Common use of ILLNESS/INJURY LEAVE Clause in Contracts

ILLNESS/INJURY LEAVE. 17.1 Unit members employed on a full-time basis shall be entitled to accumulate ten (10) days per school year of illness/injury leave available to the unit member from the first work day of each year. Illness/injury leave, which is not used, shall accumulate from year to year without limit. Any used but unearned sick leave shall be deducted from final pay warrant upon termination. 17.2 Unit members who work less than full-time shall be entitled to accumulate and use illness/injury leave for all such service at a rate that is in the same proportion as their part-time employment bears to full-time employment. 17.3 In addition to all illness/injury leave entitlement that a unit member may accumulate within the District, he/she shall also be entitled to all unused illness/injury leave which may have been accumulated while employed in a position requiring certification qualifications in another California school district according to the Education Codes. 17.4 The District shall annually provide each teacher with a written statement of his/her accrued sick leave no later than October 15 of each year. 17.5 Unit members may use accumulated illness/injury leave and extended illness leave as set forth in this Article for disabilities caused or contributed to by pregnancy, miscarriage or childbirth and recovery there from. The length of such disability leave, including the date on which the leave is to begin and the date on which the duties are to be resumed, shall be determined by the unit member and her physician or a licensed medical practitioner. 17.6 Certificated employees on extended regular contracts will be granted sick leave in addition to regular sick leave, at the rate of one (1) day per month or partial month(s), as long as the increment is at least one-half (1/2) of the school days. This provision does not apply to extra-curricular assignments and/or summer school. 17.7 Personnel teaching Adult Evening High School in addition to their full-time position within the District shall be allowed to use one-half (1/2) day per semester of their accumulated District injury/illness leave for every semester three hour class taught. Each absence from the Adult School assignment shall be charged at the rate of one- half of a full day of sick leave. 17.8 No salary or sick leave deduction is made for absence due to a verifiable contagious disease contacted during the performance of school duties with other persons having a contagious disease, for the period of isolation or quarantine. Written verification from an attending physician or a certificate from the County Health Department is required.

Unit Members claiming paid sick leave shall notify their Principal by telephone no later than 7:30 AM the day for which leave is claimed. f. The District with good cause may require a doctor's verification that a teacher is fit to return to work. After the fifth consecutive day of absence, teachers may be required to obtain a doctor's verification of illness and a doctor's verification of fitness to return to work. g. Part time certificated employees accrue paid sick leave on a pro rata basis. h. Unit Member shall arrange for transfer of unused, accrued sick leave no later than October 15 from former or to future employing districts. Requests for transfer shall be in writing on forms approved by the State Department of Education. i. Upon receipt of a completed transfer request form, the District shall supply to Unit Member's new Member's new employer with a certified statement listing accumulated sick leave signed by the person who maintains employee attendance records. j. Two (2) additional days of leave of sick leave will be advanced at the start of each school year for each full time teacher who used two or less days of sick leave in preceding school year. Each Unit Member will be advanced twelve days of sick leave plus (if earned) the bonus days from the preceding school year. 17.5 k. A Unit members Member may use accumulated illness/accrued sick leave to care for the illness or injury leave and extended illness leave of a child, spouse, or parent as set forth defined in this Article for disabilities caused the Family Medical Leave Act. A child is defined as biological, adopted or contributed to by pregnancyxxxxxx child, miscarriage or childbirth and recovery there from. Any used but unearned sick leave shall be deducted from final pay warrant upon termination. 17.2 20.2.2 Unit members who work less than full-time shall be entitled to accumulate and use illness/injury leave for all such service at a rate that is in the same proportion proration to the full- time entitlement as their part-time employment bears to full-time employment. 17.3 In 20.2.3 To the extent provided by the law, in addition to all illness/injury leave entitlement that a unit member may accumulate within the District, he/she shall also be entitled to all unused illness/injury leave which may have been accumulated while employed in a position requiring certification qualifications in another California public school district according to the Education Codesdistrict. 17.4 20.2.4 The District shall annually provide each teacher unit member with accounting of illness/injury leave each time such leave is reported. 20.2.5 Upon exhaustion of all accumulated illness/injury leave credit, a written statement of unit member who continues to be absent under the this Article shall receive, for up to one hundred (100) days, the difference between his/her accrued sick leave pay and the amount actually paid substitute or, if no later than October 15 of each yearsubstitute has been employed, the difference between his/her pay and the amount that would have been paid a substitute. 17.5 20.2.6 Unit members may use accumulated illness/injury extended illness leave as set forth in this Article for caused or contributed to by pregnancy/miscarriage and/or recovery therefrom. 20.2.7 Unit members may use accumulated illness/injury leave and extended illness leave as set forth in this Article article for disabilities caused care due to illness or contributed disability of immediate family which shall include, but not limited to by pregnancythe following: mother (stepmother), miscarriage or childbirth and recovery there from. The length mother-in-law, father (stepfather), father-in-law, spouse, son, step-son, daughter (stepdaughter), sibling, grandparent, grandchild of such disability leave, including the date on which the leave is to begin and the date on which the duties are to be resumed, shall be determined by the unit member and her physician or a licensed medical practitioner. 17.6 Certificated employees on extended regular contracts will be granted sick leave spouse, or any person living in addition to regular sick leave, at the rate of one (1) day per month or partial month(s), as long as the increment is at least one-half (1/2) immediate household of the school days. This provision does not apply to extra-curricular assignments and/or summer schoolunit member. 17.7 Personnel teaching Adult Evening High School in addition to their full-time position within the District shall be allowed to use one-half (1/2) day per semester of their accumulated District injury/illness leave for every semester three hour class taught. Each absence from the Adult School assignment shall be charged at the rate of one- half of a full day of sick leave. 17.8 No salary or sick leave deduction is made for absence due to a verifiable contagious disease contacted during the performance of school duties with other persons having a contagious disease, for the period of isolation or quarantine.
