Impact on acoustic climate. Impact of the planned Works Contracts on the acoustic climate is limited in time to the con- struction stage, and it is not significant. Impact on biotic nature Implementation of the planned Works Contracts is associated with the occurrence of impacts on vegetation and on fauna in the area. Those impacts – resulting mainly from the necessary acquisition of land, traffic of vehicles and machines in the construction period, and logging of trees and shrubs – shall be partially reduced due to the planned mitigation measures (along with the currently developed replacement tree planting program for the whole Subcomponent 3A of the OVFMP, referred to in Chapter 6.8), and in total they shall not affect the condition of protected habitats and species adversely in a regional scale. Implementation of the planned Works Contract 3A.2/1 does neither affect Natura 2000 sites nor other protected areas and objects. Implementation of the planned Works Contract 3A.2/2 shall partially be done within the boundaries of Krzyszkowicki Forest ecological use land, but – in accordance with the results of the Environmental Impact Assessment and the provisions of the environ- mental decision – it shall not result in significant adverse impact on the aforementioned pro- tected area.

Impact on acoustic climate. Due to specificity of the Works Contract its acoustic impact shall occur in the implementation phase only, when it would be necessary to apply heavy construction equipment and to deliver construction materials. Those shall be movable as well as fixed noise sources associated with preparation of the site for the construction, loading, delivery, and unloading of raw materials and goods, raising of the embankment, condensation of slopes, development of hydro-insulating membranes, and clearance works associated with site grading and sowing with grass. Exceedance of permissible noise standard may be related to periods of operations of heavy equipment and of truck deliveries in vicinity of noise sources. The greatest impact shall occur at the performance in the direct neighborhood of acoustically protected areas (residential areas). The impact shall however be local and short-term and shall end at the completion of works within the Works Contract area. At the use of the Works Contract there shall be no impact on the acoustic climate, due to the absence of devices and machines, which would be required for operating the Works Contract. Temporarily there may be a short-term impact in a form of noise emitted by operating lawnmowers, which are necessary to mow greenery at the embankment; however, the impact may last for few hours a year only, in total. The impact is integrally associated with the scope of the Works Contract on the implementation stage, and it cannot be eliminated completely. In order to limit the impact of works on the status of acoustic climate during implementation of the Contract one shall implement mitigation measures described in Appendix 1 to the EMP for Contract 3D.2/2 - Plan of mitigation measures, items in the table: 15, 78 - 82.

  • Unbundled Channelization (Multiplexing) 5.7.1 To the extent NewPhone is purchasing DS1 or DS3 or STS-1 Dedicated Transport pursuant to this Agreement, Unbundled Channelization (UC) provides the optional multiplexing capability that will allow a DS1 (1.544 Mbps) or DS3 (44.736 Mbps) or STS-1 (51.84 Mbps) Network Elements to be multiplexed or channelized at a BellSouth central office. Channelization can be accomplished through the use of a multiplexer or a digital cross-connect system at the discretion of BellSouth. Once UC has been installed, NewPhone may request channel activation on a channelized facility and BellSouth shall connect the requested facilities via COCIs. The COCI must be compatible with the lower capacity facility and ordered with the lower capacity facility. This service is available as defined in NECA 4.

  • Events Beyond Our Control If an Event Beyond Our Control occurs and prevents Us from performing any of Our obligations under this Contract to any extent, then We are not required to perform that obligation to the extent and for as long as We are prevented by that Event Beyond Our Control. If such an Event Beyond Our Control occurs and We consider it appropriate to do so, We may notify You of the Event Beyond Our Control by any reasonable means, including by a public announcement.

  • Rating Impact on Student Learning Growth ESE will provide model contract language and guidance on rating educator impact on student learning growth based on state and district-determined measures of student learning. Upon receiving this model contract language and guidance, the parties agree to bargain with respect to this matter.

  • Emergency Closures A. The University’s inability to make a Room available to me for any reason beyond the University’s control including, but not limited to, natural disaster, fire, flood, earthquake, condemnation, pandemic, quarantine, utility malfunction, infestation, or other emergency or force majeure event shall not constitute a breach of this Agreement by the University. In such circumstances, the University shall have no liability to me in any way for injuries, reimbursement, damages, inconvenience, annoyance or compensation of any kind. The University may attempt to find, but cannot guarantee, an alternative space for me. If the unavailability of my Room or an alternative space persists for more than 72 hours, I may terminate this Agreement and Check out during said unavailability without penalty provided that I shall be responsible for all financial obligations incurred up to the date of such termination. The University agrees to provide me with a pro rata refund, calculated from the date of such termination to the end of the Agreement Period, of any prepaid housing and dining payment made to the University, and to return my Deposit pursuant to this Agreement. Upon resumption of standard operations, Agreement Termination requirements and charges will apply as described in Section XIV.

  • Emergency Childcare Employees may use vacation leave for childcare emergencies after the employee has exhausted all of their accrued compensatory time. Use of vacation leave and sick leave for emergency childcare is limited to a combined maximum of four (4) days per calendar year.

  • Under-Frequency and Over Frequency Conditions The New York State Transmission System is designed to automatically activate a load- shed program as required by the NPCC in the event of an under-frequency system disturbance. Developer shall implement under-frequency and over-frequency relay set points for the Large Generating Facility as required by the NPCC to ensure “ride through” capability of the New York State Transmission System. Large Generating Facility response to frequency deviations of predetermined magnitudes, both under-frequency and over-frequency deviations, shall be studied and coordinated with the NYISO and Connecting Transmission Owner in accordance with Good Utility Practice. The term “ride through” as used herein shall mean the ability of a Generating Facility to stay connected to and synchronized with the New York State Transmission System during system disturbances within a range of under-frequency and over-frequency conditions, in accordance with Good Utility Practice and with NPCC Regional Reliability Reference Directory # 12, or its successor.

  • Infection Control Consistent with the Centers for Disease Control and Prevention Guideline for Infection Control in Health Care Personnel, and University Policy 3364-109-EH-603, the parties agree that all bargaining unit employees who come in contact with patients in the hospital or ambulatory care clinics will need to be vaccinated against influenza when flu season begins each fall. The influenza vaccine will be offered to all health care workers, including pregnant women, before the influenza season, unless otherwise medically contraindicated or it compromises sincerely held religious beliefs.

  • Start-Up and Synchronization Consistent with the mutually acceptable procedures of the Developer and Connecting Transmission Owner, the Developer is responsible for the proper synchronization of the Large Generating Facility to the New York State Transmission System in accordance with NYISO and Connecting Transmission Owner procedures and requirements.

  • Emergency/Declared Disaster Requirements In the event of an emergency or if Orange County is declared a disaster area by the County, state or federal government, this Contract may be subjected to unusual usage. The Contractor shall service the County during such an emergency or declared disaster under the same terms and conditions that apply during non-emergency/disaster conditions. The pricing quoted by the Contractor shall apply to serving the County’s needs regardless of the circumstances. If the Contractor is unable to supply the goods/services under the terms of the Contract, then the Contractor shall provide proof of such disruption and a copy of the invoice for the goods/services from the Contractor’s supplier(s). Additional profit margin as a result of supplying goods/services during an emergency or a declared disaster shall not be permitted. In the event of an emergency or declared disaster, emergency purchase order numbers will be assigned. All applicable invoices from the Contractor shall show both the emergency purchase order number and the Contract number.
