Incoming Wires. You request us to accept incoming wires. We have the right, in our absolute discretion, to reject incoming funds transfers without notice to you or any liability therefore. If you request, we will notify you of incoming transfers in any manner that we deem acceptable within a reasonable time following the receipt of such transfer. However, we assume no liability (including interest or attorneys’ fees) for failure to give such notice.

Incoming Wires. You agree to pay our fees and charges for wire transfers received by us from others for credit to your account. We may accept such wire transfers and credit your account without verifying the authority of the sender. We may but are not obligated to provide a confirmation or other notice to you of the transaction but will provide you with information on your account statement. If the incoming wire transfer is denominated in a currency other than U.S. dollars, then you agree that we (i) have no obligation to convert the funds to dollars or to seek to contact you for authorization to convert to dollars but may do so if we receive authorization from you; and (ii) are authorized by you to return the wire transfer at any time.
Incoming Wires. We apply incoming wires to accounts based solely on the account or other identifying number We receive with the wire. Any inbound wire transfer that We receive after the cutoff time We establish from time to time will be deposited to the account designated in the wire on the next Business Day. We may send advice of incoming wires at our sole discretion.
Incoming Wires. If funds are wired into an Account, the Client agrees that the Bank’s Funds Transfer Agreement will apply and also agrees that notification of the receipt of such wire may be made by including such wire as a credit reflected in the periodic statement for the Client’s account indicated in the wire instructions (“Payment Order”), as well as by a separate notice sent by mail or electronically to the Client no later than the Business Day following the Business Day that the wire has been received by the Bank. If funds are wired to your Account by others and those funds are in a currency other than U.S. dollars (“Foreign Currency”), then you agree that the Bank will convert the Foreign Currency to U.S. dollars at the current exchange rate selected by the Bank, in its sole discretion, before crediting those funds to your account, you agree to pay the Bank for all fees and charges applicable to such conversion. If the Bank makes funds available to the Client in anticipation of the Bank’s receipt, in the currency of the Payment Order, of final payment of a Payment Order for which the Client is the beneficiary, then the Client agrees that all such funds made available prior to receipt of final payment (i) constitute loans or advances by the Bank and not acceptance of a Payment Order, and (ii) shall be repayable upon demand to the Bank if the expected funds in the currency of the Payment Order are not actually received or finally settled. The Client recognizes that from time to time the Bank may charge its accounts for amounts credited thereto, whether provisionally or not, including by way of illustration and not by way of limitation, charges made as a result of the cancellation or amendment of a Payment Order or the failure of a wire system to settle as anticipated. The Bank may rely solely on identifying account numbers of the beneficiary, beneficiary bank or intermediary bank in the Payment Order, rather than names. The Bank has no duty to detect any inconsistencies between the name and the account number in any Payment Order.

  • Workstation/Laptop encryption All workstations and laptops that process and/or store DHCS PHI or PI must be encrypted using a FIPS 140-2 certified algorithm which is 128bit or higher, such as Advanced Encryption Standard (AES). The encryption solution must be full disk unless approved by the DHCS Information Security Office.

  • Cell Phone Employee shall be provided with a cell phone, with e-mail capabilities, at Board expense. As a condition of receipt of said cell phone, employee is expected to be reachable as necessary and appropriate by the Superintendent and Board President for the thorough and efficient operation of the School District. Incidental personal use shall be permitted. Employees shall have the option of being reimbursed for the use of a personal smartphone in the amount of fifty dollars ($50.00) per month instead of accepting a district cell phone. As a condition of this reimbursement, employee must a) be reasonably available at all times via the personal phone; and b) take reasonable measures to protect the confidentiality of student and staff information being transmitted to and through said phone.

  • Contract Monitoring The criminal background checks required by this rule shall be national in scope, and must be conducted at least once every three (3) years. Contractor shall make the criminal background checks required by Paragraph IV.G.1 available for inspection and copying by DRS personnel upon request of DRS.

  • Sub-processing 1. The data importer shall not subcontract any of its processing operations performed on behalf of the data exporter under the Clauses without the prior written consent of the data exporter. Where the data importer subcontracts its obligations under the Clauses, with the consent of the data exporter, it shall do so only by way of a written agreement with the sub-processor which imposes the same obligations on the sub-processor as are imposed on the data importer under the Clauses. Where the sub-processor fails to fulfil its data protection obligations under such written agreement the data importer shall remain fully liable to the data exporter for the performance of the sub-processor’s obligations under such agreement.
