Common use of INCAPACITATED EMPLOYEES Clause in Contracts

INCAPACITATED EMPLOYEES. 28:01 In the event that an employee becomes physically unable to continue working in his/her classification the Company may transfer such employee where a vacancy exists to a job that he/she can satisfactorily perform without the necessity of following the job posting procedure. The parties agree that the seniority provisions herein may be abridged to provide for such transfer upon mutual agreement. The parties acknowledge the Human Rights Code and the duty to accommodate may make necessary transfers of employees and other abridgements of seniority provisions. 28:02 Prior to such a transfer the Company may require the employee to be examined by a physician of its choice so the Company may be satisfied as to the employee’s condition and the work restriction that may apply to the employee. 28:03 Any employee so transferred will have his/her condition reviewed at least twice yearly. 28:04 The Union will be advised of the circumstances of each employee to whom these provisions may apply.
