HOLIDAY PROVISIONS. The School District reserves the right, if school is in session, to cancel any of the above holidays and establish another holiday in lieu thereof. Any legal holiday or holidays which fall on an employee’s vacation period shall not be counted as a vacation day. In order to be eligible for holiday pay, an employee must have worked his/her regular workday before and after the holiday, unless the employee is on an excused illness, leave, or on vacation under terms of this Agreement. The one-half day holidays indicated above shall be taken on the last one-half working day before the eligible day off for New Year’s and Christmas, except when school is in session on the day before the holiday. The employee will be able to take that one-half day as soon as convenient after the holiday. Food service The actual days to be observed as holidays pursuant to this provision, shall be mutually agreed upon by the parties during March of each year, and posted on a holiday calendar. Full-time employees will have Labor Day as a holiday if they have worked at least be paid the equivalent of their regular scheduled work day on the scheduled date of the holiday(s). Regular scheduled work day shall be interpreted to mean the employees regular scheduled work day(s) of the semester in which the holiday(s) falls. If the scheduled holiday(s) falls on the employees’ day off, one (1) work paid day prior to Labor Day of comparable time will be given during the preceding week or during the week in which the current fiscal yearholiday(s) falls. Eligible employees shall receive one (1) day's pay for each regular scheduled work days of the holidays listed above based on their normal work schedulepreceding semester. To be eligible for the holiday pay, the an employee must report for work both the regular last scheduled work day immediately preceding before the holiday and the regular first scheduled work day after following the holiday; except during Christmas/New Years break period. For payroll purposes, unless he/she is on vacation, leave with pay, or is otherwise excused by his/her administrative supervisor. If a day for which an employee terminates his/her employment, all benefits of said employment is paid shall cease on the date of termination. Eligible employees who work on a holiday shall be paid, in addition to their regular pay, an amount equal to the product of the hours worked and a time-and-one-half rate. When a holiday is observed by the Employer within an Employee's scheduled vacation, the holiday will not be considered as a vacation day and worked, under the vacation provisions of this section. Holiday pay for full-time employees will be extended one result in eight (18) hours of pay, with the exception of employees who are scheduled to work a four (4) day continuous with ten (10) hour shift during the vacationweek of the holiday. In such case, the employee working the four (4) day ten (10) hour shift shall be entitled to ten (10) hours holiday pay for the holiday. An employee who is called in for emergency overtime on the actual holiday shall be guaranteed 8 hours at straight time or double-time for actual hours worked, whichever is greater. General Laborers will receive holiday pay equivalent to the number of hours they were scheduled to work on the designated holiday.

(E) Regular part-time employees will receive prorated holiday pay (paid on the regular payday for the first full pay period following the end of their anniversary year), such pay to be prorated by multiplying the number of holidays for which they were eligible in their prior anniversary year by the number of hours paid to them (excluding overtime) during such anniversary year and dividing by 260 (but such total hours not to exceed the number of hours for which regular full-time employees would be eligible), and multiplying by their base rate of pay exclusive of overtime or other premiums.

When a holiday is observed by the Employer within an Employee's scheduled vacation, the holiday will not be considered as a vacation day and the vacation will be extended one (1) day continuous with the vacation.
