Level Two - Superintendent. If the aggrieved person is not satisfied with the disposition of his/her grievance at Level One, or if no decision is reached within six (6) school days after the grievance was referred to the building principal or immediate supervisor, then within ten (10) school days a written grievance shall be referred to the Superintendent. A decision shall be rendered by the Superintendent within ten (10) school days after its presentation.
Level Two - Superintendent a. If the aggrieved person(s) is not satisfied with the disposition of the grievance at Level One, within seven days the grievance may be submitted to the superintendent. The superintendent, or his designee, shall file a written decision within seven days after the close of the conference.
b. If the parties mutually agree that the grievance will go directly to the Board of Directors, a hearing shall be scheduled with the Board within 45 days of the agreement to bypass Level Two.
Level Two - Superintendent. If the grievant is not satisfied with the disposition of the grievance at Level One, the grievant must file the grievance in writing with the Superintendent within ten (10) calendar days after the decision at Level One. The Superintendent may meet with the grievant. Within ten (10) calendar days after receiving the written grievance, the Superintendent will render a decision in writing.
Level Two - Superintendent. 1. To appeal the decision a copy of the written grievance shall be filed with the Superintendent, or designee.
2. The Superintendent or designee shall arrange a meeting with the grievant and/or designated representative and issue a written decision to the grievant and Association representative within ten (10) days of receiving the written grievance. If the grievant or Association is not satisfied with the Superintendent's written response or if no response is received, the Association may proceed to level three within ten (10) days of when the response was due.
Level Two - Superintendent. If the grievance is not satisfied with the disposition of their grievance at Level One, or if no decision has been rendered within ten
Level Two - Superintendent. If the aggrieved teacher is not satisfied with the disposition of the grievance at Level One, the aggrieved person may appeal to the Superintendent of Schools by filing a written appeal with the Superintendent within three (3) school days after the receipt of the written decision at Level One. If no written disposition of the grievance is given within three (3) school days after the Level One meeting the grievant may refer the grievance to the Superintendent of Schools by filing a written notice of appeal (refer to Appendix C) with the Superintendent within six (6) school days after the Level One meeting. The Superintendent shall, within three (3) school days after the receipt of the written appeal, meet with the aggrieved teacher or his/her representative, or with both, for the purpose of resolving the grievance. The Superintendent shall, within three (3) school days after the hearing, render his/her decision and the reasons therefor in writing with a copy to each of the following: the aggrieved teacher, his/her representative, the principal or other immediate superior involved, BTA President.
Level Two - Superintendent. A. If the matter is not resolved at Level One, the grievance may be filed in writing with the Superintendent or other person designated by the Board. The grievance must be filed at Level Two within ten (10) days from the date the Level One response was received.
B. The Superintendent shall set a time and place for a meeting with the Association and the grievant within ten (10) days of receipt of written notification from the Association that it wishes to continue the grievance. The Superintendent shall answer the grievance in writing within seven (7) days from the date of the meeting at which the grievance was discussed, unless the time limit is extended by mutual agreement. A grievance not appealed, as provided in Step Three (3) below, within ten (10) days after the answer from the Superintendent shall be considered settled on the basis of the last answer and not subject to further review. The time limits may be extended by mutual agreement.
Level Two - Superintendent a. Within five (5) working days of receipt of the written grievance, the Superintendent will schedule a meeting with the grievant and/or Association representatives. The Superintendent may, as his/her discretion, request that a member of the administrative team be present at this meeting.
b. Within ten (10) working days after the meeting, the Superintendent will render a written disposition, including supporting reasons, to all parties.
Level Two - Superintendent. 1. In the event that either the Professional Staff Member or the ASSOCIATION is not satisfied with the disposition of the grievance at Level One, or if no decision has been rendered within seven (7) days from the date of the receipt of the grievance or the holding of the Level One meeting, whichever is applicable, either the Professional Staff Member or the ASSOCIATION may appeal the grievance in writing, stating the specific basis for the appeal to the Superintendent. A grievance may be filed at Level Two when the administrator involved at Level One does not have the authority pursuant to BOARD policy to resolve the grievance.
2. The Superintendent or his/her designee shall, within seven (7) days of receipt of the Level Two appeal, conduct a meeting concerning the grievance. The meeting will include the Professional Staff Member who filed the grievance, ASSOCIATION representatives, the supervisor involved, the Principal, and the Superintendent or the Superintendent's representative. Within seven (7) days after this meeting, the Superintendent or his/her designee will issue the decision along with the reasons, in writing, as to the final disposition of the grievance. A copy will be furnished to the aggrieved person, the ASSOCIATION, the supervisor and the Principal involved.
Level Two - Superintendent. 1. Within five (5) days of receipt of the decision rendered by the principal in regard to such hearing, such decision may be further appealed by the aggrieved person to the superintendent. The appeal shall include a copy of the decision being appealed and the grounds for regarding the decision incorrect. The appeal shall be in writing, dated, and the receipt of the appeal initialed or recorded by the superintendent by date and time. It shall also state the name of all persons officially present at the prior hearing and such persons shall receive a copy of the appeal.
2. Appeals to the superintendent shall be heard by the superintendent within ten (10) days of the receipt of the appeal. Written notice of the time and place of the hearing shall be given by the superintendent five (5) days prior thereto to the aggrieved person, his/her representative, if any, the Union grievance representative, and any administrator who has theretofore been involved in the grievance.
3. Within twenty (20) days of hearing the appeal, the superintendent of schools shall communicate to the aggrieved person and all other parties officially present at the hearing, his written decision which shall include supportive reason therefore. A copy of the decision will be sent to the chairman of the grievance committee.
