Common use of Job Vacancies and Layoffs Clause in Contracts

Job Vacancies and Layoffs. Seniority shall prevail with reference to filling permanent job vacancies, layoffs, and recall from such layoffs; provided, however, that job performance, skill, ability, and general qualifications for the position in question are not overriding factors in the judgment of the Employer. If a nurse disagrees with the Employer’s determination as to job performance, skill, ability and general qualifications, the nurse may have recourse to the grievance procedure.
