Jury and Witness Duty. If an employee is requested to serve as a juror in any court of law or is required by subpoena to attend as a witness in a court proceeding in which the Crown is a party, or is required to attend a coroner's inquest in connection with a case concerning the Hospital, the employee shall not lose regular pay because of necessary absence from work due to such attendance, and shall not be required to work on the day of such duty, provided that the employee: (a) informs the Employer immediately upon being notified that the employee will be required to attend court or the coroner's inquest; (b) presents proof of service requiring the employee's attendance; and (c) promptly repays the Employer the amount (other than expenses) paid to the employee for such service as a juror or for attendance as such witness. (Applicable to full-time employees) In addition to the foregoing, where an employee is required by subpoena to attend a Court of Law or Coroner's Inquest, in connection with a case arising from the employee's duties at the Hospital, on his regularly scheduled day off or during his regularly scheduled vacation, the Hospital will attempt to reschedule the employee's regular day off or vacation period, it being understood that any rescheduling shall not result in the payment of any premium pay. (Applicable to full-time employees) In addition to the foregoing, where an a full-time employee is required by subpoena to attend a Court court of Law law or Coronercoroner's Inquest, inquest in connection with a case arising from the employee's duties at with the Hospital, Corporation on his their regularly scheduled day off or during his regularly scheduled vacationoff, the Hospital Corporation will attempt to reschedule the employee's regular day off or vacation periodoff. Where the employee's attendance is required during a different shift than they are scheduled to work that day, it being the Corporation will attempt to reschedule the shift to include the time spent at such hearing. It is understood that any rescheduling shall not result in the payment of any premium pay. If Where the Hospital fails Corporation is unable to reschedule the employee and, as a result, they are required to attend during other than their regularly scheduled paid hours, they shall be paid for all hours actually spent at such employeeshearing at their straight time hourly rate subject to (i), (ii) and (iii) above.
(b) If an employee is required to serve as a juror in any court of law, or is required to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law or coroner's inquest in connection with a case arising from the employee's duties with the Corporation, the Hospital employee shall arrange lieu time off work for all days not lose regular pay because of such attendance provided that the employees would otherwise employee:
(i) notifies the Corporation immediately on the employee's notification that they will be off work had it not been for required to attend at court;
(ii) presents proof of service requiring the attendance at Court or employee's attendance; and,
(iii) deposits with the Coroner's InquestCorporation the full amount of compensation received excluding mileage, traveling and meal allowances and an official receipt thereof. (Applicable to part-time employees) In addition to the foregoing, where a part-time employee is required by subpoena to attend a court of law or Xxxxxxxcoroner's inquest, inquest in connection with a case arising from the employee's duties at with the Hospital, Corporation on his their regularly scheduled day off, he they shall receive be paid for all hours actually spent at such hearings at their regular pay as if he had been scheduled straight time hourly rate subject to work the day. (Applicable to part-time employees) In addition to the foregoing, where a part-time employee is required by subpoena to attend a court of law or Xxxxxxx's inquest, coroner’s inquest in connection with a case arising from the employee's nurse’s duties with the Employer, the nurse shall not lose service/seniority or regular pay because of such attendance and shall not be required to work the night shift prior to, or on the day of such duty provided that the nurse:
(i) notifies the Employer immediately on the nurse’s notification that she or he will be required to attend court;
(ii) presents proof of service requiring the nurse’s attendance;
(iii) deposits with the Employer the full amount of compensation received excluding mileage, travelling and meal allowances and an official receipt where available. In addition, where a full-time nurse, regular part-time or relief nurse is selected for jury duty for a period in excess of one (1) week, she or he shall be paid for all hours scheduled and not be expected to attend at work. Upon completion of the Hospitalprocess the nurse shall be returned to that point on her or his former schedule that is considered appropriate by the Employer. It is understood and agreed that the local parties may agree to different scheduling arrangement for the first week of jury and witness duty.
(b) Where the Employer requires a nurse to attend any meetings in preparation for a case or legal proceedings which either arises from a nurse’s employment with the Employer or otherwise involves the Employer, on the Employer will make every reasonable effort to schedule such meetings with the Employer during the nurse’s regularly scheduled hours of work. If the nurse is required to attend such meetings outside of her or his regularly scheduled day offhours, he the nurse shall receive be paid for all hours spent in such meetings at her or his regular pay as if he had been scheduled to work the daystraight time hourly rate of pay. (The following clauses related to Pregnancy Leave Part-time and Parental Leave relief nurses will be incorporated credited with seniority and service for all such hours paid as provided above while in all collective agreements:)attendance at such meetings.

(Applicable to full-time employees) In addition to the foregoing, where an employee is required by subpoena to attend a Court court of Law law or Coronercoroner's Inquest, inquest in connection with a case arising from the employee's duties at the Hospital, Villa on his the employee's regularly scheduled day off or during his regularly scheduled vacationoff, the Hospital Villa will attempt to reschedule the employee's regular day off or vacation periodoff. Where the employee's attendance is required during a different shift than he/she is scheduled to work that day, it being the Villa will attempt to reschedule the shift to include the time spent at such hearing. It is understood that any rescheduling shall not result in the payment of any premium pay. If Where the Hospital fails Villa is unable to reschedule such employeesthe employee and, as a result, the Hospital shall arrange lieu time off work for all days the employees would otherwise be off work had it not been for the attendance at Court or the Coroner's Inquest. (c) deposits with the Hospital the full amount of compensation received excluding mileage, travelling and meal allowances and an official receipt thereof. Where a part-time employee is selected for jury duty, for a period in excess of one (1) week, the employee shall be paid for all hours scheduled and not be expected to attend at work. Upon completion of the process the employee shall be returned to that point on their former schedule that is considered appropriate by the Hospital. It is understood and agreed that the local parties may agree to different scheduling arrangements for the first week of jury and witness duty. Jury and Witness Duty. Applicable to full-time and part-time employees: If an employee is requested required to attend jury selection or serve as a juror in any court of law law, or is required by subpoena to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law or coroner's inquest in connection with a case concerning arising from the employee's duties at the Hospital, the employee shall not lose regular pay because of necessary absence from work due to such attendance, and shall not be required to work on the day of such duty, attendance provided that the employee:

Maternity -Le-av-e An employee who is pregnant and who has been employed for at lease ten months immediately the expected date of birth shall be entitled, upon her written application therefor, to a leave of six months from her employment or such shorter leave of absence as the employee may request com- mencing during the period of eleven weeks preceding the estimated day of her delivery. immediately Effective on confirmation by the Unemployment Insurance Commission of the appropriateness of the Hospital's Supplemental Unemployment Benefit (SUB) Plan, an employee on leave as set out benefits pursuant to Section of the Unemployment Insurance Act, shall be paid a supplemental unemployment benefit. That benefit will be equivalent to the difference between seventy-five per cent of her regular weekly earnings and the sum of her weekly Unemployment Insurance benefits and any other earnings. Such payment shall commence following comple- tion of the two week unemployment insurance waiting period, and receipt by the Hospital of the employee's Unemployment Insurance cheque stub as proof that she is in receipt of Unemployment Insurance pregnancy benefits, and shall continue while the employee is in of such benefits for a maximum period of fifteen weeks. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours. Where the actual date of her delivery is later than the estimated date of her delivery, the leave of absence shall not end before the expiration of six weeks following the actual date of her delivery. The employee shall give the Hospital weeks' notice in writing prior to the day upon which she intends -to commence her leave of absence and shall furnish the Hospital with the certificate of a legally medical practitioner stating that she is pregnant and giving the estimated day upon which delivery will occur in his opinion. An employee may, if she desires to return to work, shorten the duration of the leave of absence requested upon giving the Hospital four week's notice of her intention to do so and furnishing the Hospital with the certificate of a legally qualified medical practitioner stating that she is able to resume her work. The may require the employee to begin the leave of absence at such time as in its opinion the duties of her posi- tion cannot reasonably be performed by a pregnant woman or the performance of her work is affected by the pregnancy. (i) If an employee is requested required to serve as a juror in any court of law law, or is required by subpoena to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law or coroner's inquest in connection with a case concerning arising from the Hospitalemployee's duties with the Employer, the employee shall not lose regular pay because of necessary absence from work due to such attendance, and shall not be required to work on the day of such duty, attendance provided that the employee:

(ai) informs notifies the Employer Corporation immediately upon being notified on the employee's notification that the employee they will be required to attend court or the coroner's inquestat court;
(bii) presents proof of service requiring the employee's attendance; and,
(ciii) promptly repays deposits with the Employer Corporation the full amount (other than expenses) paid to the employee for such service as a juror or for attendance as such witnessof compensation received excluding mileage, traveling and meal allowances and an official receipt thereof. (Applicable to full-time employees) In addition to the foregoing, where an a full-time employee is required by subpoena to attend a Court court of Law law or Coronercoroner's Inquest, inquest in connection with a case arising from the employee's duties at with the Hospital, Corporation on his their regularly scheduled day off or during his regularly scheduled vacationoff, the Hospital Corporation will attempt to reschedule the employee's regular day off or vacation periodoff. Where the employee's attendance is required during a different shift than they are scheduled to work that day, it being the Corporation will attempt to reschedule the shift to include the time spent at such hearing. It is understood that any rescheduling shall not result in the payment of any premium pay. Jury and Witness Duty. If an employee is requested to serve as a juror in any court of law or is required by subpoena to attend as a witness in a court proceeding in which the Crown is a party, or is required to attend a coroner's inquest in connection with a case concerning the Hospital, the employee shall not lose regular pay because of necessary absence from work due to such attendance, and shall not be required to work on the day of such duty, provided that the employee:

g) Upon request of the Nurse, the Employer shall endeavour to arrange a shift change to ensure adequate rest periods.

Where the employee's attendance is required during a different shift than he is scheduled to work that day, it being the Hospital will attempt to reschedule the shift to include the time spent at such hearing.
