Inspections by Superintendent. Where it is specified that work shall be inspected before being covered up, the Contractor shall notify the Superintendent when such work is ready for inspection, and the Superintendent shall inspect or cause the work to be inspected within seven (7) days of the date of notification. In the event of the Superintendent not making the inspection the Contractor shall proceed with the work, and if required, open up the work at a later period. The Contractor acknowledges that the Superintendent owes no duty to the Contractor to inspect the Works or, if it does inspect the Works, to review construction for errors, omissions or compliance with the requirements of the Contract and Contract Documents, and no inspection of the Works or review of construction by the Superintendent will in any way lessen or otherwise affect the Contractor’s obligations under the Contract or otherwise according to law or the Principal’s rights against the Contractor whether under the Contract or otherwise according to law. Cost of Test and Inspections The cost of the testing and the inspections referred to in clauses 16.1 and 16.2 shall be borne by the Contractor except: in the event the Contractor is required to open up the work at a later date due to the Superintendent not making the required inspection within seven (7) days of the date of notification, the Contractor shall be paid the cost of such opening up and making good unless it shall be found that the work does not accord with the Contract or Contract Documents or with the directions of the Superintendent; in the event the Contractor is directed by the Superintendent to undertake additional tests to establish conformity, the Contractor shall be paid the cost of such testing unless it shall be found that the work does not accord with the Contract or Contract Documents or with the directions of the Superintendent.

  • Superintendent The Contractor shall employ a competent superintendent and necessary assistants who shall be in attendance at the Project site during the progress of the Work. The superintendent shall represent the Contractor and all communications given to the superintendent shall be as binding as if given to the Contractor.   • Superintendence The Contractor shall maintain on site, at all times during the construction activities, a dedicated competent Superintendent. This person shall be acceptable to the County and shall have a cell phone at which he or she can be reached at all times. The superintendent shall represent the Contractor in his absence and all directions given to him shall be binding as if given to the Contractor. Whenever, in the sole discretion of the County, the Contractor is not providing a sufficient level of supervision, the County may direct the Contractor to increase the level of supervision for any or all projects, including but not limited to the right to direct the Contractor to assign a full time, dedicated Superintendent for any project; submit daily management, inspection, activity, and planning reports; substitute Subcontractors; submit daily photographs of the work in place and the work areas prepared for the next day’s work; and develop a site specific quality control program, all at no cost to the County. In the event the County’s personnel are required to provide direction or supervision of the work in the field because the Contractor has not provided sufficient supervision, the Contractor shall reimburse the County $150 per hour for such effort.

  • CONTRACTOR SUPERVISION Contractor shall provide competent supervision of personnel employed on the job Site, use of equipment, and quality of workmanship.

  • Superintendent's Duties The Superintendent’s duties shall be as prescribed by statute and by Board policies, rules, regulations and directives. The Superintendent agrees to devote the Superintendent’s time, skill, labor and attention to all required duties throughout the contract term. The Superintendent shall be subject to the direction and control of the Board at all times and shall perform such administrative duties as the Board assigns. By agreement with the Board, the Superintendent may undertake consultative work, speaking engagements, writing, lecturing, or other professional duties and obligations as long as they do not interfere with carrying out the Superintendent’s duties and obligations to the District.
