Use of the Works. The Chapter may use the Works for internal purposes only except as otherwise agreed to by SCI or SCIF. The Chapter may make copies of the Works for its internal use provided that it reproduces and includes the copyright notice on any copies of the Works. The Chapter may not modify the Works without the prior written consent of SCI or SCIF. The Chapter may not distribute the Works without written authorization from SCI or SCIF. If the Chapter modifies the Works pursuant to consent by SCI or SCIF, all modifications will be owned by SCIF and the Chapter hereby assigns any rights it may have in such modifications to SCIF. The Chapter shall comply with the bylaws of SCI and the guidelines and directives of the Board of SCI as they relate to use of the Works.
Use of the Works before Completion has been certified The Employer uses the parts of the Works before Completion is certified by the Project Manager which constitutes Take over by the Employer. Any (“hand over”) inspections done to allow use of commissioned portions of the Works are done to aid prompt correction of Defects and should not be confused with Take over procedures.
Use of the Works. Except as otherwise agreed in writing, Art Center shall have the right to publish photographs and text regarding the Project, and the Works in connection with publicity and promotion for Art Center.
Use of the Works before Completion has been certified The Contractor will have to carry out the supervision of the installations, as per the instruction of the Project Manager.
Use of the Works. In order to facilitate the educational experience and career opportunities for the Students, Sponsor understands that Art Center permits and encourages the Students to use their Works in portfolios of their works. Therefore, the Parties agree that Project assignments will not call for the material integration of Confidential Information into any works created in connection with the Project, without Sponsor’s consent. Except as otherwise agreed in writing, Art Center shall have the right to publish photographs and text regarding the Class, the Project, and the Works in connection with publicity and promotion for Art Center, and the Students shall continue to have the right to include the Works in their portfolios, notwithstanding any purchase by Sponsor or others of the rights to the Works. Additionally, at any time within 30 days after the final Class meeting, at Sponsor’s request, Art Center will provide Sponsor with available duplicates or photographs of the Works to be used for Sponsor’s internal purposes only, provided that Sponsor shall include attribution credit and legal notices as designated by Art Center.
Use of the Works. (a) Project Co shall confine construction machinery and equipment, storage of Products, and operations of employees to limits indicated by Applicable Law or the Project Agreement and shall not unreasonably encumber the Site with Products.
(b) Project Co shall not load or permit to be loaded any part of the Works with a weight or force that will endanger the safety of the Works.
(c) HMQ, City and UofT shall have the right to enter and occupy the Works in whole or in part for the purpose of placing fittings, furniture and equipment or for other uses, including the intended use of HMQ before Substantial Completion, as provided for in the Works Schedule. Project Co shall cooperate with HMQ and the HMQ Representative, so as to permit HMQ, City and UofT to occupy and to place such fittings, furniture and equipment in the most efficient manner possible. Such entry and occupation shall not be considered an acceptance of the Works or in any way relieve Project Co from responsibility to complete this Project Agreement. Subject to Section 11.21(d), Project Co is responsible to ensure the completion in accordance with the Scheduled Substantial Completion Date and that the Facility is ready for occupancy by City and UofT, in accordance with the Project Agreement. Project Co acknowledges that Substantial Completion is only achieved in respect of the Works as a whole, save and except for the Post Games Works, which shall be completed in accordance with Schedule 32 – Post Games Works.
Use of the Works before Completion has been certified The Employer uses the exhaust stacks to operate the gas turbine to let the stacks go through a full thermal heat cycle in order to prove the assembly before Completion.
