Common use of JOB VACANCY Clause in Contracts

JOB VACANCY. 11.01 Where the Employer determines that a vacancy or new position exists within the bargaining unit, or where a temporary vacancy arises as a result of the necessity to replace a Nurse on a leave of absence expected to be for twelve (12) weeks or longer, the Employer shall post a notice of vacancy or new position for a period of five (5) working days. 11.02 The parties agree that in all cases of promotion to a higher classification and job vacancies the following factors will be considered: (a) ability, experience and qualifications; (b) seniority. Where the factors in (a) above are considered to be relatively equal seniority will be the determining factor. (a) The Employer will notify all bargaining unit Nurses of all bargaining unit vacancies via email, in addition to posting such vacancies as required by Article 11.01 hereof. The Employer agrees to post all vacancies and new positions on the Health Unit website. (b) Any Nurse wishing to make application shall do so in writing within the required time limit. (c) Nurses who express an interest, in writing, for assignment to a different program will be considered when a job vacancy or new position arises and such request shall remain in effect only until the end of the calendar year in which it is submitted. (d) The Employer will forward a copy of all postings related to job vacancies or new positions to the Union. (e) All applications will be acknowledged in writing within fourteen (14) days of receipt. (f) The Employer reserves the right to interview only those Nurses who meet the minimum qualifications and experience requirements on the job posting. (g) The Union shall receive notification of the successful applicant(s) within seven (7) calendar days of the decision of the Employer via email. The Employer will provide the Union with a list of unfilled vacancies in advance of each Liaison Committee meeting. The Union will also be advised of any posted positions that have been rescinded by the Employer at that time. (h) Any job vacancy not filled within three (3) months of the expiry date of such posting shall be considered cancelled and prior to filling such job vacancy it will be posted in accordance with 11.01. (i) A Nurse awarded a temporary vacancy shall be entitled to apply for another temporary vacancy but is expected to remain in the initial temporary vacancy until its completion prior to transferring into another temporary vacancy. This does not apply to Nurses applying for vacancies or requesting a transfer to permanent full-time or permanent part-time positions posted in accordance with Article 11.01, or Nurses who posted or transferred as a result of a layoff. (j) Absent exceptional circumstances, the Employer will endeavour to move Nurses who have been selected for positions in accordance with Article 11.01 into their positions within seventy-five (75) days of their selection to the positions.

When such factors are deemed to be relatively equal, seniority shall be the governing factor. 17.05 The name of the successful applicant will be posted and unsuccessful applicants will be notified. 17.06 Vacancies which are not expected to exceed four (4) months will not be posted and may be filled at the discretion of the Clinic. In filling such vacancies, consideration shall be given to employees in the bargaining unit already trained to perform the work. 17.07 The Clinic shall have the right to fill a posted vacancy on a temporary basis to allow for completion of the posting process and a completion of arrangements to permit the employee selected to fill the vacancy. No grievance may be filed concerning the filling of such temporary arrangements. 17.08 Where there is a vacancy in a job share position, the remaining job share partner will continue the position in a full-time capacity until the remaining job share position is filled.

Only those job vacancies which the Company has declared to be a job vacancy or new position exists will be available for bids. Applications must be submitted electronically within the bargaining unitspecified time period using the on-line application tool provided by the Company. The application shall contain a clear, or where a temporary vacancy arises as a result concise statement of the necessity to replace a Nurse employee’s background, training and overall qualifications and the reasons the bidding employee should be considered for the position. Any employee who is on a leave of absence expected vacation throughout the entire period that any such notice is posted who would like to be considered for twelve the vacancy may submit a written application for the job to be filed within forty-eight (1248) weeks or longer, hours following the Employer shall post a notice of vacancy or new position for a period of five (5) working daystime that he is scheduled to return to work. 11.02 10.02 The parties agree that in all cases of promotion to a higher classification and job vacancies the following factors will be considered: (a) ability, experience and qualifications; (b) seniority. An employee's bid will be considered except employees who at the time of the vacancy are in one of the following categories: a) Probationary and temporary employees; b) Laid off employees; c) Employees who within the previous six (6) months have been returned to their former job because of failure to qualify on a job in the same title as the vacancy involved; d) Employees who have not been in their present position for at least one year. With supervisory approval, employees with less than one year’s service in their present position may submit a job bid. 10.03 The Company will fill the vacancy with the candidate it determines to be the most qualified. In doing so, the Company will attempt to fill the vacancy internally from those employees submitting a job bid request. However, it is understood that the Company may also consider candidates outside the bargaining unit when filling those vacancies. JOB VACANCY. 11.01 Where (a) Should a permanent job become available, the Employer determines that a Company shall post the permanent job on the Company Bulletin Board for five (5) working days. Employees who wish to be considered shall sign the posting. The most senior applicant for the job shall be the successful candidate provided he is capable of performing the job. The name of the successful candidate shall be posted on the Company Bulletin Board for five (5) working days. (b) If no applications are received during the posting period, the Company may transfer the most junior qualified employee to fill the vacancy or new position exists within start proceeding to hire employees to fill the vacancy, from outside the bargaining unit.
