TIME AND LEAVE. Section 1. This Article contains interpretations relating to time and leave issued by the Commissioner of the Department of Citywide Administrative Services (“DCAS”)1 prior to July 1, 1979, and codified by the University which have been issued by the Office of the Vice Chancellor for Human Resources Management. This Section shall not circumscribe the authority of the University to issue new interpretations subsequent to the effective date of this Agreement and not inconsistent with this Agreement. Such new interpretations shall be subject to the grievance and arbitration provisions of this Agreement.
(a) Employee requests for annual leave, made pursuant to College policy or collective bargaining agreement, shall be made in writing on a form supplied by the College. Approval or disapproval of the request shall be made on the same form by a supervisor authorized to do so by the College. Decisions on request for annual leave or for leave with pay shall be made within seven (7) working days of submission except for requests which cannot be approved at the local level, or requests for leave during the summer peak vacation period or other such periods for which the College or University has established and promulgated a schedule for submission and decision of leave requests. Once a leave request has been approved, the approval may not be rescinded except in writing by the President. If a President calls upon an employee to forego the employee's approved annual leave or any part thereof in any year, it must be in writing and that portion shall be carried over until such time as it can be liquidated. Such action must be taken by a President personally and may not be delegated.
(b) Where an employee has an entitlement to accrued annual leave and/or compensatory time, and the University's fiscal condition requires employees who are terminated, laid off or who choose to retire in lieu of layoff, be removed from the payroll on or before a specific date, the University shall provide the monetary value of accumulated and unused annual leave and/or compensatory time allowances standing to the employee's credit in a lump sum.
(c) The annual leave allowance for full-time employees shall accrue as follows2:

(a) The annual leave allowance accrual for full-time employees shall be at fifteen

All provisions of the Resolution approved by the Board of Estimate on June 5, 1956 on “Leave Regulations for Employees Who Are Under the Career and Salary Plan” (hereinafter “Leave Regulations”) and amendments, and official interpretations relating thereto, in effect on the effective date of this Agreement and amendments which may be required to reflect the provisions of this Agreement shall apply to all employees covered by the Agreement.
b. The annual leave allowance for Employees shall accrue as follows: Employees hired prior to January 1, 2006:

TIME AND LEAVE. This article supplements the relevant provisions of applicable statutes, government-wide regulations and Department Regulations which govern the resolution of all disputes concerning matters covered by this article.

TIME AND LEAVE. Section 1: general
A. Employees will accrue and use sick and annual leave in accordance with applicable laws, government-wide regulations, VA regulations, and this Agreement.
B. All leave charges shall be in increments of one-quarter hour except for employees in E below.
C. Employees should request, in advance, approval of anticipated leave.
D. Leave will only be approved or denied in accordance with 5 CFR Part 630. Leave will not be denied for the purpose of disciplining an employee.
E. The minimum leave charge for full-time physicians, dentists, podiatrists, chiropractors, and optometrists (appointed under 38 USC 7401, 7405 or 7306) is one calendar day and multiples thereof. When a scheduled day’s work extends over portions of two calendar days, leave will be charged for the day on which the greater part of the day’s work falls, or for the first day when the day’s work is equally divided between 2 calendar days. No charge to leave will be made for absence of these employees on administrative non-duty days.
F. No arbitrary or capricious restraints will be established to restrict when leave may be requested.
G. When employees are required to use an electronic time and attendance system to request leave, they will be appropriately trained in the use of such system. If the electronic system is unavailable or not functioning employees will use a SF-71 to request leave.
H. The Department may increase the stated limits applicable to all forms of leave in accordance with applicable government wide regulations and laws.
I. All employees shall be excused or receive appropriate pay for all holidays prescribed by Federal law, and that may be added by Federal law, or that may be designated by Executive Order.
J. If the Department proposes to change the automated time and attendance system, the Department will give notice and bargain in accordance with Article 13: National Consultation Rights and Mid-Term Bargaining.
K. Employees who use their leave in accordance with 5 CFR Part 630 will not be adversely affected in any employment decision solely because of their leave balances.
Section 2: Annual Leave for Title 5, hybrid and Title 38 Employees
A. Annual leave is provided to allow employees extended leave for rest and recreation and to provide periods of time off for personal and emergency purposes. All employees may request annual leave and take such leave subject to the Department’s approval.
