Historically Underutilized Businesses (HUBs. If Contractor was not required to submit a HUB subcontracting plan and if subcontracting is permitted under this Contract, Contractor is encouraged to make a good faith effort to consider subcontracting with HUBs in accordance with Texas Government Code Chapter 2161 and 34 TAC § 20.14 et seq. Contractors may obtain a list of HUBs at xxxx://xxx.xxxxxx.xxxxx.xx.xx/procurement/prog/hub. If Contractor has filed a HUB subcontracting plan, the plan is incorporated by reference in this Contract. If Contractor desires to make a change in the plan, Contractor must obtain prior approval of the revised plan from the Department’s HUB Coordinator before proposed changes shall be effective under this Contract. Contractor shall make a good faith effort to subcontract with HUBs during the performance of this Contract and shall report HUB subcontract activity to the Department’s HUB Coordinator by the 15th day of each month for the prior month’s activity, if there was any such activity in accordance with 34 TAC § 20.16(c).

Historically Underutilized Businesses (HUBs. In accordance with state law, it is TFC’s policy to assist HUBs, whenever possible, to participate in providing goods and services to the agency. TFC encourages those parties with whom it contracts for the provision of goods and services to adhere to this same philosophy in selecting Subcontractors to assist in fulfilling CMR’s obligations with TFC. If CMR subcontracts with others for some or all of the services to be performed under this Contract, CMR shall comply with all HUB requirements pursuant to Chapter 2161 of the Texas Government Code. A digital copy of the Approved HUB Subcontracting Plan (“HSP”) is attached hereto as Exhibit H and incorporated herein for all purposes. When required, CMR shall submit an updated HSP. Upon TFC approval of HSP update(s), such update(s) shall become, without further notice or action, a part of the incorporated Exhibit H. A copy of the HSP form is attached hereto as Exhibit I and incorporated herein for all purposes. Upon execution of a GMP Amendment Acceptance, an updated HSP must be approved. CMR shall provide the HUB program of TFC with pertinent details of any participation by a HUB in fulfilling the duties and obligations arising hereunder on the HSP Progress Assessment Reporting (“PAR”) Form, a copy of the form for which is attached hereto as Exhibit J and incorporated herein for all purposes.

ALL EMPLOYERS MUST PROVIDE EVIDENCE OF COMPLIANCE WITH THE INSURANCE REQUIREMENTS OF THE TEXAS WORKERS’ COMPENSATION ACT. Generally, an employer with one or more employees carries workers’ compensation insurance to cover those employees or elects coverage through self-insurance as permitted by Texas Labor Code, Section 406.003. Sole proprietorships who wish to perform freight services pursuant to Texas Facilities Commission’s Freight Transportation Service Provider Agreement that do not carry workers’ compensation insurance must comply, agree, and attest to the following: A signed statement (see below) that the business is a sole proprietorship as defined by the Texas Workers’ Compensation Act. I am the owner of a sole proprietorship, doing business as, and am the sole employee of this business entity. I, as an individual employer, have not elected to be covered under the Texas Workers’ Compensation Act. I, and the sole proprietorship that I represent, waive all rights to sue the Texas Facilities Commission or its officers, employees, or commissioners or the State of Texas for injuries not caused by its negligence. I, and the sole proprietorship that I represent, am covered by medical insurance that will be used to cover any injuries obtained in providing freight services to Texas Facilities Commission (TFC). I, and the sole proprietorship that I represent, release liability of the Texas Facilities Commission or its officers, employees, or commissioners or the State of Texas for any injuries to myself in the course of performing work in conjunction with providing freight services to TFC.

Historically Underutilized Businesses (HUBs. As may be required, PSP will proactively comply with TFC’s established policies regarding the utilization of HUB and all other applicable administrative rules and statutes relating to utilization of HUB’s by TFC for the Project, including (i) TFC’s HUB program, and (ii) the HUB Compliance Reporting System as described in Section 10.04, below. A copy of the approved HSP, if any, is attached hereto as Exhibit B and incorporated herein for all purposes. When required, PSP shall submit an updated HSP. A copy of the HSP Form is attached hereto as Exhibit C and incorporated herein for all purposes. Upon TFC approval of HSP update(s), such update(s) shall become, without further notice or action, a part of the incorporated Exhibit B. PSP shall provide the HUB program of TFC with pertinent details of any participation by a HUB in fulfilling the duties and obligations arising hereunder on the PARs form, a copy of which is attached hereto as Exhibit D and incorporated herein for all purposes. No changes to the HSP can be made by the PSP without the written approval of TFC.
Historically Underutilized Businesses (HUBs. Contractor shall make a good faith effort to locate and consider HUBs, as defined in Texas Gov’t Code §2161.001(2) and Title 34 TAC §20.12, when subcontracting any portion of this Contract, in accordance with Contractor’s DSHS-approved HUB Subcontracting Plan. Contractor shall report HUB subcontract activity to the Department’s HUB Coordinator in accordance with Title 34 TAC §20.16(c), which requires Contractor to report the identity and amount paid to each HUB subcontractor for payments made by Contractor to the HUB subcontractor in the previous month.

A/E shall provide TFC with pertinent details of any participation by a HUB in fulfilling the duties and obligations arising hereunder on the HUB Subcontracting Plan Progress Assessment Report (PAR). PARs shall be submitted monthly with each invoice and are a condition of payment.
Historically Underutilized Businesses (HUBs. In accordance with state and federal laws, CBBEP is required to assist HUBs, whether minority or women-owned, to participate whenever possible in providing goods and services. CBBEP encourages those parties with whom it contracts to adhere to this same requirement. PERFORMING PARTY shall complete and return the CBBEP Contractor Participation Reporting Form with each payment request submittal as determined in this Contract (see Contract Cost Budget, Item C). CBBEP guidelines are available upon request.
