Interruptions in Services. We may, on a regular basis, perform maintenance on our equipment or system, which may result in interrupted service or errors in the Service. We also may need to change the scope of our Services from time to time. We will attempt to provide prior notice of such interruptions and changes but cannot guarantee that such notice will be provided. Harm to Computer Systems/Data. YOU AGREE THAT OUR LIABILITY FOR VIRUSES, WORMS, TROJAN HORSES, OR OTHER SIMILAR HARMFUL COMPONENTS THAT MAY ENTER YOUR COMPUTER SYSTEM BY DOWNLOADING INFORMATION, SOFTWARE, OR OTHER MATERIALS FROM OUR SITE SHALL BE LIMITED TO REPLACING, OR THE REASONABLE COST OF REPLACING, THE LOST INFORMATION, SOFTWARE OR OTHER MATERIAL. WE WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM SUCH HARMFUL COMPONENTS. Performance of Software and Electronic Service. WE MAKE NO WARRANTY TO YOU REGARDING THE EQUIPMENT OR THE SOFTWARE, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE.

Interruptions in Services. The Bank may on a regular basis perform maintenance on the Bank’s equipment or systems which may result in interruption of the Online Banking Services. The Bank will not be liable to you as a result of any such interruptions.
Interruptions in Services. In the event the operations of WPPA's or Provider Hospital's services or facilities, or any substantial portion thereof, are interrupted by war, fire, insurrection, labor matters, riots, the elements, earthquakes, acts of God, or, without limiting the foregoing, any other cause beyond the control of the WPPA or Provider, the provisions of this Agreement (or such portions hereof as the WPPA or Provider is thereby rendered incapable of performing) shall be suspended for the duration of such interruption. If less than a substantial portion of the WPPA's or Provider's services or facilities are affected, it shall be relieved of its obligations only as to those effected operations and only as to those effected portions of this Agreement for the duration of the interruption. Should a substantial part of the services, which WPPA has agreed to provide hereunder, be interrupted pursuant to such event for a period more than thirty (30) days, then Group shall have the right to terminate this Agreement upon ten (10) days prior written notice to WPPA.
Interruptions in Services. 7.1 PE shall use reasonable commercial efforts consistent with prevailing industry standards to maintain its facilities and operations in a manner, which minimizes errors and interruptions in the Services. For greater certainty the parties acknowledge that no power supply facility operation can be completely free from any errors or interruption in the Confidential Services, whether within or outside of PE reasonable control. In the case of commercial power supply outage, the building standby generator supply shall automatically kick-in to assume the full load.
Interruptions in Services. Landlord shall not be in default hereunder, or be liable for any damages directly or indirectly resulting from, nor shall any amounts due hereunder be abated by reason of: (a) the installation, use or interruption of use of any equipment in connection with the furnishing of any of the services described in Section 6.01 above; (b) the failure to furnish, or a delay in furnishing, any such services; or (c) the limitation, curtailment, rationing or restriction on use of water, electricity, gas or any other form of energy or any other service or utility whatsoever serving the Premises. If any governmental entity promulgates or revises any statute, ordinance or building, fire or other code, or imposes mandatory or voluntary controls or guidelines on Landlord or the Premises or any part thereof, relating to the use or conservation of energy, water, light or electricity or the provision of any other utility or service provided with respect to this Lease, or if Landlord is required or elects to make alterations to the Premises in order to comply with such mandatory or voluntary controls or guidelines, Landlord may, in its sole discretion, comply with such mandatory or voluntary controls or guidelines, or make such alterations to the Premises. Such compliance activities or alterations shall be performed at mutually agreeable times, and in a manner that will minimize interference with Tenant's business operations. Tenant agrees to cooperate in good faith to accomplish that end.
Interruptions in Services. We, or our Bill Payment provider, may on a regular basis perform maintenance on equipment and/or systems which may result in interruptions to the Services or errors in the Services. We will attempt to provide prior notice of such interruptions and changes, but we cannot guarantee that such notice will be provided. We are not liable for any losses, damages, or claims you may have from an interruption in or change to the Services regardless of whether or not you received a notice.
Interruptions in Services. Alliance Bank may on a regular basis perform maintenance on Alliance Bank equipment or systems that may result in an interruption of Business Banking services. Alliance Bank will not incur any liability to you as a result of any such interruptions.

  • Service Interruptions The Company may need to interrupt Your access to the Website to perform maintenance or emergency services on a scheduled or unscheduled basis. You agree that Your access to the Website may be affected by unanticipated or unscheduled downtime, for any reason, but that the Company shall have no liability for any damage or loss caused as a result of such downtime.

  • Interruption of Services Tenant agrees that Landlord shall not be liable in damages, by abatement of Rent or otherwise, for failure to furnish or delay in furnishing any service, or for any diminution in the quality or quantity thereof, when such failure or delay or diminution is occasioned, in whole or in part, by repairs, renewals, or improvements, by any strike, lockout or other labor trouble, by inability to secure electricity, gas, water, or other fuel at the Building after reasonable effort so to do, by any accident or casualty whatsoever, by act or default of Tenant or other parties, or by any other cause beyond Landlord’s reasonable control; and such failures or delays or diminution (any such event, a “Service Failure”) shall never be deemed to constitute an eviction or disturbance of Tenant’s use and possession of the Premises or relieve Tenant from paying Rent or performing any of its obligations under this Lease. Notwithstanding the foregoing, if the Premises, or a material portion of the Premises, is made untenantable (that is, Tenant cannot conduct its business in such portion) or inaccessible for a period in excess of five (5) consecutive business days as a result of the Service Failure that has been caused by Landlord’s act or omission with respect to matters within Landlord’s control (“Controlled Service Failure”), then Tenant, as its sole remedy, shall be entitled to receive an abatement of Rent payable hereunder during the period beginning on the sixth (61 ) consecutive business day of the Controlled Service Failure and ending on the day the service has been restored. If the entire Premises has not been rendered untenantable or inaccessible by such a Controlled Service Failure, the amount of abatement that Tenant is entitled to receive by reason of such a Controlled Service Failure shall be prorated based upon the percentage of the Premises rendered untenantable or inaccessible and not used by Tenant. Notwithstanding the foregoing, business days during which the Premises or a material portion thereof are untenantable or inaccessible, or during which all or nearly all the Premises are unusable, by reason of a Service Failure which arises from a fire or other casualty which is covered by the provisions of ARTICLE 13 shall in no event be considered in determining whether Tenant is entitled to an abatement of Rent under this Section 8.03 (in such event the provisions of Section 13.01 shall govern Tenant’s rights). In no event shall Landlord be liable to Tenant for any loss or damage, including the theft of Tenant’s property, arising out of or in connection with the failure of any security services, personnel or equipment.

  • Interruptions There shall be no abatement of rent and Lessor shall not be liable in any respect whatsoever for the inadequacy, stoppage, interruption or discontinuance of any utility or service due to riot, strike, labor dispute, breakdown, accident, repair or other cause beyond Lessor's reasonable control or in cooperation with governmental request or directions.

  • Continuity of Services A. The Contractor recognizes that the service(s) to be performed under this Contract are vital to the State and must be continued without interruption and that, upon Contract expiration, a successor, either the State or another contractor, may continue them.
