works for a continuous period of more than two hours, will be paid an allowance equal to the difference between their substantive salary the Employee’s own wage and the minimum salary wage of the higher classified position.
37.3 The allowance paid may be adjusted during the period of higher duties.
37.4 Where an Education Assistant is directed to act in a position for all which has an incremental range of wages the time during which the employee performs such duties. Where it is specified at the commencement of Education Assistant will be entitled to receive an increase in the higher duties allowance equivalent to the annual increment the Education Assistant would have received had the Education Assistant been permanently appointed to such position. The application of this provision is on the basis that the employee is to undertake part acting service with allowances for acting in positions for the same classification or higher than the position during the 18 months preceding the commencement of such acting will aggregate as qualifying service towards such an increase in the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paidallowance.
(b) No 37.5 Where an Education Assistant who is in receipt of an allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position granted under this Clause and has been so for a continuous period in excess of one
(1) week 12 months or in excess more, proceeds on a period of two (2) consecutive working days approved leave of not more than four weeks other than student vacation leave, the Employee will continue to receive the allowance for trades staff.
(c) No allowance the period of leave. This Clause will be payable pursuant to subclause 12.1(a) also apply to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks.

(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires37.6 This Clause does not apply to Education Assistants working within the same classification, resigns or where that Education Assistant is retrenched by the University will receive payment for accrued leave entitlements at the classified higher rate of pay on termination of employmentdue to their personal annual progression.
(f) Where an employee in receipt of a higher duties allowance works on a public holiday, the relevant shift loading or overtime rate will be applied to the higher duties allowance for time worked on that day.

Higher Duties Allowance. (a1) An employee who is temporarily appointed to perform temporarily and satisfactorily performs all of the duties of a higher classified position and who performs all such duties required to be performed during the appointment for at least 5 consecutive working days is a “relieving employee” and, will be paid an a higher duties allowance equal to for the time they perform the duties.
(2) A higher duties allowance is the difference between their substantive the relieving employee’s salary and the minimum salary of the higher classified position.
(3) If only a portion of the duties associated with the higher position are performed, a pro rata relieving allowance may be paid.
(4) A higher duties allowance will not be paid if a relieving employee’s position statement includes deputising for all the time position in which they are relieving, except if they perform the duties for a period longer than 4 consecutive weeks.
(5) An allowance shall not be payable where a period of leave of absence taken by an employee acting in a higher level position exceeds 5 consecutive working days.
(6) A higher duties allowance will be varied to take into account any changes in salary for the higher classified position occurring during which the relieving period.
(7) If the University expects a position to be vacant for an indefinite period, it should, where operational circumstances permit, be internally advertised in the first instance and filled through competitive selection.
(8) An employee performs such duties. Where it who has relieved for one year or more in the same higher classified position is specified at eligible for incremental progression in the commencement position and for payment of the higher duties allowance that on any leave taken during the employee is to undertake part further period of the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paidrelief.

Higher Duties Allowance. (a) 70.1 An employee who is appointed required by the University to act in a position of higher classification than that which the employee occupies will be paid a higher duties allowance provided the period of acting service in the higher position is continuous for a period of ten consecutive working days or more.
70.2 For the purposes of this clause, a public holiday will count as part of the qualifying period when an employee acts in a higher position on the working day immediately prior to and on the working day immediately following the public holiday.
70.3 Where an employee qualifies for payment of a higher duties allowance, the allowance will be payable from the date the employee commences the performance of the higher duties.
70.4 An employee who is required to perform temporarily all the full duties of a higher classified position will be entitled to the payment of a higher duties allowance. The rate of the allowance will be the difference between the employee’s substantive base salary and the minimum salary applicable to the higher classified position.
70.5 Where an employee performs a portion of the duties of a higher classified position and who performs all such duties required to be performed during position, the appointment employee will be paid an allowance which will be equal to that proportion of the difference between their substantive the salary of the employee and the minimum salary of the that higher classified position for all the time during of which the employee performs such is performing a portion of the duties. Where it is specified at The proportion will equate with the commencement of the higher duties allowance that the employee is to undertake part proportion of the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paidperformed.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the 70.6 Where an employee performs the duties of a higher position for periods that are not continuous but in aggregate total more than 12 months, the employee will upon the completion of each period totaling 12 months be granted salary increments applicable to the higher classified position provided that for the first and subsequent increments, each total 12 month period of higher duties is completed within the period of 24 months preceding that completion.
70.7 For the purposes of clause 70.6 above, where an employee performs the duties of another position having the same or higher classification than the higher position for which the employee was receiving a higher duties allowance, these duties will be deemed to be performance of duties in the higher position.
70.8 Where an employee who is performing the duties of a higher position is permanently promoted to that position, the employee will not suffer any reduction in remuneration, and will receive the same increments as if the employee had during the period of temporary service in the higher position been the permanent occupant of that position.
70.9 An employee, who at the time of proceeding on approved leave with pay (other than long service leave) was in receipt of an allowance under this clause, will continue to be paid such an allowance if the delegated officer certifies that the allowance would have been paid but for the granting of the leave, and the employee will continue to act in the higher position after the commencement of duty, provided that:
(a) where an employee is granted leave on a part-time basis; the replacement employee undertaking the duties of the higher position will receive the allowance on a pro-rata basis equivalent to the percentage of the time of leave granted;
(b) where an employee has received an allowance in respect of acting in an unbroken series of higher positions up to the time of proceeding on leave with pay (other than long service leave), the employee will continue to receive the allowance during the leave if the delegated officer certifies that the allowance would have been paid in respect of acting in any one of those positions but for the granting of leave and the employee will continue to act in the higher position after the commencement of duty.
70.10 When higher duties allowance payments are included in leave with pay in accordance with clause 70.9 above, the leave period in excess respect of one
(1) week or which the payments are included will be regarded as service for the purpose of the granting of increments in excess of two (2) consecutive working days for trades staffaccordance with this clause.
(c) No 70.11 An allowance will be payable pursuant to subclause 12.1(a) to an employee whose position is designated under this clause will be regarded as a “deputy” or equivalent salary for the purposes of a more senior employeecalculating all other types of allowances, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeksincluding overtime.
(d) 70.12 An employee who has been will not be penalised in receipt of any way for a refusal to perform higher duties.
70.13 Nothing in this clause will prevent higher duties allowance being authorised for more periods less than one (1) month will be paid such allowance for all paid leave taken during that periodspecified in sub clause 70.1.
(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.
(f) Where an employee in receipt of a higher duties allowance works on a public holiday, the relevant shift loading or overtime rate will be applied to the higher duties allowance for time worked on that day.

Higher Duties Allowance. (a) 42.1 An employee who performs the duties of a higher classification which has a maximum attainable annual salary:
a) not higher than the maximum attainable annual salary payable to an Administrative Officer 6 , will be paid an allowance for performing the duties of the higher classification upon the completion of one day; or
b) higher than the maximum attainable annual salary payable to an Administrative Officer 6, will be paid an allowance for performing the duties of the higher classification upon the completion of six days. Note: The salary level for an Administrative Officer 6 can be found in Schedule 11 of the Northern Territory Public Sector 2017—2021 Enterprise Agreement; as at 10 August 2017 it was $96,145.
42.2 For the purpose of this clause:
a) Higher duties is appointed to perform temporarily all defined as temporary performance of the duties of a higher classified position and who performs all such designation above the substantive designation occupied.
b) Higher duties required to be performed during the appointment will be paid an allowance equal to means the difference between their the actual salary paid with respect to the substantive salary designation and the minimum salary of the higher classified position for all the time during point at which the employee would be paid were they to hold the higher duty designation as their substantive designation.
c) Substantive designation means the designation to which an employee has been appointed, permanently transferred or permanently promoted.
d) An employee may be directed to perform higher duties for which duties the employee shall be paid a higher duties allowance in accordance with clause 42.
42.3 Other conditions
a) An employee temporarily performing the duties of a designation, the conditions of service of which differ from those of the designation normally held by the employee, shall be subject to the conditions of service of that designation as though the permanent holder of that designation.
b) An employee who temporarily performs such duties. the duties of a designation which mandates criteria for advancement must meet that criteria before an allowance may be paid.
42.4 Partial payment of allowance Where it is specified at an employee performing higher duties does not perform all the commencement of duties applicable to that designation the CEO shall determine the higher duties allowance that the employee is to undertake part of the duties of the higher position onlypayable, a lesser amount, which will normally be calculated as a percentage of the full amountduties performed, will be paidand subject to such conditions as the CEO approves.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one
(1) week or in excess of two (2) consecutive working days for trades staff.
(c) No allowance will be payable pursuant to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks.

Higher Duties Allowance. Professional Staff The higher duties allowance is the difference between the salary of the staff member and the salary payable for the position at the higher classification and is proportionate to the percentage of work being performed. The staff member will receive the allowance for the period of the higher duties. A staff member whose substantive position is designated at Level A is not permitted to undertake course coordination. Overtime Meal Allowance $20.00 Professional staff members will receive an Overtime Meal Allowance when working approved overtime in accordance with Clause 37 (Overtime – Professional Staff), as a “deputy” follows: • Weekdays – where the staff member has worked two (2) hours or equivalent more of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks.
(d) An employee who has been approved overtime in receipt of a higher duties allowance for more than any one (1) month day; or • Weekends and University Holidays – where the staff member has worked five (5) hours or more of approved overtime in any one (1) day. An Overtime Meal Allowance will not be paid in circumstances where: • the staff member is not performing the overtime at a University campus or work location (for example, they perform the overtime at home or another location of their choice); and/or • the University provides the staff member with a meal. The Overtime Meal Allowance will be paid such allowance for all paid leave taken during that period.
(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched adjusted by the University on the FFPPOA 1 July each year during the life of this Agreement, equivalent to the most recently published Australian Bureau of Statistics Consumer Price Index (All Groups, Australia) annual figure. Change of Residence / Relocation Allowance In accordance with University policy A staff member will be entitled to apply for a Relocation Allowance in circumstances where: • the staff member is successful in being appointed to a position at another University campus or location; • the appointment requires a geographical relocation and results in the staff member changing their place of residence; and • the appointment is regarded as being in the interests of the University. Indigenous Australian salary loading $5,000 per annum (pro-rata for part-time). This loading is superannuable and will not increase in accordance with salary increases. Indigenous Australian staff employed on a continuing or fixed-term basis. A staff member will be required to provide Confirmation of Identity as defined in University policy and procedure to be eligible to receive this loading. Gender Affirmation Allowance $2,000 as a lump sum payment for accrued leave entitlements claimable once only over any periods of casual employment at the higher rate of pay on termination of employment.

Higher Duties Allowance. (a) An employee officer who is appointed directed by the Commission to perform temporarily all of act in an office which is classified higher than the duties of a higher classified position officer's own substantive office and who performs all such the full duties required and accepts the full responsibility of the higher office for a continuous period of five consecutive working days or more, shall, subject to be performed during the appointment will provisions of this clause, be paid an allowance equal to the difference between their substantive the officer's own salary and the minimum salary the officer would receive if the officer was permanently appointed to the office in which the officer is so directed to act. Where the full duties of a higher office are temporarily performed by two or more officers they shall each be paid an allowance as determined by the Commission. An officer who is directed to act in a higher classified office but who is not required to carry out the full duties of the position and/or accept the full responsibilities, shall be paid such proportion of the allowance provided for in subclause (1) of this clause as the duties and responsibilities performed bear to the full duties and responsibilities of the higher office. Provided that the officer shall be informed, prior to the commencement of acting in the higher classified position for all office, of the time duties to be carried out, the responsibilities to be accepted and the allowance to be paid. This allowance paid may be adjusted during which the employee performs such period of higher duties. Where it is specified at the commencement an officer who has qualified for payment of the higher duties allowance that under this clause is required to act in another office or other offices classified higher than the employee is to undertake part of the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paid.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position officer's own for a period in excess of one

Higher Duties Allowance. 26.1 Higher Duties Allowance (aHDA) An employee is payable to an officer who is appointed directed to temporarily perform temporarily all of the duties of a position with a higher classified classification.
26.2 An officer acting in a position and who performs all such duties required to be performed during the appointment with a maximum pay of an RMO 2, for a period of one day or more, will be paid HDA for that period.
26.3 An officer acting in a position with a pay or maximum pay greater than the maximum pay of an allowance equal RMO 2 will be paid HDA for a period of five consecutive days or more. This payment will occur from day 1, provided the total period of higher duties is five days or more.
26.4 Where the officer on temporary transfer is to perform the full duties of the higher position, HDA is calculated as the difference between their substantive salary the staff member‘s current pay and a point in the minimum salary pay range of the higher classified position for all determined by the time during which head of service in accordance with Clause 25.
26.5 Where the employee performs such duties. Where it officer is specified at the commencement of the higher duties allowance that the employee is to undertake performing only part of the duties of the higher position onlyand the higher position is at least two levels above the officer‘s current substantive level, a lesser amountpayment of partial HDA may be agreed between the supervisor/manager and the officer, which prior to the commencement of the temporary transfer.
26.6 The rate of payment for partial HDA will normally be a percentage point in the pay range(s) of the full amount, intervening level(s). The head of service‘s decision on the rate of payment of partial HDA will be paid.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless take into account the employee performs specified part of the duties of the higher classified position that the officer is to perform.
26.7 An officer receiving HDA is entitled to normal incremental progression for the officer‘s substantive position and any increment gained while performing HDA is maintained upon the officer ceasing the higher duties.
26.8 Previous higher duties service will be considered in determining the appropriate pay point for future periods of higher duties.
26.9 If a position is expected to be available for a period of six months or longer the position must be advertised in excess of one
(1) week or in excess of two (2) consecutive working days for trades staffthe Gazette.
(c) No allowance 26.10 Periods of higher duties should not normally extend beyond twelve months. If after twelve months the position is normally vacant it will be payable pursuant to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeksadvertised unless there are exceptional circumstances.

Higher Duties Allowance. (a) Where an Employee has been directed to temporarily perform duties at a higher classification level, the following provisions apply:
i. An employee who is appointed Employee directed to perform temporarily all or part of the duties of a higher classified position and who performs all such duties required to be performed during the appointment classification will be paid an allowance equal to the difference between their substantive the Employee’s own salary and the minimum salary the Employee would receive if promoted to the higher classification, or an alternative amount determined and authorised as a percentage of the higher classified position for duties performed where partial performance is directed.
ii. An Employee under 21 years of age who is paid an age rate and is directed to perform all the time during which the employee performs such duties. (b) No allowance iv. An Employee who is directed to perform continuous higher duties for at least four hours will be payable pursuant to subclause 12.1(a) unless the employee regarded as being on higher duties for that whole day; performance of higher duties for less than four hours on one day will be disregarded for all purposes.
v. An Employee who performs the duties of a higher classification will be subject to the conditions of service of the higher classified position classification, including the criteria determined by the Commissioner or the relevant Schedule for advancement beyond a salary barrier point.
vi. An Employee who performs the duties of a higher classification which has a maximum annual salary in excess of the maximum annual salary payable to an Administrative Officer 6, for a period in excess of one
(1) less than one week or in excess of two (2) consecutive working days for trades staffwill not be paid an allowance, and that period will not count as service at the higher classification level unless the Commissioner determines otherwise.
(c) No allowance vii. An Employee who performs the duties of a higher classification for twelve months continuously, or for twelve months in broken periods over a 24 month period, and has met the requirements of clause 23 of this Agreement will be payable pursuant paid an increment in accordance with that clause.

Higher Duties Allowance. 29.3 Where a relieving employee classified above Level 3 acts in an office or offices classified one class higher than the employee’s own office for a continuous period exceeding 4 weeks, the employee shall be paid a higher duties allowance as prescribed in subclause 29.1 of this Clause for all that the employee is to undertake part of the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paid.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a such period in excess of one4 weeks.

(d) An employee who has been in receipt of a higher duties an allowance for less than 12 months if during the employee’s absence no other employee acts in the office in which the employee was acting immediately prior to proceeding on leave and the employee resumes in the office immediately after leave. For the purpose of this subclause the expression “normal annual leave” shall mean an annual period of recreation leave of 4 weeks (5 weeks in the case of regular shift workers), and shall include any of the holidays and leave in lieu accrued during the preceding 12 months taken in conjunction with such annual recreation leave.
29.8 Where an employee who is in receipt of an allowance granted under this Clause proceeds on:
29.8.1 A period of annual leave in excess of the normal; or
29.8.2 A period of any other approved leave of absence of more than one (1) month will 1 calendar month, the employee shall not be paid entitled to receive payment of such allowance for all paid leave taken during that periodthe whole or any part of the period of such leave.

Higher Duties Allowance. (a) 1. An employee who is appointed by the Branch/General Secretary to perform temporarily all of the duties of act in a position which is a higher classified position level than the employee’s own position, and who performs all such the full duties required to be performed during and accepts the appointment will full responsibility of the higher level position for a minimum of 15 hours, shall be paid an allowance equal to the difference between their substantive the employee’s own salary and the minimum salary the employee would receive if the employee was permanently appointed to the acting position.

Higher Duties Allowance. (a) An employee who is appointed to perform temporarily all 20.1. Higher Duties Allowance. ACTING IN A HIGHER POSITION OTHER THAN PRINCIPAL
(a) An A higher duties allowance shall be paid to an employee who is appointed to perform temporarily all of the duties of acts up for more than eight consecutive working days in a position with a higher classified position and who performs all such duties required to be performed during the appointment will be paid an allowance equal to the difference between their substantive salary and the minimum salary of the higher classified position for all the time during which the employee performs such duties. (i) the higher duties allowance for time worked shall be paid from the date the duties are transferred
(ii) the higher duties allowance may be paid to both permanent and fixed term teachers
(iii) the employer shall identify either the hours assigned to each teacher (as per 3.13 (d) above) or the total hours transferred each term where the duties are not performed on that daya continuous basis

(d) 47.5.5 Employees who undertake a significant proportion of the duties of a higher level position, but not all of the duties, will at least be paid an allowance to a salary step half way between their substantive level and the minimum of the level to which they are relieving.
47.5.6 An employee who has been in receipt of receives a higher duties allowance for more than one (1) month will be paid such an allowance for all approved paid leave taken during that period.
(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.

Higher Duties Allowance. (a) An 47.1 Higher Duties Allowance is payable to an employee who is appointed directed to temporarily perform temporarily the duties of a position with a higher classification.

47.6 An employee receiving Higher Duties Allowance is entitled to normal incremental progression for the employee’s substantive position. This increment gained while performing higher duties is maintained upon cessation of the higher duties.
47.7 Previous higher duties service will be considered in determining the appropriate salary point for future periods of higher duties.
47.8 Where the vacancy period of higher duties is expected to exceed 6 (six) months the vacancy will be advertised within the ACTPS.
47.9 Periods of higher duties should not normally extend beyond 12 months. If after 12 months the position is nominally vacant it will be advertised unless there are exceptional circumstances.
47.10 If an employee performs the duties of a higher classified position and who performs all such duties required to be performed during position, the appointment will be paid rate of Higher Duties Allowance payable is based upon the lowest salary point for the classification of that position. If, however, the employee has previous service for an allowance equal to increment or the difference between their substantive salary and the minimum salary bottom of the higher classified position for all salary scale exceeds the time during which employee’s standard salary, the employee performs such duties. Where it rate of Higher Duties Allowance payable is specified at the commencement next salary point of the higher duties allowance that classification.
47.11 If an employee is being paid Higher Duties Allowance before going on paid leave and would have continued to receive Higher Duties Allowance if they had not taken leave, then the employee is entitled to undertake part payment of Higher Duties Allowance for the duties period of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paidleave.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one
(1) week or in excess of two (2) consecutive working days for trades staff.
(c) No allowance will be payable pursuant to subclause 12.1(a) to 47.12 If an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods leave on half pay during a period of leave for up to four (4) weekshigher duties, the half pay rate must be based on the higher duties pay.
(d) 47.13 An employee who has been in receipt of a performing higher duties allowance continually for more than one 1 (1one) month will year may be paid such allowance for all paid leave taken during that period.
(e) An employee who has been relieving continuously in a position for a period in excess granted an increment. Broken periods of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.
(f) Where an employee in receipt of a performing higher duties allowance works on a public holiday, may also be counted towards an increment if the relevant shift loading or overtime rate will be applied to employee has performed the higher duties allowance for time worked on that daytwelve months in broken periods during the immediately preceding 2 (two) years, or 2 (two) years in the last 4 (four), or 3 (three) years in the past 6 (six) years.

Higher Duties Allowance. 32.1 Higher Duties Allowance (aHDA) An employee is payable to an officer who is appointed directed to temporarily perform temporarily all of the duties of a position with a higher classified classification.
32.2 An officer acting in a position and who performs all such duties required to be performed during the appointment with a maximum pay of an SRMO 1, for a period of one day or more, will be paid HDA for that period.
32.3 An officer acting in a position with a pay or maximum pay greater than the maximum pay of an allowance equal SRMO 1 will be paid HDA for a period of five consecutive days or more. This payment will occur from day one, provided the total period of higher duties is five days or more.
32.4 Where the officer on temporary transfer is to perform the full duties of the higher position, HDA is calculated as the difference between their substantive salary the staff member’s current pay and a point in the minimum salary pay range of the higher classified position for all determined by the time during which head of service in accordance with Clause 31.
32.5 Where the employee performs such duties. Where it officer is specified at the commencement of the higher duties allowance that the employee is to undertake performing only part of the duties of the higher position onlyand the higher position is at least two levels above the officer’s current substantive level, a lesser amountpayment of partial HDA may be agreed between the supervisor/manager and the officer, which prior to the commencement of the temporary transfer.
32.6 The rate of payment for partial HDA will normally be a percentage point in the pay range(s) of the full amount, intervening level(s). The head of service’s decision on the rate of payment of partial HDA will be paid.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless take into account the employee performs specified part of the duties of the higher classified position that the officer is to perform.
32.7 An officer receiving HDA is entitled to normal incremental progression for the officer’s substantive position and any increment gained while performing HDA is maintained upon the officer ceasing the higher duties.
32.8 Previous higher duties service will be considered in determining the appropriate pay point for future periods of higher duties.
32.9 If a position is expected to be available for a period of six months or longer the position must be advertised in excess of one
(1) week or in excess of two (2) consecutive working days for trades staffthe Gazette.
(c) No allowance 32.10 If a position is expected to be available for a period of less than six months advertisement in the gazette is not required.
32.11 Periods of higher duties should not normally extend beyond twelve months. If after twelve months the position is nominally vacant it will be payable pursuant to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeksadvertised unless there are exceptional circumstances.
(d) An employee who has been 32.12 Nothing in receipt this clause will restrict casual or temporary employees performing duties of a higher duties allowance for more than one (1) month will be paid such allowance for all paid leave taken during that periodoffice in accordance with the PSM Act and the PSM Standards.

Higher Duties Allowance. 29.3 Where a relieving employee classified above Level 3 acts in an office or offices classified one class higher than the employee’s own office for a continuous period exceeding four weeks, the employee shall be paid a higher duties allowance as prescribed in subclause 29.1 of this clause for all that the employee is to undertake part of the duties of the higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paid.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a such period in excess of one

(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.
(f) Where an employee in receipt of a higher duties allowance works on a public holidayfor such periods. Provided that payment shall be made at the highest rate the employee has been paid during the employee’s term of continuous acting or at the rate applicable to the office in which the employee is currently acting, whichever is the less.
29.6 Where an employee is directed to act in an office which has an incremental range of salaries, the relevant shift loading or overtime rate will employee shall be applied entitled to the receive an increase in higher duties allowance equivalent to the annual increment the employee would have received had the employee been permanently appointed to such office. Provided that acting service with allowances for time worked on that dayacting in offices of the same classification or higher than the office during the eighteen months preceding the commencement of so acting shall aggregate as qualifying service towards such an increase in the allowance.
29.7 Where an employee who is in receipt of an allowance granted under this clause and has been so for a continuous period of twelve months or more, proceeds on:

Higher Duties Allowance. (2) An employee who is directed by the Employer to perform the duties of a higher classification which has a minimum salary rate of pay higher than the ordinary rate of pay of his or her own substantive position and who performs the full duties and accepts the full responsibility of the higher classified position classification for all a continuous period of forty or more consecutive working hours, shall, subject to the time during provisions of this clause, be paid a Temporary Special Allowance equal to the difference between the employees own salary and the salary he or she would receive if he or she was permanently appointed to the classification in which the he or she is so directed to perform.
(3) Where an employee performs such duties. Where it is specified at the commencement who has qualified for payment of the higher duties allowance that or temporary special allowance under this clause is required to act in another position or other positions which have a minimum rate of pay higher than the employee is to undertake part ordinary rate of pay of the employees own substantive position and he or she performs the full duties and accepts the full responsibility of the higher position onlyfor periods less than forty consecutive working hours without any break in acting service, such employee shall be paid a lesser amount, higher duties allowance for such periods; provided that payment shall be made at the highest rate the employee has been paid during the term of continuous acting or at the rate applicable to the position in which will normally be a percentage of he or she is currently acting - which ever is the full amount, will be paidlesser.

Higher Duties Allowance. (a) 6.1. An employee who is appointed required to perform temporarily all act in a position of higher classification than that which the employee occupies shall be paid an allowance computed in accordance with this clause.
6.2. An employee shall be eligible for payment of a higher duties allowance where the period of acting service in the higher position is continuous for a period of at least two consecutive working weeks.

Higher Duties Allowance. 56.1 An employee continuously employed for more than two (2) weeks acting in a position, the salary for which is higher than that prescribed for the employee's permanent position shall, subject to Clause 56.2, be paid for the full period of acting the salary to which he/she would be entitled if the employee held that permanently.

(f) in all instances above there is an entitlement to payment of higher salary over the summer vacation period at a pro-rata rate.

56.3 An employee referred to in Clause 56.1 of this provision shall not be paid the higher salary for any period of absence on long service leave or for sick leave of more than a two (2) week duration.
56.4 Where an employee in receipt the full duties of a higher position are performed by two (2) or more employees on an acting basis, each shall be paid an allowance determined by the Employer.
56.5 Subject to Clause 56.6 hereof, an employee who is directed to act in a higher position but who is not required to carry out the full duties allowance works on a public holidayof the position and/or accept the full responsibilities, the relevant shift loading or overtime rate will shall be applied to paid such proportion of the higher duties allowance for time worked on that dayas the duties and responsibilities performed by him/her bear to the full duties and responsibilities of the higher position.

Higher Duties Allowance. (a) 20.1.1.1. a) For waged employees in Theatre & Events and the classifications of Ticket Sales Representative and Operational Security Officer, payment to the nearest quarter of an hour may be authorised for a minimum of two hours and for the number of hours during the shift in which they perform in the higher classified waged position.
b) Visitor Services Officer waged employees will be paid higher duties to the nearest quarter of an hour when they conduct backstage tours during the hours when no Supervisor is on duty.
20.1.1.5. Where a waged employee is authorised to undertake higher duties in a salaried position for a period in excess of one
(1) week or in excess of two (2) consecutive working days for trades staff.

47.8 Where the vacancy period of higher duties is expected to exceed 6 (six) months the vacancy will be advertised in the gazette. The requirement to advertise in the gazette does not apply to vacancies expected to be less than six months in duration.
47.9 Periods of higher duties should not normally extend beyond 12 months. If after 12 months the position is nominally vacant it will be advertised unless there are exceptional circumstances.
47.10 If an employee performs the duties of a higher classified position and who performs all such duties required to be performed during position, the appointment will be paid rate of Higher Duties Allowance payable is based upon the lowest salary point for the classification of that position. If, however, the employee has previous service for an allowance equal to increment or the difference between their substantive salary and the minimum salary bottom of the higher classified position for all salary scale exceeds the time during which employee’s standard salary, the employee performs such duties. Where it rate of Higher Duties Allowance payable is specified at the commencement next salary point of the higher duties allowance that classification.

(c) No allowance will be payable pursuant to subclause 12.1(a) to 47.12 If an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods leave on half pay during a period of leave for up to four (4) weekshigher duties, the half pay rate must be based on the higher duties pay.
(d) 47.13 An employee who has been in receipt of a performing higher duties allowance continually for more than one 1 (1one) month will year may be paid such allowance for all paid leave taken during that period.
(e) An employee who has been relieving continuously in a position for a period in excess granted an increment. Broken periods of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.

Higher Duties Allowance. (a) An employee who is appointed Gen)
6.6.1 Your employer may approve payment of a higher duties allowance to perform temporarily all you if you are required to undertake the full duties and responsibilities of a higher graded position during the temporary absence of the occupant of that position, and to competently discharge those higher duties. Payment at a lesser rate may be approved for you if you are required to undertake only some of the duties and responsibilities of a higher classified position and who performs all such duties required to be performed during graded position.
6.6.2 The rate of the appointment allowance will be paid an allowance equal to calculated by taking the difference between their substantive your salary and the salary that you would have received if appointed to the higher position. Where the payment of the full rate of the allowance is not justified, the rate is to be that proportion of the full allowance that the duties and responsibilities competently performed, bear to the whole of the higher duties and responsibilities.
6.6.3 If you are on ranges of rates, Higher Duties Allowance shall be calculated as 6.5 per cent of your salary, except where the difference between your salary and the minimum salary for the higher position is a greater amount, in which case the higher amount is payable. Where the payment of the higher classified position for all full rate of the time during which allowance is not deemed by your employer to be appropriate, the employee performs such duties. Higher Duties Allowance. Higher Duties Allowance. (a)
41.1 An employee who performs the duties of a higher classification which has a maximum attainable annual salary:
a) not higher than the maximum attainable annual salary payable to an Administrative Officer 6 , will be paid an allowance for performing the duties of the higher classification upon the completion of one day; or
b) higher than the maximum attainable annual salary payable to an Administrative Officer 6, will be paid an allowance for performing the duties of the higher classification upon the completion of six days. Note: The salary level for an Administrative Officer 6 can be found in Schedule 11 of the Northern Territory Public Sector 2021—2025 Enterprise Agreement; as at 10 August 2017 it was $103,538.
41.2 For the purpose of this clause:
a) Higher duties is appointed to perform temporarily all defined as temporary performance of the duties of a higher classified position and who performs all such designation above the substantive designation occupied.
b) Higher duties required to be performed during the appointment will be paid an allowance equal to means the difference between their the actual salary paid with respect to the substantive salary designation and the minimum salary of the higher classified position for all the time during point at which the employee would be paid were they to hold the higher duty designation as their substantive designation.
c) Substantive designation means the designation to which an employee has been appointed, permanently transferred or permanently promoted.

41.3 Other conditions
a) An employee temporarily performing the duties of a designation, the conditions of service of which differ from those of the designation normally held by the employee, shall be subject to the conditions of service of that designation as though the permanent holder of that designation.
b) An employee who temporarily performs such duties. the duties of a designation which mandates criteria for advancement must meet that criteria before an allowance may be paid.
41.4 Partial payment of allowance Where it is specified at an employee performing higher duties does not perform all the commencement of duties applicable to that designation the CEO shall determine the higher duties allowance that the employee is to undertake part of the duties of the higher position onlypayable, a lesser amount, which will normally be calculated as a percentage of the full amountduties performed, will be paidand subject to such conditions as the CEO approves.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one
(1) week or in excess of two (2) consecutive working days for trades staff.

Higher Duties Allowance. (b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one
(1) week or in excess of office are temporarily performed by two (2) or more employees they shall each be paid an allowance as determined by the employer.
44.3 An employee who is directed to act in a higher classified office but who is not required to carry out the full duties of the position and/or accept the full responsibilities, shall be paid such proportion of the allowance provided for in sub-clause 44.1 of this clause as the duties and responsibilities performed bear to the full duties and responsibilities of the higher office. Provided that the employee shall be informed, prior to the commencement of acting in the higher classified office, of the duties to be carried out, the responsibilities to be accepted and the allowance to be paid. The allowance paid may be adjusted during the period of higher duties.
44.4 Where an employee who has qualified for payment of higher duties allowance under this clause is required to act in another office or other offices classified higher than the employee’s own for periods less than five consecutive working days for trades staff.
(c) No allowance will without any break in acting service, such employee shall be payable pursuant to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks.
(d) An employee who has been in receipt of paid a higher duties allowance for more than one (1) month will such periods: provided that payment shall be made at the highest rate the employee has been paid such allowance for all paid leave taken during that periodthe term of continuous acting or at the rate applicable to the office in which the employee is currently acting - whichever is the lesser.
(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.
(f) 44.5 Where an employee is directed to act in receipt an office which has an incremental range of a higher duties allowance works on a public holiday, the relevant shift loading or overtime rate will salaries such an employee shall be applied entitled to receive an increase in the higher duties allowance equivalent to the annual increment the employee would have received had the employee been permanently appointed to such office; provided that acting service with allowances for acting in offices for the same classification or higher than the office during the eighteen (18) months preceding the commencement of such acting shall aggregate as qualifying service towards such an increase in the allowance.
44.6 Where an employee who is in receipt of an allowance granted under this clause and has been doing so for a continuous period of twelve months or more, proceeds on any period of paid leave and:
(a) resumes in the office immediately on return from leave, the employee shall continue to receive the allowance for the period of leave; or
(b) does not resume in the office immediately on return from leave, the employee shall continue to receive the allowance for the period of leave accrued during the period of higher duties.
44.7 Where an employee who is in receipt of an allowance granted under this clause for less than twelve months proceeds on a period of paid leave, whether in excess of the normal entitlement or not, the employee shall continue to receive the allowance for the period of normal leave provided that:
(a) during the employee’s absence, no other employee acts in the office in which the employee was acting immediately prior to proceeding on leave; and
(b) the employee resumes in the office immediately on return from leave.
44.8 For the purpose of sub-clause 44.7, ‘normal leave’ means the period of paid leave an employee would accrue in twelve months. It shall also include any public holidays and leave in lieu accrued during the preceding twelve months taken in conjunction with such paid leave
44.9 Where a part-time employee acts in a higher office, the allowance shall be payable after the completion of 38 hours service in that position. The 38 hours service in the higher position must be worked on consecutively according to the hours the part-time employee normally works.
44.10 Where the higher office is a part-time position, the allowance shall be payable after the completion of 38 hours service in that dayposition. The 38 hours service in the higher position must be worked consecutively according to the normal working hours of the part-time position for which the allowance is being paid.

Higher Duties Allowance. Acting in a Higher Position Other Than Principal

(i) the higher duties allowance for time worked shall be paid from the date the duties are transferred
(ii) the higher duties allowance may be paid to both permanent and fixed term teachers
(iii) the employer shall identify either the hours assigned to each teacher (as per 3.15 (d) above) or the total hours transferred each term where the duties are not performed on that daya continuous basis

Higher Duties Allowance. (a) 40.1 Higher Duties Allowance is payable to an employee, other than a casual or temporary employee, who is directed to temporarily perform the duties of a position with a higher classification.
40.2 An employee who performing higher duties in a position is appointed subject to perform temporarily all conditions of that position.
40.3 An employee may only be paid in respect of one higher position even if they are performing the duties of 2 (two) higher positions at the same time.
40.4 An employee acting as a RN/RM Level 2 or Level 3 position will be paid Higher Duties Allowance for a period of 1 (one) day or more.
40.5 An employee acting in a RN/RM Level 4 or Level 5 position will be paid Higher Duties Allowance for a period of 5 (five) consecutive days or more. This payment will occur from day 1 (one), provided the total period of higher duties is 5 (five) days or more.
40.6 An employee receiving Higher Duties Allowance is entitled to normal incremental progression for the employee’s substantive position. This increment gained while performing higher duties is maintained upon cessation of the higher duties.
40.7 Previous higher duties service will be considered in determining the appropriate salary point for future periods of higher duties.
40.8 Where the vacancy period of higher duties is expected to exceed 6 (six) months the vacancy will be advertised in the gazette.
40.9 Periods of higher duties should not normally extend beyond 12 (twelve) months. If after 12 (twelve) months the position is nominally vacant it will be advertised unless there are exceptional circumstances.
40.10 If an employee performs the duties of a higher classified position and who performs all such duties required to be performed during position, the appointment will be paid rate of Higher Duties Allowance payable is based upon the lowest salary point for the classification of that position. If, however, the employee has previous service for an allowance equal to increment or the difference between their substantive salary and the minimum salary bottom of the higher classified position for all salary scale is lower than the time during which employee’s standard salary, the rate of Higher Duties Allowance payable is at the next salary point of the classification.
40.11 If an employee is being paid Higher Duties Allowance before going on paid leave and would have continued to receive Higher Duties Allowance if they had not taken leave, then the employee performs such dutiesis entitled to payment of Higher Duties Allowance for the period of leave.
40.12 An employee performing higher duties continually for more than 1 (one) year may be granted an increment. Higher Duties Allowance. 32.1 Higher Duties Allowance (aHDA) An is payable to an employee who is appointed directed to temporarily perform temporarily all of the duties of a position with a higher classified classification.
32.2 An employee acting in a position and who performs all such duties required to be performed during the appointment with a maximum salary of an ASO 6 or equivalent, or less will be paid HDA for a period of one day or more.
32.3 An employee acting in a position with a salary or maximum salary greater than the maximum salary of an allowance equal ASO6 or equivalent will be paid HDA for a period of five consecutive days or more. This payment will occur from day 1, provided the total period of higher duties is five days or more.
32.4 Where the officer on temporary transfer is to perform the full duties of the higher position, HDA is calculated as the difference between their substantive the staff member’s current salary and a point in the minimum salary range of the higher classified position for all determined by the time during which Chief Executive in accordance with Clause 30 Pay Points and Increments.
32.5 Where the employee performs such duties. Where it officer is specified at the commencement of the higher duties allowance that the employee is to undertake performing only part of the duties of the higher position onlyand the higher position is at least two levels above the officer’s current substantive level, a lesser amountpayment of partial HDA may be agreed between the supervisor/manager and the officer, which prior to the commencement of the temporary transfer.
32.6 The rate of payment for partial HDA will normally be a percentage point in the salary range(s) of the full amount, intervening level(s). The Chief Executive’s decision on the rate of payment of partial HDA will be paid.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless take into account the employee performs specified part of the duties of the higher classified position for a period in excess of one
(1) week or in excess of two (2) consecutive working days for trades staffthat the officer is to perform.
(c) No allowance 32.7 An employee receiving HDA is entitled to normal incremental progression and any increment gained while performing HDA is maintained upon the employee ceasing the higher duties.
32.8 Previous HDA service will be payable pursuant considered in determining the appropriate salary point for future periods of higher duties.
32.9 Where the vacancy period of Higher Duties Allowance is expected to subclause 12.1(a) to an employee whose exceed six months the vacancy will be advertised within the ACTPS.
32.10 Periods of higher duties should not normally extend beyond twelve months. If after twelve months the position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks.
(d) An employee who has been in receipt of a higher duties allowance for more than one (1) month nominally vacant it will be paid such allowance for all paid leave taken during that periodadvertised unless there are exceptional circumstances.
(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.
(f) Where an employee in receipt of a higher duties allowance works on a public holiday, the relevant shift loading or overtime rate will be applied to the higher duties allowance for time worked on that day.

(d) An employee who has been does not perform the full duties and/or does not accept the full responsibilities of the higher position shall be paid such proportion of the allowance specified in receipt of a higher duties allowance for more than one subclause (1) month (c) of this clause as the duties and responsibilities bear to the full duties and responsibilities of the higher position. The Employer will advise the employee of the proportion of duties to be paid such allowance for all paid leave taken during that periodundertaken before the employee commences duties in the higher classified position.
(e) An employee who has been relieving continuously Where the cumulative period of acting in a position for or positions of a period in excess of higher level exceeds 12 months who retiresin any 18 month period, resigns or the employee’s allowance will include the relevant service increments for the position in which the employee is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employmentacting.
(f) Where If an employee undertakes higher duties for a continuous period of 12 months or more, the employee shall be entitled to be paid at the higher duties rate when taking the annual leave accrued during that period, provided the employee:
(i) continues to be employed on that higher duties rate, or
(ii) takes that annual leave entitlement within 12 months of the entitlement being accrued.
(g) Each period of acting on higher duties, whether paid or not, will be recorded in receipt the employee’s personnel records and be recognised as experience.
(h) An employee required to temporarily undertake, for the whole of a higher duties allowance works on a public holidayshift, the relevant shift loading or overtime rate full duties of a position classified at Senior Registered Nurse Level 1 to 4, will be applied to receive the appropriate higher duties allowance for time worked that shift.
(i) An employee will not be paid higher duties when acting in another position whilst the permanent employee is on that daya single accrued day off as prescribed by Clause 25 – Hours of Work and Rostering of this Agreement.

Higher Duties Allowance. XXXX recognises the need to provide a Higher Duties Allowance for members of staff who are requested to perform the duties of certain key positions when the incumbents of those positions are absent from ACER for at least ten consecutive working days and not more than twelve months. The payment of a Higher Duties Allowance is at the discretion of the Divisional Head. Should the Higher Duties Allowance be approved, the staff member will be advised whether full or partial responsibilities of the higher position are to be performed, and the amount and anticipated duration of the Higher Duties Allowance. If the organisation’s requirement for the performance of work at a higher level is for one year or more, then the CEO will offer a Notice of Variation to Appointment at an appropriate salary level for the duration of the period of work at the higher level:

(e) An employee Employee who has been relieving continuously performs the duties of a higher classification and is in receipt of a position for a period in excess salary above the minimum salary payable to the holder of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate classification, will, upon commencing to perform the duties of pay on termination of employmentthe higher classification, be paid such allowance as will cause total remuneration to be the same as that which would have been payable if the Employee had been promoted to the higher classification.
(f) Where An Employee who temporarily performs the duties of a classification, the conditions of service of which differ from those of the classification normally held by the Employee, will be subject to the first-mentioned conditions as though the Employee were the permanent holder of the classification.
(g) An Employee temporarily performing the duties of a higher classification who does not perform all of the duties of that classification, may be paid in respect of the performance of those duties an employee allowance of such amount, and subject to such conditions, as the Commissioner approves.
(h) An allowance granted under this clause will be regarded as salary for the purposes of calculating travelling and meal allowances and payment for extra duty service and excess travelling time.
(i) An Employee who at the time of proceeding on approved leave with pay (including public holidays), was in receipt of an allowance determined in accordance with this clause, will continue to be paid such an allowance to the extent that the CEO certifies that allowance would have been paid but for the grant of the leave.
(j) An Employee who, at the time of proceeding on approved leave with pay, was an Employee who:
(i) in accordance with the duty roster, regularly performed the duties of an Employee with a higher duties classification than the classification of the first- mentioned Employee during the rostered days off of the second- mentioned Employee; and
(ii) is an Employee whose CEO certifies that, but for proceeding on the paid leave, would have been entitled to be paid an allowance works for temporarily performing those duties; will be paid, in respect of such leave the allowance that would have been paid had the Employee not been proceeding on leave.
(k) Where leave taken by an Employee entitled under paragraphs (i) or (j) to an allowance is less than leave on full pay, payment of the allowance will be made on a public holiday, pro rata basis.
(l) Where temporary promotion allowance payments are included in leave with pay in accordance with paragraph (i) the relevant shift loading or overtime rate leave periods in respect of which the payments are included will be applied to service holding a relevant higher classification for the higher duties allowance for time worked on that daypurposes of the granting of increments in accordance with this clause.

Higher Duties Allowance. Acting in a Higher Position Other Than Principal
(a) An A higher duties allowance shall be paid to an employee who is appointed to perform temporarily all of the duties of acts up for more than eight consecutive working days in a position with a higher classified position and who performs all such duties required to be performed during the appointment will be paid an allowance equal to the difference between their substantive salary and the minimum salary of the higher classified position for all the time during which the employee performs such duties. (f) Where The ‘rate for the position’ is the salary the employee acting up would receive should they be permanently appointed to the position but not less than the rate for their current position.
(g) When as a consequence of an employee in receipt appointment to the Kāhui Akoleadership role the employer reallocates duties of a teacher(s) acting in a higher duties allowance works on position to a public holiday, the relevant shift loading teacher or overtime rate will be applied to teachers then:
(i) the higher duties allowance for time worked shall be paid from the date the duties are transferred
(ii) the higher duties allowance may be paid to both permanent and fixed term teachers
(iii) the employer shall identify either the hours assigned to each teacher (as per 3.13 (d) above) or the total hours transferred each term where the duties are not performed on that daya continuous basis
(iv) the rate of the higher duties allowance will be calculated in accordance with 3.13 (b) and 3.13 (f) above.

Where it is specified at the commencement of the higher duties allowance that the employee is to undertake part of the full duties of the a higher position only, a lesser amount, which will normally be a percentage of the full amount, will be paid.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one
(1) week or in excess of office are temporarily performed by two (2) or more employees they shall each be paid an allowance as determined by the employer.
44.3 An employee who is directed to act in a higher classified office but who is not required to carry out the full duties of the position and/or accept the full responsibilities, shall be paid such proportion of the allowance provided for in subclause 44.1 of this clause as the duties and responsibilities performed bear to the full duties and responsibilities of the higher office. Provided that the employee shall be informed, prior to the commencement of acting in the higher classified office, of the duties to be carried out, the responsibilities to be accepted and the allowance to be paid. The allowance paid may be adjusted during the period of higher duties.
44.4 Where an employee who has qualified for payment of higher duties allowance under this clause is required to act in another office or other offices classified higher than the employee’s own for periods less than five consecutive working days for trades staff.
(c) No allowance will without any break in acting service, such employee shall be payable pursuant to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks.
(d) An employee who has been in receipt of paid a higher duties allowance for more than one (1) month will such periods: provided that payment shall be made at the highest rate the employee has been paid such allowance for all paid leave taken during that periodthe term of continuous acting or at the rate applicable to the office in which the employee is currently acting - whichever is the lesser.
(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.
(f) 44.5 Where an employee is directed to act in receipt an office which has an incremental range of a higher duties allowance works on a public holiday, the relevant shift loading or overtime rate will salaries such an employee shall be applied entitled to receive an increase in the higher duties allowance equivalent to the annual increment the employee would have received had the employee been permanently appointed to such office; provided that acting service with allowances for acting in offices for the same classification or higher than the office during the eighteen (18) months preceding the commencement of such acting shall aggregate as qualifying service towards such an increase in the allowance.
44.6 Where an employee who is in receipt of an allowance granted under this clause and has been doing so for a continuous period of twelve months or more, proceeds on any period of paid leave and:
(a) resumes in the office immediately on return from leave, the employee shall continue to receive the allowance for the period of leave; or
(b) does not resume in the office immediately on return from leave, the employee shall continue to receive the allowance for the period of leave accrued during the period of higher duties.
44.7 Where an employee who is in receipt of an allowance granted under this clause for less than twelve months proceeds on a period of paid leave, whether in excess of the normal entitlement or not, the employee shall continue to receive the allowance for the period of normal leave provided that:
(a) during the employee’s absence, no other employee acts in the office in which the employee was acting immediately prior to proceeding on leave; and
(b) the employee resumes in the office immediately on return from leave.
44.8 For the purpose of subclause 44.7, ‘normal leave’ means the period of paid leave an employee would accrue in twelve months. It shall also include any public holidays and leave in lieu accrued during the preceding twelve months taken in conjunction with such paid leave. Part-time Higher Duties Allowance Arrangements
44.9 Where a part-time employee acts in a higher office, the allowance shall be payable after the completion of 38 hours service in that position. The 38 hours service in the higher position must be worked on consecutively according to the hours the part-time employee normally works.
44.10 Where the higher office is a part-time position, the allowance shall be payable after the completion of 38 hours service in that dayposition. The 38 hours service in the higher position must be worked consecutively according to the normal working hours of the part-time position for which the allowance is being paid.

(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one
(1) week or in excess of office are temporarily performed by two (2) or more Employees they shall each be paid an allowance as determined by Main Roads.
53.3 An Employee who is directed to act in a higher classified office but who is not required to carry out the full duties of the position and/or accept the full responsibilities, shall be paid such proportion of the allowance provided for in subclause 53.1 as the duties and responsibilities performed bear to the full duties and responsibilities of the higher office. Provided that the Employee shall be informed, prior to the commencement of acting in the higher classified office, of the duties to be carried out, the responsibilities to be accepted and the allowance to be paid. The allowance paid may be adjusted during the period of higher duties.

(d) An employee who has been in receipt of paid a higher duties allowance for more than one (1) month will such periods: provided that payment shall be made at the highest rate the Employee has been paid such allowance for all paid leave taken during that periodthe term of continuous acting or at the rate applicable to the office in which the Employee is currently acting - whichever is the lesser.
(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.
(f) 53.5 Where an employee Employee is directed to act in receipt an office which has an incremental range of a higher duties allowance works on a public holiday, the relevant shift loading or overtime rate will salaries such an Employee shall be applied entitled to receive an increase in the higher duties allowance equivalent to the annual increment the Employee would have received had the Employee been permanently appointed to such office; provided that acting service with allowances for acting in offices for the same classification or higher than the office during the eighteen (18) months preceding the commencement of such acting shall aggregate as qualifying service towards such an increase in the allowance. 53.6 Where an Employee who is in receipt of an allowance granted under this clause and has been so for a continuous period of twelve months or more, proceeds on any period of paid leave and:
(a) resumes in the office immediately on return from leave, the Employee shall continue to receive the allowance for the period of leave; or
(b) does not resume in the office immediately on return from leave, the Employee shall continue to receive the allowance for the period of leave accrued during the period of higher duties.
53.7 Where an Employee who is in receipt of an allowance granted under this clause and has been so for less than twelve months, proceeds on a period of paid leave, whether in excess of the normal entitlement or not, the Employee shall continue to receive the allowance for the period of normal leave provided that:
(a) During the Employee’s absence, no other Employee acts in the office in which the Employee was acting immediately prior to proceeding on leave; and
(b) The Employee resumes in the office immediately on return from leave.
53.8 For the purpose of 53.7 the expression ‘normal leave’ means the period of paid leave an Employee would accrue in twelve months. It shall also include any public holidays and leave in lieu accrued during the preceding twelve months taken in conjunction with such paid leave. Part Time Higher Duties Allowance Arrangement
53.9 Where a Part-time Employee acts in a higher office, the allowance shall be payable after the completion of 37.5 hours of service in that position. The 37.5 hours service in the higher position must be worked on consecutively according to the hours the Part-time Employee normally works.
53.10 Where the higher office is a part time position, the allowance shall be payable after the completion of 37.5 hours service in that dayposition. The 37.5 hours service in the higher position must be worked consecutively according to the normal working hours of the part time position for which the allowance is being paid.

Higher Duties Allowance. (a1) Higher duties is a temporary measure which can be used to cover staff on leave or who are otherwise absent from duties or while recruitment action is taking place. Higher duties provides a career development opportunity for staff, in accordance with Clause 41 – Career Planning and Development.
(2) An employee who is temporarily appointed to perform temporarily all of and satisfactorily performs the duties of a higher classified position and who performs all such duties required to be performed during for:
(a) at least 5 consecutive working days; or
(b) at least 5 separate days within a two month period when the basis of the appointment does not involve consecutive working days but is regular (for example one day per week each week) is a “relieving employee” and, will be paid an a higher duties allowance equal to for the time they perform the duties.
(3) A higher duties allowance is the difference between their substantive the relieving employee’s salary and the minimum salary of the higher classified position for all the time during which the employee performs such duties. Where it is specified at the commencement position.

(d) An employee who has been in receipt of a higher duties allowance for more than one (1) month a period in excess of 20 working days will be paid such allowance for all leave accrued in the period of higher duties work, if the allowance would have been paid but for the granting of the leave. Such leave taken during that periodshall count as service for incremental purposes. For HDA’s less than 20 working days, the HDA allowance will only be paid for actual time worked in the relieving position.
(e7) A higher duties allowance will be varied during the period of higher duties to take into account any changes in:
(a) salary for the higher classified position.
(b) the proportion of duties associated with the higher position.
(8) If the University expects a position to be vacant for an indefinite period, it will be internally advertised in the first instance and filled through competitive selection.
(9) An employee who has been relieving continuously relieved for one year or more in the same higher classified position is eligible for incremental progression in the position and for payment of the higher duties allowance on any leave taken during the further period of relief.
(10) Where an employee relieves in a higher grade position for a period in excess of 12 months who retiresor more, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employmentgrade duties allowance will be superannuable, in agreement with the employee unless the employee expressly declines this benefit.
(f11) In circumstances where a period of higher duties extends beyond the original time envisaged, the Supervisor will take action either to have the position reviewed by Human Resources, begin recruitment action or to provide Human Resources and the relieving employee with reasons for continuing Higher Duties. The relieving employee will also be advised of any revised end date for the performance of higher duties.
(12) Where an employee performing higher duties is permanently appointed to that position, they shall be treated for incremental progression purposes as having been the permanent occupant of that position during the entire period of higher duties.
(13) If an employee who has been relieving in receipt a higher position/positions is permanently appointed to a different position at the same or higher HEW level, then the employee’s periods in relieving in the higher position or positions may be aggregated and taken into account for the purpose of incremental progression within that classification level or that of a higher duties allowance works on a public holiday, the relevant shift loading or overtime rate will be applied to the higher duties allowance for time worked on that daybroadbanded position.

(6) If an employee undertakes higher duties for a continuous period of 12 months or more, the employee shall be paid.entitled to be paid at the higher duties rate when taking the annual leave accrued during that period, provided the employee:
(a) continues to be employed on that higher duties rate, or
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties takes that annual leave entitlement within 12 months of the higher classified position for a period in excess of one
(1) week or in excess of two (2) consecutive working days for trades staffentitlement being accrued.
(c7) No allowance Each period of acting on higher duties, whether paid or not, will be payable pursuant to subclause 12.1(a) to an employee whose position is designated recorded in the employee’s personnel records and be recognised as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeksexperience.
(d8) Notwithstanding subclause (1), an Employee required to temporarily undertake, for the whole of a shift, the full duties of a position classified at Senior Registered Nurse Level 1 to 4, will receive the appropriate higher duties allowance for that shift.
(9) Shift Co-ordination Allowance An employee who has been Employee classified at Level 1 who, in receipt the absence of a higher classified employee, is directed to act as a designated Shift Co-ordinator for the whole of a shift shall be paid a higher duties allowance for more than one (1) month will be paid such allowance for all paid leave taken during that period.
(e) An employee who has been relieving continuously in a position for a period in excess of 12 months who retires, resigns or is retrenched by the University will receive payment for accrued leave entitlements at the higher rate of pay on termination of employment.

Higher Duties Allowance. (1) week or in excess of office are temporarily performed by two (2) or more employees they shall each be paid an allowance as determined by the employer.
45.3 An employee who is directed to act in a higher classified office but who is not required to carry out the full duties of the position and/or accept the full responsibilities, shall be paid such proportion of the allowance provided for in sub-clause 45.1 of this clause as the duties and responsibilities performed bear to the full duties and responsibilities of the higher office. Provided that the employee shall be informed, prior to the commencement of acting in the higher classified office, of the duties to be carried out, the responsibilities to be accepted and the allowance to be paid. The allowance paid may be adjusted during the period of higher duties.
45.4 Where an employee who has qualified for payment of higher duties allowance under this clause is required to act in another office or other offices classified higher than the employee’s own for periods less than five consecutive working days for trades staff.

Higher Duties Allowance. (a) PROFESSIONAL STAFF
38.1 An employee who is appointed required to perform temporarily all act in a position of higher classification for thirty per cent or more of the responsibilities and for a continuous period of two weeks or more (including public holidays) shall receive a higher duties allowance for the period of the higher duties based on the difference between the salary of the employee and the salary payable for the higher classification.

Higher Duties Allowance. (a) 42.1 An employee who performs the duties of a higher classification which has a maximum attainable annual salary:
a) not higher than the maximum attainable annual salary payable to an Administrative Officer 6 , will be paid an allowance for performing the duties of the higher classification upon the completion of one day; or
b) higher than the maximum attainable annual salary payable to an Administrative Officer 6, will be paid an allowance for performing the duties of the higher classification upon the completion of six days. Note: The salary level for an Administrative Officer 6 can be found in Schedule 11 of the Northern Territory Public Sector 2021—2025 Enterprise Agreement; as at 10 August 2017 it was $103,538.
42.2 For the purpose of this clause:
a) Higher duties is appointed to perform temporarily all defined as temporary performance of the duties of a higher classified position and who performs all such designation above the substantive designation occupied.
b) Higher duties required to be performed during the appointment will be paid an allowance equal to means the difference between their the actual salary paid with respect to the substantive salary designation and the minimum salary of the higher classified position for all the time during point at which the employee would be paid were they to hold the higher duty designation as their substantive designation.
c) Substantive designation means the designation to which an employee has been appointed, permanently transferred or permanently promoted.
d) An employee may be directed to perform higher duties for which duties the employee shall be paid a higher duties allowance in accordance with clause 42.
42.3 Other conditions
a) An employee temporarily performing the duties of a designation, the conditions of service of which differ from those of the designation normally held by the employee, shall be subject to the conditions of service of that designation as though the permanent holder of that designation.
b) An employee who temporarily performs such duties. the duties of a designation which mandates criteria for advancement must meet that criteria before an allowance may be paid.
42.4 Partial payment of allowance Where it is specified at an employee performing higher duties does not perform all the commencement of duties applicable to that designation the CEO shall determine the higher duties allowance that the employee is to undertake part of the duties of the higher position onlypayable, a lesser amount, which will normally be calculated as a percentage of the full amountduties performed, will be paidand subject to such conditions as the CEO approves.
(b) No allowance will be payable pursuant to subclause 12.1(a) unless the employee performs the duties of the higher classified position for a period in excess of one
(1) week or in excess of two (2) consecutive working days for trades staff.
(c) No allowance will be payable pursuant to subclause 12.1(a) to an employee whose position is designated as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while the senior employee is absent on duty or for periods of leave for up to four (4) weeks.

Higher Duties Allowance. (f) Where an employee in receipt of a higher duties allowance works on a public holidaythis Agreement, the relevant shift loading or overtime rate will be applied to the higher duties allowance payable shall be the difference between the current salary of the employee acting in the higher position and the minimum salary the employee would receive if appointed to that position provided that any increase shall not exceed a maximum of three salary steps.
38.4 When an employee performs the duties of a higher position that is not covered by the application clause of this Agreement, such as a management position, the higher duties allowance payable shall be an hourly rate of $5-$10 per hour, such rate to be agreed between the manager and the employee after taking into account the length of the appointment and the extent of the duties and responsibilities.
38.5 Applicable to Waikato/Bay of Plenty only: Absences (by a House Leader or Service Coordinator) of less than five consecutive working days will not usually necessitate a replacement staff member on higher duties. However, should the Manager decide that a replacement is required, higher duties allowance will be paid for time worked those days on that daywhich the staff member has undertaken the duties of the higher position.
38.6 The period for which higher duties allowance is approved is not to exceed 13 months. Where this period is likely to be or is in fact exceeded, the case is to be referred to the General Manager.

(c) No allowance will be payable pursuant to subclause 12.1(a) to 31.5 Where an employee whose position is designated directed to act in an office which has an incremental range of salaries such employee shall be entitled to receive an increase in higher duties allowance equivalent to the annual increment the employee would have received had the employee been permanently appointed to such office; provided that acting service with allowance for acting in offices for the same classification or higher than the office during the eighteen months preceding the commencement of so acting shall aggregate as a “deputy” or equivalent of a more senior employee, whose normal duties as specified by their job description include deputising for that more senior employee and who is deputising while qualifying service towards such an increase in the senior employee is absent on duty or for periods of leave for up to four (4) weeksallowance.
(d) An 31.6 Where an employee who has been qualified for payment of higher duties allowance under this clause is required to act in receipt of a another office or other offices classified higher than the employee’s own for periods less than five (5) working days without any break in acting service, such employee shall be paid higher duties allowance for more than one such periods; provided the payment shall be made at the highest rate of the employee has been paid during the term of continuous acting or at the rate applicable to the office in which the employee is currently acting – whichever is the lesser.
31.7 Where an employee who is in receipt of an allowance granted under this clause, and has been doing so for a continuous period of twelve months or more, proceeds on any period of paid leave and:

(e) An 31.8 Where an employee who has been relieving continuously is in a position receipt of an allowance granted under this clause for less than twelve months proceeds on a period of paid leave, whether in excess of 12 the normal entitlement or not, the employee shall continue to receive the allowance for the period of normal leave provided that:
(a) during the employee’s absence, no other employee acts in the office in which the employee was acting immediately prior to proceeding on leave; and
(b) the employee resumes in the office immediately on return from leave.
31.9 For the purpose of subclause 31.8, ‘normal leave’ means the period of paid leave an employee would accrue in twelve months. It shall also include any public holidays and leave in lieu accrued during the preceding twelve months who retirestaken in conjunction with such paid leave.
31.10 Where a part time employee acts in a higher office, resigns or is retrenched by the University will receive payment for accrued leave entitlements at allowance shall be payable after the completion of 37.5 hours service in that position. The 37.5 hours service in the higher rate of pay on termination of employmentposition must be worked consecutively according to the hours the part time employee normally works.
(f) 31.11 Where an employee in receipt of the higher office is a higher duties allowance works on a public holidaypart time position, the relevant shift loading or overtime rate will allowance shall be applied payable after the completion of 37.5 hours service in that position. The 37.5 hours service in the higher position must be worked consecutively according to the higher duties normal working hours of the part time position for which the allowance for time worked on that dayis being paid.

Higher Duties Allowance. XXXX recognises the need to provide a Higher Duties Allowance for employees who are requested to perform the duties of certain key positions when the incumbents of those positions are absent from ACER for at least ten consecutive working days and not more than twelve months. Higher duties can also be applied temporarily in instances where ACER needs to fill a vacancy of an existing position. The payment of a Higher Duties Allowance is at the discretion of the Head of Division. Should the Higher Duties Allowance be approved, the employee will be advised whether full or partial responsibilities of the higher position are to be performed, and the amount and anticipated duration of the Higher Duties Allowance. If the organisation’s requirement for the performance of work at a higher level is for one year or more, then the CEO will offer a Notice of Variation to Contract at an appropriate salary level for the duration of the period of work at the higher level:

Higher Duties Allowance. (a) 6.1. An employee who is appointed required to perform temporarily all act in a position of higher classification than that which the employee occupies shall be paid an allowance computed in accordance with this clause.
6.2. An employee shall be eligible for payment of a higher duties allowance where the period of acting service in the higher position is continuous for a period of at least two consecutive working weeks.
6.3. For the purpose of this clause, a holiday shall count as part of the qualifying period.
6.4. Higher duties allowance shall be payable from the date the employee commenced the higher duties.
6.5. Where an employee performs the full duties of a higher classified position and who performs all such duties required to be performed during office the appointment will employee shall be paid an allowance equal to the difference between their substantive salary and the minimum salary of the employee and the salary payable had the employee been promoted to the higher classified office.
