Instructors. 7.1 All instructors teaching COLLEGE courses offered as part of this CCAP Agreement must meet the minimum qualifications for instruction in a California community college as set forth in Title 5 California Code of Regulations, Sections 53410 and 58060 or as amended and be hired by the 4CD. 7.2 The CCAP Agreement Appendix shall specify which participating SCHOOL DISTRICT or COLLEGE will be the employer of record for purposes of assignment monitoring and reporting to the county office of education. SCHOOL DISTRICT personnel selected to be instructors remain employees of the SCHOOL DISTRICT, subject to the authority of the SCHOOL DISTRICT, but will also be subject to the authority of 4CD specifically with regard to their duties as instructors. 7.11 The COLLEGE shall determine the number of instructors, the ratio of instructors to students, and the subject areas of instruction, subject to approval by 4CD.

Upon receipt of a complaint alleging harassment, discrimination or any other violation of law, including but not limited to Title IX, the designated employee from the entity receiving the complaint shall inform and provide a copy of such complaint to the designated employee from the other entity. The designated employees from the COLLEGE and SCHOOL DISTRICT shall review the facts giving rise to the complaint and determine which entity will take the lead on investigating, managing and resolving such complaint. Neither COLLEGE nor SCHOOL DISTRICT may abandon or assign their obligations under the law, including Title IX.

7.7 Faculty will complete mandatory training as required by the employer of record.

7.10 Faculty provided by the SCHOOL DISTRICT will are eligible to participate in professional development activities sponsored by the COLLEGE as required by the terms and condition of the contract and shall be encouraged to participate in ongoing collegial interaction to include, but not limited address course content, course delivery, assessment, evaluation, and/or research and development in the field. Adjunct faculty are not required to participate in these activities however, they are encouraged to participate.
7.9 Faculty performance 7.11 Performance of faculty members employed by the COLLEGE shall be evaluated by the COLLEGE using the adopted existing procedures as outlined in Article 14 – Evaluation of the Agreement between Monterey Peninsula Community College District (MPCCD) and Monterey Peninsula College Teachers Association (MPCTA). In cases where a faculty member is employed by the SCHOOL DISTRICT to teach AB288 courses, the performance expectations and evaluation process will be detailed in an Instructional Service Agreement between the COLLEGE and standards for faculty of SCHOOL DISTRICT. The Agreement between MPCCD and the COLLEGE, subject to the approval of 4CDMonterey Peninsula College Teachers Association (MPCTA) is available at xxxx://xxx.xxx.xxx/home/showdocument?id=5521.
7.10 7.12 The COLLEGE may select instructors from SCHOOL DISTRICT personnel. Instructors. 7.1 All instructors teaching COLLEGE courses offered as part of this CCAP Agreement must meet the minimum qualifications for instruction in a California community college as set forth in sections 53410 and 58060 of Title 5 V of the California Code of Regulations, Sections 53410 and 58060 as required or hired as amended and be hired part of an Instructional Service Agreement. 7.2 Consistent with the terms negotiated between WVMCCD and the faculty union, WVMFT instructors for courses offered as part of this CCAP Agreement shall be assigned as follows: • Courses will first be offered to regular faculty of COLLEGE that meet the above- stated minimum qualifications and have participated. • If courses are not filled by regular faculty, they will be offered to COLLEGE adjunct faculty who possess contractual rehire preference rights, and who meet the above-stated minimum qualifications. • If courses are still not filled, they may be offered to junior adjunct faculty and employees of CUHSD who meet the above-stated minimum qualifications.
7.3 WVMCCD shall be solely responsible for all salaries, wages, and benefits due to dual enrollment faculty who are WVMCCD employees. The CUHSD shall be solely responsible for the salaries, wages, and benefits due to the dual enrollment faculty who are CUHSD employees, unless otherwise agreed by CUHSD and WVMCCD.
7.4 The CCAP Agreement Appendix A shall specify which participating SCHOOL DISTRICT institution, either CUHSD or COLLEGE WVMCCD, will be the employer of record for purposes of assignment monitoring and reporting to the county office of education. Sec(Ed. 2 Code § 76004 (m)(1).)

7.5 COLLEGE and SCHOOL DISTRICT certify that any remedial course taught by community college faculty at a partnering high school campus shall be offered only to high school students who do not meet their grade level standard in math, English, or both on an interim assessment in grade 10 or 11, as determined by the partnering school district, and shall involve a collaborative effort between high
7.6 7.7 Instructors who teach COLLEGE courses under this CCAP Agreement shall comply with the fingerprinting requirements set forth in Ed Code § section 45125 or as amended and amended; the tuberculosis testing and risk assessment requirements of California Health and Safety Code § 121525 section121525 or as amended; completion of training on mandated reporting as set forth in Education Code section 44691or as amended; and submission of a New Employee Data Input Form (i.e., Emergency Contact Information). In addition to any other prohibition or provision, no person who has been convicted of a violent or serious felony felony, as defined by Education Code section 44332.6 (c) shall be eligible to teach any courses offered as part of this CCAP Agreement or otherwise provide services on a SCHOOL DISTRICT CUHSD site. The CCAP Agreement Appendix shall specify additional procedures for faculty under this agreement.
7.7 7.8 Prior to teaching, faculty provided by the SCHOOL DISTRICT CUHSD shall receive discipline-specific training and an orientation from WVMCCD at COLLEGE regarding, but not limited to, course curriculum, assessment criteria, pedagogy, course philosophy, testing and grading procedures record keeping, and other instructional responsibilities. Said training shall be approved by WVMCCD. In the event WVMCCD and provided by CUHSD disagree regarding faculty training guidelines, the COLLEGE.parties agree to meet and confer in good faith. If the parties cannot reach agreement within a reasonable time, WVMCCD shall make the final decision regarding the appropriate training and orientation for CUHSD faculty.
7.8 7.9 Faculty provided by the SCHOOL DISTRICT will CUHSD may participate in professional development activities sponsored by the COLLEGE as required by the terms and condition of the contract WVMCCD and shall be encouraged to participate in ongoing collegial interaction to include, but not limited activities address items such as address course content, course delivery, assessment, evaluation, and/or research and development in the field.

7.3 The COLLEGE shall be solely responsible for all salaries, wages, and benefits due to dual enrollment faculty who are COLLEGE employees.
7.4 The COLLEGE shall be responsible for faculty salaries associated with the instructional class time of the classes conducted under this Agreement for faculty that are not SCHOOL DISTRICT employees. Any supplemental instruction related to the material presented in classes conducted under this Agreement by COLLEGE Employees, that extends beyond the college schedule, is the SCHOOL DISTRICT’s responsibility.
7.5 The CCAP Agreement Appendix shall specify which participating SCHOOL DISTRICT or COLLEGE will be the employer of record for purposes of assignment monitoring and reporting to the county office of education. Sec. 2 (m)(1)

As a general rule, faculty must be physically present in the classroom or lab or within line-of-sight of the students.

7.13 The COLLEGE may select instructors from SCHOOL DISTRICT personnel. SCHOOL DISTRICT personnel selected to be instructors remain employees of the SCHOOL DISTRICT, subject to the authority of the SCHOOL DISTRICT, but will also be subject to the authority of 4CD SMC specifically with regard to their duties as instructors.
7.11 7.14 The COLLEGE shall determine will be the number employer of instructors, record for all community college- paid faculty teaching at the ratio of instructors to students, and the subject areas of instruction, subject to approval by 4CD.SCHOOL DISTRICT.

SCHOOL DISTRICT shall ensure that all instructor/staff nominees possess any certificates or other training indicia that may be required including, but not limited to the minimum qualifications for teaching community college as set forth in Title 5 CCR 53410 and 58060 or as amended. COLLEGE shall determine the number of instructors, the ratio of instructors to students, and the subject areas of instruction, subject to approval by 4CD.PVCCD. COLLEGE shall provide an orientation meeting for faculty and instructional resources such as manuals, course outlines, curriculum materials, and testing and grading procedures. All instructors who are SCHOOL DISTRICT employees must sign the Instructor Agreement, which states, among other things, that PVCCD shall have the primary right to control over the course content under the terms of this MOU. Instructors teaching courses under this MOU shall not have any other assigned duty while course instruction is taking place. The instructional services provided by SCHOOL DISTRICT personnel shall include development of appropriate lectures. The lectures will conform to the approved curriculum and course outlines and recommendations of experienced COLLEGE instructors and shall meet the academic standards and criteria of PVCCD. LIAISON AND COORDINATION OR RESPONSIBILITIES The COLLEGE shall appoint an educational administrator who will serve as liaison, and who will approve all dual enrollment instructors in consultation with the academic department of the COLLEGE and in conformity with PVCCD policies and standards. The liaison shall provide initial and ongoing training for dual enrollment faculty, conduct site visits, provide performance evaluations of instructors teaching DE Courses, and strengthen communication between essential elements of the SCHOOL DISTRICT, the COLLEGE, COLLEGE academic departments, and the COLLEGE student affairs office. The liaison will keep dual enrollment faculty informed of new curriculum developments, pedagogic innovations, textbook adoptions, educational outcomes, assessment of learning, grading standards, proficiency expectations, and syllabus components. The liaison will facilitate coordination and cooperation between COLLEGE and SCHOOL DISTRICT. COLLEGE will provide SCHOOL DISTRICT personnel with reasonable assistance, direction and instruction in how to fulfill their responsibilities under this MOU, including conducting appropriate student assessments, outreach/recruitment activities and compliance with PVCCD policy and the COLLEGE’S procedures and academic standards. SCHOOL DISTRICT shall provide personnel to perform clerical services and services assessing students, processing student applications, enrolling qualified students, and other related services as may be necessary. SCHOOL DISTRICT’s personnel will perform these services on duty time. 7.8 Faculty provided by the SCHOOL DISTRICT will participate in professional development activities sponsored by the COLLEGE as required by the terms and condition of the contract and shall be encouraged to participate in ongoing collegial interaction to include, but not limited address to addressing course content, course delivery, assessment, evaluation, and/or research and development in the field.
7.9 Faculty performance shall be evaluated by the COLLEGE using the adopted evaluation process and standards for faculty of the COLLEGE, subject to the approval of 4CD.

The COMMUNITY COLLEGE DISTRICT or COLLEGE will be has no obligation to compensate instructors for any supplemental instruction, including supplemental instruction related to course material that extends beyond the employer of record for college schedule.

7.9 7.11 Faculty performance shall be evaluated by the COLLEGE using the adopted evaluation process and standards for faculty of the COLLEGE, subject to the approval of 4CDSMC.
7.10 7.12 Faculty provided by the SCHOOL DISTRICT who don’t comply with the policies, regulations, standards, and expectations of the COLLEGE shall be ineligible to teach dual enrollment courses.
7.13 The COLLEGE may select instructors from SCHOOL DISTRICT personnel. SCHOOL DISTRICT personnel selected to be instructors remain employees of the SCHOOL DISTRICT, subject to the authority of the SCHOOL DISTRICT, but will also be subject to the authority of 4CD SMC specifically with regard to their duties as instructors.
7.11 7.14 The COLLEGE shall determine will be the number employer of instructors, record for all community college-paid faculty teaching at the ratio of instructors to students, and the subject areas of instruction, subject to approval by 4CD.SCHOOL DISTRICT.

The appropriate COLLEGE shall determine administrator, in consultation with the number of instructorsappropriate SCHOOL DISTRICT administrator, will grant final approval to SCHOOL DISTRICT teachers eligible to teach dual enrollment courses. RSCCD /SAC will orient the ratio of approved faculty member.
7.11. COLLEGE instructors will notify SCHOOL DISTRICT school counselors or higher education coordinators when a student enrolled in a college course provided under this CCAP agreement begins to students, struggle and will refer the subject areas of instruction, subject to approval by 4CD.student for additional support.

The instructor shall determine the type, make, and model of all equipment, books and materials to be used during each course offered as part of this Agreement and submit for approval to WKCCD. TUHSD understands that no equipment or materials fee may be charged to students per Education Code § 49011.
8.8. WKCCD instructors are not required to provide fundamental modifications to a course for students participating in this Agreement with Individual Education Plans or 504 plans. XXXXX will communicate accommodations to instructors participating in this agreement.
8.9. Dual Enrollment instructors will be evaluated by the COLLEGE using the adopted evaluation process WKCCD College faculty and standards for faculty of the COLLEGEadministration as outlined in Xxxx College's collective bargaining agreement (Exhibit "B" Article 6.8.3, subject to the approval of 4CDTC Collective Bargaining Agreement).

The designated employees from the COLLEGE and SCHOOL DISTRICT shall review the facts giving rise to the complaint and determine which entity will take the lead on investigating, managing and resolving such complaint. Neither COLLEGE nor SCHOOL DISTRICT may abandon or assign their obligations under the law, including Title IX.

Any supplemental instruction related to the material presented in classes conducted under this Agreement by COLLEGE Employees, that extends beyond the college schedule, is the SCHOOL DISTRICT’s responsibility.
7.5 The CCAP Agreement Appendix shall specify which participating SCHOOL DISTRICT or COLLEGE will be the employer of record for purposes of assignment monitoring and reporting to the county office of education. Sec. 2 (m)(1)
