If the Employees are required by the Company to work in the rain, such as in the above circumstance, they will be paid single time in addition to the rate of pay applicable at the time. 6.4.5 In instances where the ambient temperatures reach a level which are outside the normal weather pattern and/or forecast temperatures are such that Employees are likely to be exposed to ”heat hazards”, affected Employees and the Company will meet and consult on the following: • working areas and working pattern for the period so affected; • alternative work areas; • additional rest breaks and cooling down periods in A/C areas; • shading protection and other such methods to ensure practical work continues; and • training and skills improvement alternatives. 6.4.6 It is the agreed position that all alternative avenues are to be explored prior to personnel being authorised to vacate the site. A site-specific procedure is to be developed and agreed in respect of the handling of temperature issues. This will be agreed at Company/Employee/ Safety Committee HSE Representative Level.

Inclement Weather. 6.4.1 The intent of the Parties is for disruption of work on the Project to be minimised during periods of inclement weather, provided it is safe and reasonable for work to continue. In any situation where inclement weather conditions do affects, or are is likely to affect affect, the safe performance of work, the affected Employees and the Company will shall consult on and seek the best method for of completing work safely safely. To be clear all outside work will cease unless the employees and the company agree that it is safe to continue. Inclement weather shall be (but not limited to) the existence of rain or abnormal climatic conditions (whether they be those of hail, lightning, snow, extreme cold, high wind, severe dust storm, extreme high temperature, air quality or the like or any combination thereof) by virtue of which it is either not reasonable or not safe for Employees exposed thereto to continue working whilst the same prevail. If lightning strikes occur within ten kilometres of the worksite, Employees will see if alternate safe remain in the work is availablesheds for thirty minutes from the last lightning strike. HOT WEATHER GUIDELINES 44.1. Under this Agreement, temperature of or above 35°C shall be defined as constituting ‘inclement weather’. 6.4.2 ‘Inclement Weather’ 44.2. When it is expected that the temperature will mean climatic conditions as follows: • rain; • hail; • high winds; and/or • fogbe 35°C or more, or when the temperature approaches 35°C, the Parties on site shall confer regarding the performance of work. 6.4.3 44.3. As part of a process leading to improvements, it is recognised that hot weather procedures including relocation, must be part of a formal OH&S procedures developed, adopted and managed on a project basis having regard to the different conditions that may prevail on projects in various locations. TEMPERATURE MEASUREMENT 44.4. When the temperature reaches 35°C as reported at the closest automatic Bureau of Meteorological Weather Station all outside work will cease and workers may leave the site once critical works are complete. As the temperature approaches this level the supervisor will plan the work, where practical, to avoid lengthy periods of critical work completion. 44.5. Employees who are required to commence work at or after the end of the ordinary day work hours and when the temperature is at or over 35°C may be required to remain on site in air conditioned amenities for a minimum one hour, holding themselves available to commence work should the temperature fall below 35°C AIR QUALITY 44.6. Referencing the EPA guidelines. When the air quality measurement is very poor, employees will go to the sheds for a maximum for two hours. Where the air quality is Hazardous, employees will be sent home. RESTRICTION OF PAYMENT 44.7. An Employee shall not be entitled to payment for Inclement Weather as provided for in this clause unless the Employee remains on the job until the provisions set out in this clause have been observed. 44.8. The intent entitlement to payment for time lost due to Inclement Weather is an entitlement limited to ordinary time lost, and does not apply to overtime, public holidays and/or weekend work. Should overtime or weekend work be suspended due to inclement weather, then overtime payments will cease subject to the provisions of this Agreement concerning minimum payment for Saturdays, Sundays and public holidays in which case the minimum time payments as prescribed by the Agreement shall apply. 44.9. All necessary steps shall be taken to ensure a full working understanding of the Inclement Weather procedure herein standards, as contained in this Agreement, is achieved and maintained by the Company and Employees. 44.10. Should a portion of the Project be affected by Inclement Weather, Employees can be transferred to another work location for similar duties where those duties are available. 44.11. Any dispute in relation to the application of this clause shall be resolved by following the steps outlined in clause 12, Disputes Resolution Procedure. ENTITLEMENT TO PAYMENT – INCLEMENT WEATHER HOURS 44.12. An Employee shall be entitled to payment by the Company for ordinary time lost through Inclement Weather for up to 36 hours in every four weeks. For the purpose of this sub- clause the following conditions shall apply: a. The first period shall be deemed to commence on the first day of the first full day period after the commencement of this Agreement and subsequent periods shall commence at 4 weekly periods thereafter in line with the pay cycle; b. An Employee shall be credited with 36 hours at the commencement of each four weekly period or pro rata if employed after the commencement of the 4 week cycle. Pro rata arrangements will be as follows: 36 hours credited where the Employee commences on any working day within the first week; 24 hours credited where the Employee commences on any working day within the second week; 16 hours where the Employee commences on any working day within the third week; and 8 hours where the Employee commences on any working day within the fourth week; c. The number of hours at the credit of any Employee at any time shall not exceed 36 hours. d. It is agreed between the Parties that, the payment for ordinary time lost is deemed to commence at the time that work ceases at the current work location. TRANSFERS 44.13. Employees may be transferred from one location on a project where or when applicableit is unreasonable to work due to Inclement Weather, individuals, groups, sections or areas of the workforce to work at another location on the Project orProject, if possible, all Project Employees will work in dry areas. If it which is not possible for all Employees affected by Inclement Weather. This may include the opportunity to work, it attend pre- arranged training in locations not affected by Inclement Weather. Howeveror where only a portion of the project is affected by Inclement Weather, all other Employees not so affected are to continue working regardless of the fact that other Employees may not be gainfully employed due to the Inclement Weather. 23.4 Where all avenues of alternative productive work in emergenciesareas unaffected by Inclement Weather have been exhausted participation in genuine and relevant training, work may continueconsultation and information sharing activities are to be utilised. 23.5 Any Employee operating machinery fitted with a functional weatherproof cab is deemed to be working in an area not affected by Inclement Weather, or as agreed between subject to safe working conditions applying and reasonable access to the Company and Employees in circumstances such as when machine being available to the Employee. 23.6 All Employees are provided with wet weather gear to unload trailers or complete concrete pours (be available to clean up and xxxxxxx relevant work areas as examples), during periods of Inclement Weather where it is agreed that to not move or protect equipment or goods may result in substantial loss. If the Employees are required directed by the Company to work in the rain, such as in the above circumstance, they will be paid single time in addition to the rate of pay applicable at the timefollowing Inclement Weather. 6.4.5 23.7 In instances where circumstances of Inclement Weather, management in consultation with the ambient temperatures reach a level which are outside the normal weather pattern and/or forecast temperatures are such that Employees are likely to be exposed to ”heat hazards”, affected Employees and the Company will meet and consult on the following: • working areas and working pattern OHS committee is responsible for the period so affected; • alternative determining whether productive work areas; • additional rest breaks and cooling down periods in A/C areas; • shading protection and other such methods to ensure practical work continues; and • training and skills improvement alternativesshould cease or continue. 6.4.6 It is the agreed position that all alternative avenues are to be explored prior to personnel being authorised to vacate the site. Inclement Weather. 6.4.1 In any situation where weather conditions do or are likely to affect safe work, affected Employees and the Company will consult on and seek the best method for completing work safely or will see if alternate safe work is available. 6.4.2 Inclement Weather' will mean climatic conditions as follows: • rain; • hail; • high winds; and/or • fog. 6.4.3 The intent of the Inclement Weather procedure herein is that, where or when applicable, individuals, groups, sections or areas of the workforce on the Project or, if possible, all Project Employees will work in dry areas. If it is not possible for all Employees to work, it is accepted that Employees may continue working whilst others are not able to do so. 6.4.4 It is not the intent or requirement for Employees to work in Inclement Weather (rain). However, in emergencies, work may continue, or as agreed between the Company and Employees in circumstances such as when Employees are provided with wet weather gear to unload trailers or complete concrete pours (as examples), during periods of Inclement Weather where it is agreed that to not move or protect equipment or goods may result in substantial loss. If the Employees are required by the Company to work in the rain, such as in the above circumstance, they will be paid single time in addition to the rate of pay applicable at the time. 6.4.5 In instances where the ambient temperatures reach a level which are outside the normal weather pattern and/or forecast temperatures are such that Employees are likely to be exposed to "heat hazards", affected Employees and the Company will meet and consult on the following: « working areas and working pattern for the period so affected; • alternative work areas; • additional rest breaks and cooling down periods in A/C areas; • shading protection and other such methods to ensure practical work continues; and • training and skills improvement alternatives. 6.4.6 It is the agreed position that all alternative avenues are to be explored prior to personnel being authorised to vacate the site. A site-specific procedure is to be developed and agreed in respect of the handling of temperature issues. Inclement Weather. 6.4.1 In any situation where weather conditions do or are likely (a) The parties to affect safe work, affected Employees and this Agreement adopt the Company will consult on and seek the best method for completing work safely or will see if alternate safe work is available. 6.4.2 ‘following provision – Inclement Weather’ will mean climatic conditions Weather - as follows: • rain; • hail; • high winds; and/or • fog.: 6.4.3 (i) The intent parties agree that all necessary steps will be taken to ensure that a full working understanding of the Inclement Weather procedure herein procedures as contained in the relevant industry awards, is thatachieved and maintained throughout the industry, where or when applicable, individuals, groups, sections or areas with particular adherence to the following provisions and guidelines. (ii) Should a portion of the workforce on the Project orproject be affected, if possibleby inclement weather, all Project Employees other employees not so affected will continue working in accordance (iii) During periods of hot weather, work in dry areasair conditioned environments will continue, subject to amenities being located adjacent to or within a reasonable distance from the workplace. If it is not possible for all Employees to work, it is accepted that Employees may continue working whilst others are not able to do so. 6.4.4 It is not the intent or requirement for Employees to work in Inclement Weather (rain). However, in emergencies, work may continue, or as agreed between the Company and Employees in circumstances such as when Employees are provided with wet weather gear to unload trailers or complete concrete pours (as examples), recognised that during periods of Inclement Weather where hot weather, some tasks/workers may be relocated prior to (iv) When it is agreed expected that the temperature will be 35°C or more, or when the temperature approaches 35°C, the Parties on site shall confer regarding the performance of work. If work has ceased for two consecutive days due to not move or protect equipment or goods may result hot weather and the Bureau of Meteorology (BOM) has forecast that the temperature will reach 35°C on the following day and the BOM has also forecast a cool change for that day, the Employees on site on that day will remain in substantial lossair conditioned amenities for one and a half hours after the temperature reaches 35°C. If the temperature drops to below 33°C, the Employees are required will return to work. The Parties will also adopt this procedure for any subsequent days where the BOM forecasts that the temperature will reach 35°C or more. (v) Should a portion of the project be affected by inclement weather, employees can be transferred to another work location under cover on the site, or to another site in accordance with the appropriate Award provisions. (vi) It is agreed by the Company to work in the rain, such as in the above circumstance, they will be paid single time in addition to the rate of pay applicable at the time. 6.4.5 In instances where the ambient temperatures reach a level which are outside the normal weather pattern and/or forecast temperatures are such parties that Employees are likely to be exposed to ”heat hazards”, affected Employees and the Company will meet and consult on the following: • working areas and working pattern for the period so affected; • alternative work areas; • additional rest breaks and cooling down periods in A/C areas; • shading protection and other such methods to ensure practical work continues; and • training and skills improvement alternatives. 6.4.6 It is the agreed position that all alternative avenues are to be explored prior to personnel being authorised any employee leaving the site due to vacate inclement weather, consultation will take place between the site. A site-specific procedure is to be developed employee’s site representative/s and agreed in respect of the handling of temperature issues. This will be agreed at Company/Employee/ Safety Committee HSE Representative Levelsite management.
