Common use of Jury Duty or Witness Clause in Contracts

Jury Duty or Witness. a) Permanent full-time employees who are required to serve as jurors or witnesses in any court, shall be granted leave of absence for this purpose. Such leave shall not constitute a break in service for the calculation of seniority or sick leave credits. Upon completion of the jury or witness service such employees shall present to their Department Head a certificate satisfactory to the Region showing the period of such service. A coroner’s inquest shall be considered as a court for purposes of this Article. Such employees will be paid their full salary or wage for the period of such jury or witness service provided they shall deposit with the Commissioner of Human Resources Assistant or Designate the full amount of compensation received, excluding mileage and travelling expense, and an official receipt therefore. b) When employees are required to appear in court as a witness on behalf of the Region while they are off on leave or vacation, they shall be paid their full regular salary or wages for the period of time they are required to attend court, or will be given time off in lieu upon their return from leave or vacation, to be used within ninety (90) calendar days of their return to work. c) Employees shall also be compensated for the applicable mileage allowance and parking expenses incurred while attending court on the Region’s behalf while on leave. d) Leave is defined for the purpose of this article as those absences where the employee is off work and is not being paid by the Region. e) Employees who do not return from leave shall be paid the salary or wages, mileage allowance and parking expenses, owing for the period of witness service at the time of their termination.
