HOURS OF WORK, OVERTIME AND WORKING CONDITIONS. 16.01 Hours of work shall be scheduled by the Company in accordance with its requirements. 16.02 All overtime and premium pay assignments with the exception of the seasonal work as described in sub-article 27.01 (unless that seasonal work was performed by a seniority employee), which occur in a Department on a Saturday, Sunday, or Paid Holiday, will be assigned to seniority employees who have the ability, willingness and qualifications to satisfactorily perform the jobs to be done, prior to assigning such work to other employees. For the purposes of this article, employees who are regularly employed in production areas doing production work will be given first priority for overtime and premium pay assignments in production areas to do production work which occurs on a Saturday, Sunday or Paid Holidays. 16.03 Any employee who does not desire overtime and premium pay assignments shall not be required to accept such assignments provided the employee has, prior to when the overtime and premium pay assignments occur, filed a request, in writing, with his supervisor to be excused from the overtime and premium pay assignments. However, recognizing that production schedules and other factors may make it impossible to approve every request, it is recognized that the Company may have to limit the number of requests which can be approved. In any week, only ten percent (10%) of the employees on the seniority list, within a classification, shall, on a progressive basis (i.e., first week - first ten percent (10%); second week - second ten percent (10%); etc.) be eligible to make such requests. (b) In the event that overtime is scheduled in advance of a regular shift, such overtime will be assigned to those employees who are scheduled to work in that Department on the same following shift of work. (c) Notwithstanding anything contained in this article or this Agreement, should overtime or a premium pay assignment occur following a shift, it will be assigned to those employees who performed those duties on the shift immediately preceding the overtime or premium pay assignment occurring, prior to assigning such work to other employees and provided that such other employees have the ability, willingness and qualifications to satisfactorily perform the jobs to be done. This overtime will not interfere with or displace those employees who are regularly scheduled to work on the shift on which the overtime or premium pay assignment occurred. 16.09 An employee who wants permission to be absent from work, for a reason that is known to him prior to the commencement of his scheduled shift, must receive permission to be absent from his supervisor prior to the commencement of his scheduled shift. The permission of the supervisor will not be unreasonably refused. 16.10 If an employee is unable to report to work, for any reason, he shall call the attendance line as soon as possible, and, in any event, prior to the commencement of his scheduled shift. The employee shall advise the attendance line why he is unable to report for work and when he expects to report for work. (a) When an employee is absent due to work related injury/illness:

16.04 All overtime and premium pay assignments scheduled by the Company must B. The standard work week for day shift or single shift will be worked by the employee assigned unless the employee has permission from the appropriate Company official to be absent from work.
16.05 All forty (40) hours actually worked by an employee in excess per week consisting of five (5) shifts of eight (8) hours per dayMonday to Friday inclusive.
C. All such hours worked shall be classed as straight time and the eight (8) hour shift shall normally be performed between 8:00 a.m. and 5:00 p.m., but on projects where circumstances make it necessary, they shall be performed during any time of the day or night that may constitute a regular shift on that project. A premium of:
D. One (1) hour in each workday shall be allowed as a meal hour but the time allowed for the said meal hour may be reduced on any job by agreement between employees on the job and the Company or its representative.
E. Employees will be allowed time to gather and put away their working tools and equipment prior to quitting time.
F. The Company may require employees to work overtime in excess of their regularly assigned hours and when overtime is to be worked first consideration will be given to members of Local 728.
G. The first two (2) hours of daily overtime, Monday to through Friday, both inclusive, shall be paid for at the rate of time and one half. All time worked in excess of these hours and one-half (1-1/2) times the employee’s regular straight all time of pay.
16.06 All hours actually worked by an employee on a Saturday or on a and Sunday shall be paid for at the rate of double time.
H. If any employees are recalled to a job without having had eight (8) hours rest, they shall be paid at double time rate of pay until such time as they have had the said eight (8) hours rest.
I. When work cannot proceed on any day due to inclement weather or other emergency beyond the Company’s control, employees will be paid not less than three (3) hours pay, provided that the employee has reported for work and remains on the job for the full three (3) hours. The employees entitled to board expense will receive the regular allowance for the day.
J. When an employee has been notified prior to leaving their place of residence not to report for work, the three (3) hours reporting time in paragraph (I) shall not apply.
K. If on any project work cannot proceed due to shortage of material or other reason within the control of the Company, employees living away from home will either be returned home (i.e.) paid travel expense, travel time & subsistence allowance for travel day out and when requested to return to job site shall be paid same when returning to work) or at the option of the Employer and with the consent of the employees will be paid three (3) hours and subsistence if applicable for the days that the work is delayed.
L. An employee called out for work after they have completed their regular shift and have gone home shall be given not less than four (4) hours work, or if the work is not available, shall be paid for four (4) hours at the applicable overtime rate.
M. An employee who is injured while working for the Company and is sent home because of such injury shall receive pay up to the end of the shift in which they were injured. The Shop Xxxxxxx will be allowed time to gather the injured employee’s personal belongings as soon as possible after the accident and if the case warrants it the Xxxxxxx shall designate someone to accompany the injured employee to the doctor or hospital without loss of time or pay.
N. Employees shall be ready for work at starting time and shall remain at work until quitting time.
O. The Company may call employees out to unload or to do such work as may be necessary to protect property during inclement weather. The employee shall receive not less than three (3) hours pay at the appropriate rate (i.e. straight time or double time) for each time called out.
P. By mutual agreement between the Union and the Employer, a compressed work week of four – ten (10) hour days, at regular straight time rates, may be established Monday through Friday. A compressed work week schedule can be terminated if notice is given on the last day of the current compressed work week.

Accordingly, the amount of room and Sunday overtime and Monday paid holiday overtime. An employee actually working on a Thursday will be entitled to Friday paid holiday overtime as well as that above. Seasonal employees and/or seniority employees who work in the board or “seasonal areasubsistence allowance” will be eligible for weekend overtime per paid as follows:
a) If the provisions outlined above. 14.01 A Hours of work shall be scheduled by the Company in accordance with its requirements. Vacation pay will be considered as time worked. The work week shall be defined as beginning at 12:00am on Sunday, and concluding on Saturday at 11:59pm. Sanitation shifts that start before Friday at 11:00 pm will be considered starting on Friday shift and will be paid at straight time.
16.02 i) Sanitation, or other functions as deemed necessary by the Company, will work scheduled eight and one half (8.5) hour shifts during the work week ( shift is 8.5 hours in length with a 30 minute unpaid lunch).
ii) Production functions, and most maintenance employees will move to a 42 (Forty Two) hour schedule comprised of three twelve (12) hour shifts, and one eight (8) hour shift.
iii) The eight and one half (8.5) hour shift will include a 30 minute unpaid lunch break, and two fifteen (15) minute paid breaks.
iv) The twelve (12) hour shifts will provide for a 45 minute lunch period (30 minutes unpaid, and 15 minutes paid), and two fifteen (15) minute break.
v) Those employees selected for the twelve hour shift schedule will rotate two weeks of days (ie 7:00am – 7:00pm), with two weeks of nights (ie 7:00pm – 7:00am)

If no work is available, he will be paid the equivalent of three (3) hours at his regular straight time hourly rate of pay. As a condition of payment, the employee shall perform any available work which he is capable of performing and which he is requested to perform. This shall not apply in the event of an interruption of scheduled work, because of conditions out of the Company’s control. The Company will, as soon as possible, determine if work cannot be made available and will proceed immediately to notify all the employees affected.

14.06 B All hours actually worked by an employee on scheduled days off shall be paid for at one and one-half (1-1/2) times the employee’s regular straight time rate of pay.
14.07 B In the event that is known to him prior to the commencement of an employee reports for work at his scheduled regular time on his regular shift, must receive permission Monday to Friday, both inclusive, without having been previously advised not to report for work, he will be absent from given three (3) hours of work at his supervisor prior regular straight time hourly rate of pay. If no work is available, he will be paid the equivalent of three (3) hours at his regular straight time hourly rate of pay. As a condition of payment, the employee shall perform any available work which he is capable of performing and which he is requested to perform. This shall not apply in the commencement event of his an interruption of scheduled shiftwork, because of conditions out of the Company’s control. The permission of the supervisor will not be unreasonably refused.
16.10 If an employee is unable to report to workCompany will, for any reason, he shall call the attendance line as soon as possible, and, in any event, prior determine if work cannot be made available and will proceed immediately to notify all the commencement of his scheduled shift. The employee shall advise the attendance line why he is unable to report for work and when he expects to report for workemployees affected.
